HOURS OF WORK AND OVERTIME. 19.01 Nothing in this Agreement shall be construed as, or interpreted as, a guarantee of hours of work, whether per day, or week, or otherwise. 19.02 Subject to Article 19.01, the Employer shall, when creating job postings, be guided by the following principles, subject to operational requirements. a) Full shifts shall be of eight (8) hours duration, inclusive of a meal break. b) Shifts of lesser duration may be scheduled. c) Any shift of five (5) hours duration, or longer, will have a 30 minute meal break. d) Generally, meal breaks are unpaid, and the employee is free of any employment related duties or obligations. e) For each 3All employees shall have two (2) fifteen (15) minute rest periods for shifts in excess of seven-3/4 hours of a shiftand-a-half (7-1/2) hours, one before and one after the Employer shall schedule the employee to a paid 15 minute breakmeal period.
f) If an employee reports for work on any day, as required by the Employer, and starts work, the Employer shall pay the employee a minimum of four (4) hours of work at the regular wage, unless the work is suspended for a reason completely beyond the Employer’s control. If an employee reports for work on any day as required by the Employer, and the employee is fit and able to begin work, but does not commence work, at the Employer’s direction, the employee will be paid for two (2) hours of work.
g) A work schedule of two (2) weeks’ duration will be posted in a conspicuous location. The work schedule will be posted at least two (2) weeks prior to its effective date. If the Employer changes the scheduleIn all other cases, an employee will be given at least twenty-four (24) hours hours' notice of that changeany change must be given or two (2) additional hours' pay given in lieu of notice. The Employer is required to make a reasonable effort to verbally advise individual employees of the changes to their work schedule once it has been posted.
h) No employee shall be required to work in excess of six (6) consecutive days.

HOURS OF WORK AND OVERTIME. 19.01 Nothing 2.1 Eight consecutive hours, exclusive of meal period, shall constitute a day's work.
2.2 With the adoption of the shorter work week everything possible will be done to maintain the present output of work in offices where such employees are presently assigned less than eight hours per day. The employees agree to a review of the situation, upon request, at any time during the life of this Agreement at which time assigned hours of work may be discussed.
2.3 Where service required is intermittent, eight hours actual work within a spread of 12 hours shall constitute a day's work. Employees filling such positions shall be construed aspaid overtime for all time actually on duty or held for duty in excess of eight hours from time required to report for duty to the time of release, or interpreted as, a guarantee within 12 consecutive hours and also for all time in excess of 12 consecutive hours computed continuously from the time first required to report until final release. Time shall be counted as continuous service in all cases where the interval of work, whether per day, or week, or otherwiserelease from duty does not exceed one hour.
19.02 Subject to Article 19.01, 2.4 All work in excess of eight hours in any one day shall be considered as overtime and paid on the Employer shall, when creating job postings, be guided by actual minute basis at the following principles, subject to operational requirementsrate of time and one-half time.
a) Full shifts 2.5 Employees notified or called upon to work not continuous with, before or after the regular work period, shall be of eight (8) hours duration, inclusive of a meal break.
b) Shifts of lesser duration may be scheduled.
c) Any shift of five (5) hours duration, or longer, will have a 30 minute meal break.
d) Generally, meal breaks are unpaid, and the employee is free of any employment related duties or obligations. However, if the Employer designates an employee to be available during their meal break, and requires them to remain on the Employer’s premises, the Employer will pay them for the meal break. f) If an employee reports for work on any day, as required by the Employer, and starts work, the Employer shall pay the employee allowed a minimum of four (4) three hours of work at the rate of time and one-half for three hours' work or less and if held on duty in excess of three hours, time and one-half will be allowed on the minute basis.
2.6 Employees will not be required to suspend work during regular wage, unless the work is suspended for a reason completely beyond the Employer’s controlhours to absorb overtime.
2.7 Employees will be assigned two consecutive rest days off duty each week with preference given to Saturday and Sunday and then to Sunday and Monday. If an employee reports for required to work on any day as required by the Employersuch regularly assigned rest days, and the employee is fit and able to begin work, but does not commence work, they shall be paid at the Employer’s directionrate of time and one-half time on the actual minute basis with a minimum of three hours at time and one-half, the employee will for which three hours service may be paid for two (2) hours of workrequired.
g) A work schedule of two (2) weeks’ duration will 2.8 The pro rata hourly rate shall be posted in a conspicuous location. The work schedule will be posted arrived at least two (2) weeks prior by dividing the weekly rate by 40.

