The Hour Break clause establishes the right of employees or parties to take a designated break period, typically after a set number of working hours. In practice, this clause specifies the duration and timing of such breaks, such as a 30-minute lunch break after four hours of continuous work, and may outline whether the break is paid or unpaid. Its core function is to ensure that individuals have adequate rest during work periods, promoting health, productivity, and compliance with labor regulations.
Hour Break. 5.9.1 When additional overtime work is necessary, it will, wherever reasonably practicable, be so arranged that an Employee has at least 10 consecutive hours off duty between the work of successive days.
5.9.2 An Employee who works so much additional overtime between the completion of the ordinary hours worked on one day and the commencement of the ordinary hours on the next day that the Employee has not had at least 10 consecutive hours off duty between those times will, subject to this sub-clause, be released after completion of such overtime until the Employee has had 10 consecutive hours off duty without loss of pay for ordinary working time occurring during such absence.
5.9.3 If, on the direction of the Company and in exceptional circumstances, an Employee resumes or continues work without having had 10 consecutive hours off duty, the Employee will be paid at double time until the Employee is released from duty for such period and the Employee will then be entitled to be absent until the Employee has had 10 consecutive hours off duty without loss of pay for ordinary hours occurring during such absence. Except where it is not practicable to provide a ten hour break when a company and it’s employees have been engaged by different contractors between the finish of one days shift (including overtime) and the start of the next, then the Employee will be paid at the rate of double time until the 10 hour break should of occurred.
5.9.4 Where an Employee is called into work on a Sunday or holiday prescribed under this Agreement preceding an ordinary working day, the Employee will, wherever reasonably practicable, be given 10 consecutive hours off duty before the usual starting time on the next day. If this is not practicable, then the Employee will be paid at the rate of double time until the accrual of 10 hours have been achieved.
5.9.5 The provisions of this sub-clause will apply in the case of shift Employees as if 8 hours were substituted for 10 hours when overtime is worked: • for the purpose of changing shift rosters; or • where a shift Employee does not report for duty; or • where a shift is worked by arrangement between the Employees themselves.
5.9.6 Overtime worked as a result of a recall will not be regarded as overtime for the purpose of this sub-clause when the actual time worked is less than 4 hours on such recall or on subsequent recalls.
Hour Break. (a) An employee who does not receive a 10 hour break before commencing short term Shift Work shall be entitled to double ordinary time for the first afternoon or night shift, or part thereof worked, and short term conditions and penalty rates for subsequent shifts.
(b) An employee who receives a 10 hour break prior to returning to day work shall be entitled to ordinary time for the hours that would normally be worked during the break period.
(c) An employee who does not receive a 10 hour break prior to returning to day work shall be paid double ordinary time for all hours worked until released for a 10 hour break.
Hour Break. An employee who works so much overtime between the termination of their ordinary work in one day and the commencement of their ordinary work on the next day, that the employee has not at least 10 consecutive hours off duty between those times shall, subject to clause 6.2.12, be released after completion of such overtime until the employee has had 10 consecutive hours off duty without loss of pay for ordinary working time occurring during such absence. If on the instructions of the employer such an employee resumes or continues work without having had such 10 consecutive hours off duty, they shall be paid double rates until the employee is released from duty for such period and they shall then be entitled to be absent until the employee has had 10 consecutive hours off duty without loss of pay for ordinary working time occurring during such absence: Provided that, where an employee is recalled to work after the ordinary ceasing time, overtime worked in such circumstances shall not be regarded as overtime for the purposes of clause 6.2.12, where the actual time worked is less than 3 hours on such recall or on each of such recalls. The provisions of clause 6.2.12 shall apply in the case of shift workers who rotate from one shift to another as if 8 hours were substituted for 10 hours when overtime is worked:
(a) For the purpose of changing shift roster; or
(b) Where a shift worker does not report for duty; or
(c) Where a shift is worked by arrangement between the employees themselves.
Hour Break. Employees, who work periods of overtime shall, whenever reasonably practicable, observe a break of 10 consecutive hours when a) period(s) of overtime and associated travelling time aggregate to 4 or more hours; or
Hour Break. When overtime is worked by an Employee who is paid a salary or wages not exceeding the rate for salary classification Level 6, a break of not less than ten (10) hours shall be taken between the completion of work on one day and the commencement of work on the next.
Hour Break. Employees shall be allowed a break of not less than 10 hours between the termination of one duty period and the commencing of another duty period: Provided that in lieu thereof, such break shall not be less than 8 hours in any of the following circumstances:
(a) to permit changes of rosters;
(b) in any other case agreed upon the employee and the employer. Where agreement has been reached between the employer and the employee to reduce the 10 hour break between duty periods to an 8 hour continuous break, due consideration shall be given to recognise that fatigue prevention must be, at all times, paramount to ensure that standards of care are not reduced.

Where an employee gets a nine (9) hour break prior to a call out but not after a call out, it is considered that they have had a 9 hour break and they would be required to work their full shift, the next day, at ordinary time. The nine hour break starts from the time the employee leaves work, whether this is the end of their shift or when they finish overtime (should that be the case). Employees who are on call should therefore be aware that if they are called out 9 hours after leaving work, they will not have another 9 hour break until after their next rostered shift. On-Call payments at T ½ will only be paid for the hours of the call out (minimum 3 hours) and not as part of normal working shift hours. You are on an 8 hour shift from 07.30 – 16.00, and then called out at 05.00 till 06.30 the following morning. You would have had your 9 hour break prior to being called out and as such you should work your normal 8 hour shift. You were due to start work at 7.00 am so stay at work and start half an hour earlier. You are on an 8 hour shift from 07.30 – 16.00, and then called out at 02.00 till 04.00 the following morning. You would have had your 9 hour break prior to being called out and as such you should work your normal 8 hour shift as rostered. Your next shift is not until 10.00 that day so you go home and come back at 10.00. You are on an 8 hour shift from 07.30 – 16.00, and then called out at midnight for four hours till 04.00. You haven’t had your 9 hour break prior to being called out and therefore you should not start your next shift until 13.00 and finish your shift the normal time. You will be paid for your normal shift.

Hour Break. (1) Employees are entitled to a 10-hour break between work periods on successive days.
(2) An Employee who works overtime between the termination of their Ordinary Hours on one day and the commencement of their Ordinary Hours on the next day who has not had a 10-hour break, is entitled to return to work at the expiry of the 10-hour break without loss of pay for their Ordinary Hours.
(3) When an Employee commences work at the City’s request without having had the 10-hour break, the Employee is entitled to be paid at 200% of their Ordinary Hours rate of pay until the expiry of the 10-hour period.
Hour Break. As far as operationally possible, Australian Bureau of Security & Investigations shall ensure that 8- 10 hours break between shifts is provided.
