Grievant Representation Clause Samples

The Grievant Representation clause defines the right of an employee (the grievant) to be represented during the grievance process. Typically, this means the employee may choose a union representative, legal counsel, or another designated individual to assist and advocate on their behalf in meetings, hearings, or discussions related to the grievance. This clause ensures that employees are not required to navigate complex dispute resolution procedures alone, thereby promoting fairness and protecting their interests throughout the process.
Grievant Representation. In the formal grievance procedure herein provided, the grievant shall at all times be entitled to be represented by the representatives of the Association or to appear with the assistance of such representatives; except at no time shall the grievant be represented by an administrative official of the school district. The Association and its affiliate, VT-NEA, shall be the sole and exclusive representative of the grievant.
Grievant Representation. 14 The grievant shall be present at all stages of the grievance procedures. The 15 grievant has the right of representation by the Association at all levels of the 16 grievance procedure. 1 ARTICLE XII.
Grievant Representation a. A grievant must be present at all levels of the grievance procedure. At the grievant's option, after Level One, a representative of the Association or an independent third party may be present to represent the member. b. When an individual is not represented by the Association in the processing of a grievance, the Association shall, at the time of submission of the written grievance to the Principal at Level 2 or any higher level, be notified by the Principal, in writing prior to all hearing sessions concerning the content of such grievance and shall receive a copy of all decisions rendered. The Association shall have the right, when it is not actively representing a grievant, to present its position in writing relevant to said grievance.
Grievant Representation. A unit member may be represented at all levels of the grievance procedure by himself/herself or, at his/her option, by a representative provided by the Association. If a unit member is not represented by the Association or its representative, the District shall not agree to a resolution of the grievance without first providing the Association with a copy of the grievance, the proposed resolution, and an opportunity to respond.

In the formal grievance procedure herein provided, the grievant shall at all times be entitled to be represented by representatives of the Association or to appear with the assistance of such representative, except at no time shall the grievant be represented by an administrative official of the school district. Any problem or potential problem will first be discussed by the grievant with the building principal in order to arrive at a mutually satisfactory solution to the complaint. At such meeting, the grievant may choose to be represented by the Association.
Grievant Representation. Within the above time limits, either party may request a conference with the other party. The grievant shall have the right to have a representative present at any meeting the grievant may have with administration.
