The FOP REPRESENTATIVES clause defines the designation and role of individuals who act on behalf of the Fraternal Order of Police (FOP) within the context of the agreement. FOP REPRESENTATIVES. For the purposes of administering and enforcing the provisions of this Agreement, the Employer agrees as follows:
FOP REPRESENTATIVES. Representative(s) of the FOP shall be admitted to the Employer’s facilities for the purpose of processing grievances or attending meetings as permitted herein. Upon arrival, the FOP representative(s) shall identify themselves to the Employer or the Employer’s designated representative.
FOP REPRESENTATIVES. Bargaining unit members shall be entitled to have an FOP representative present during any matters of Internal Affairs Investigation where the employee is the subject of the investigation or in any meeting that the employee reasonably believes could result in disciplinary action but does not include Supervisory Reviews. The FOP representative may be an attorney paid for at the employee’s expense or a current employee designated by the FOP as a representative as chosen by the member that is not the employee’s immediate supervisor. FOP will provide training to current employees should they be designated to ensure basic understanding of their role in investigations.
FOP REPRESENTATIVES.
A. The Township agrees to grant time off to F.O.P. representatives for Association business in accordance with and not to exceed the following schedule:
1. One (1) day to the delegate designated by the F.O.P. as a delegate to attend the regular monthly meetings of the State Board of Delegates of the New Jersey State F.O.P.
2. One (1) week to attend the annual convention of the New Jersey State F.O.P. providing seventy-two (72) hours written notice is given to the Chief of the Department or his designee by the F.O.P. No more than three (3) employees (the F.O.P. President and two [2] delegates) shall be granted time off to attend the annual State F.O.P. convention.
3. Three (3) days to attend the annual convention. No more than two (2) employees (the F.O.P. President and delegate) shall be granted time off to attend the annual convention.
B. Accredited representatives of the F.O.P. may enter the Township facilities or premises at reasonable hours for the purpose of observing working conditions or assisting in the adjustments of grievances. When the F.O.P. decides to have its representatives enter the Township facilities or premises, it will request such permission which will not be unreasonably withheld, provided there shall be no interference with the normal operations of the business of Township Government or normal duties of employees.
C. Three (3) F.O.P. representatives and one (1) assistant F.O.P. representative may be appointed to represent the F.O.P. in grievances with the Township.
D. During collective negotiations, authorized F.O.P. representatives, not to exceed four (4), shall be excused from their normal work duties to participate in collective negotiations sessions that are reasonable and necessary and shall suffer no loss of regular pay.
FOP REPRESENTATIVES. 2.1. The FOP shall be represented by no more than two (2) local representatives or their two (2) designees at any one time. The representatives and their designees must be members of the bargaining unit covered by this Agreement.
2.2. The FOP agrees to notify the City Manager and the Chief of Police in writing the names of the two local representatives and two designees during the term of this Agreement. No representative shall engage in any union-related matters during work time, without the permission of a supervisor.
2.3. When any local representative, designee or member engages in union related matters, including, but not limited to: (1) either collective bargaining for a contract or a re-opener thereof;
FOP REPRESENTATIVES. Two (2) members of the FOP and an alternate shall be granted time off without loss of pay to attend negotiation sessions, mutually set, to renegotiate this Agreement. The City agrees to recognize three (3) FOP representatives appointed by the FOP excluding the state FOP staff representative, whose duties shall be to process grievances from members of the bargaining unit, and from time to time, through existing police department chain of command, bring to attention of the Chief conditions of mutual concern. It is agreed and understood by the parties that these three (3) FOP representatives may spend up to a total of ten (10) hours, collectively, per quarter, without loss of pay, with the prior approval of their supervisor, for the purpose of conducting FOP business. The supervisor’s approval shall not be unreasonably withheld, but shall consider the operational requirements of the Department and the City. The City agrees to allow the FOP and its representatives, whether State, Regional or National, reasonable access to the City Council meeting room for the conducting of FOP business when that room is not in normal use. The City will permit the said credited representatives of the FOP to have this reasonable access to the meeting room of the City at any time when not previously scheduled for another use during working hours to conduct FOP business, with prior approval of the Chief of Police and prior scheduling with the City Clerk. The FOP agrees not to use this access for the purpose of soliciting members.
FOP REPRESENTATIVES. A. The FOP may appoint up to four (4) grievance representatives to investigate and process grievances on behalf of the bargaining representative.
B. A written list of Lodge Representatives shall be furnished to the Chief of Police immediately after their designation and the FOP shall notify the Chief of Police promptly of any change of such representatives.
C. After giving seven (7) calendar days notice to the Division Commander, one (1) FOP Representative shall be granted reasonable time off during working hours with pay at an Employee’s regular rate when he is engaged in presenting a grievance under Steps 1-4 of Article 6 of this Agreement, and where it will not interfere with the operations of the Department.
FOP REPRESENTATIVES. A. The FOP may appoint up to ten (10) grievance representatives, who shall be assigned from their respective geographical sector of the school system, if at all practicable, to investigate and process grievances on behalf of the Union.
B. A written list of Lodge Representatives shall be furnished to the Department immediately after their designation, and the FOP shall notify the Department promptly of any change of such representatives.
C. After giving three (3) calendar days’ notice to the Division Commander, one (1) FOP representative shall be granted reasonable time off during working hours with pay when he is presenting a grievance under Steps 1 – 4 of this Agreement, and where it will not interfere with the operations of the Employer or require the Employer to incur overtime expenses.
FOP REPRESENTATIVES. The Township agrees to grant time off to F.O.P. representatives for Association business in accordance with and not to exceed the following schedule:
FOP REPRESENTATIVES. A. The FOP may appoint up to four (4) grievance representatives to investigate and process grievances on behalf of the bargaining representative.
B. A written list of FOP Representatives shall be furnished to the Sheriff immediately after their designation and the FOP shall notify the Sheriff promptly of any change of such representatives.
C. After giving three (3) calendar days notice to the First Sergeant, one (1) FOP Representative shall be granted reasonable administrative leave during working hours for the purpose of investigating and/or presenting a grievance under Article 5 of this Agreement, and where it will not interfere with the operations of the Department.
D. Up to four (4) Employees (a maximum of two (2) Employees from the same work group) designated by the FOP shall be provided administrative leave for time spent during meetings between the parties at times mutually agreed to by the parties for the purpose of negotiating a successor Agreement when such Employees are otherwise scheduled to work.
E. The Department shall notify the FOP of all new Employees and their addresses.