HOURS OF WORK AND OVERTIME. 19.01 14.01 The standard hours of work for which each employee shall receive his basic hourly rate shall be forty-four (44) working hours in a one (1) week period. Where an employee works hours outside of his regularly scheduled hours of work at the request of the Employer, the Employer agrees not to alter an employee's regularly scheduled hours of work, unless mutually agreed upon between the Employer and the employee.
14.02 Nothing in this Agreement Article shall be construed as, or interpreted as, to mean a guarantee of hours of work, whether work or work per day, day or per week, or otherwise.
19.02 Subject 14.03 For the purposes of this Article, a day shall commence at 12:01 a.m. and shall end at 12:00 midnight. A week shall commence at 00h01 Sunday and shall end at 24h00 Saturday. The normal pay for employees shall be bi-weekly and paid on a Friday by direct deposit at no charge to Article 19.01the employee. In the event a pay day falls on a statutory holiday, the pay will be deposited on the business day immediately preceding the holiday subject to the employee having a bank account at a major Canadian financial institution.
14.04 It is agreed by the Parties that part-time employees shall not be used to displace full-time employees.
14.05 Hours worked by an employee in excess of forty-four (44) hours in a week shall be paid at a rate of one and one-half (1½) times the employee's regular hourly wage. All hours worked in excess of twelve (12) hours shall be paid at the rate of one and one-half (1½) times the employee's regular hourly wage. All employees will be entitled to eleven (11) hours rest between shifts. Where employees are receiving overtime within a pay period due to the operation of this Article, the Employer shall, when creating job postings, be guided by agrees not to cancel any scheduled shift or hours of work of an employee for the following principles, subject to operational requirementspurposes of avoiding any further overtime payments.
a) Full shifts 14.06 Overtime shall be worked on a voluntary basis except:
i) in an emergency beyond the control of eight (8) hours duration, inclusive of a meal break.the Employer;
bii) Shifts of lesser duration may be scheduled.
c) Any shift of five (5) hours duration, or longer, will have a 30 minute meal break.
d) Generally, meal breaks are unpaid, and the employee is free of any employment related duties or obligations. However, if the Employer designates Employer's client requests emergency overtime; or
iii) in the event that an employee to be available during their meal break, and requires them to remain on the Employer’s premisesemployee's replacement does not report for work. In such cases, the Employer will pay them for the meal break. iv) The Employer agrees to begin work, but does not commence work, at provide transportation to the Employer’s direction, affected employee where the employee will be paid for two (2) hours is required to stay in accordance with this Article and the employee has no means of workpublic transportation.

Other schedules shall be permitted by mutual agreement of the Employer and the affected employee. Any work performed in excess of forty (40) hours per week, or eight (8) or ten (10) hours per day, depending on the employee will employee's assigned shift being a 5/8 or 4/10 arrangement, shall be paid at the rate of time and one-half the regular rate of pay, or paid in the form of compensatory time off in accordance with the compensatory time off provisions of this Agreement. All overtime shall be authorized in advance by the employee's supervisor and approved by the Sheriffs designee.
10.2 Each employee shall be allowed an established unpaid meal period of thirty (30) minutes or sixty (60) minutes, at the Employer's discretion. No employee shall be required to work more than five (5) consecutive hours without a meal period, unless there is a mutual agreement to waive the meal period. Employees working three (3) or more hours longer than a normal work day shall be allowed at least one thirty (30) minute meal period prior to or during the overtime period.
10.3 Each employee shall be allowed a rest period of fifteen (15) minutes in duration, on the Employer's time, for two each half shift of working time. Rest periods shall be scheduled as near as possible to the mid-point of each half shift. No employee shall be required to work more than three (23) hours without a rest period. The Employer shall endeavor to create/schedule as many forty (40) hour/week positions as possible. For clarity, unless the Part-Time employees shall not be assigned hours of work is suspended for a reason completely beyond the Employer’s control. If that could otherwise be performed by an employee reports for with less than forty (40) hours per week without the FT employee’s consent. Consistent with same, Part-Time employees shall be capped at twenty-four (24) hours/week with any/all additional hours of work on any day as required being offered by the Employer, and the employee is fit and able seniority to begin work, but those Full-Time employees with less than forty (40) hours/week prior to being offered/assigned to Part-Time positions. The above does not commence workapply in situations where an employee has left during his/her shift for medical/personal emergency situations in which case the PT employee may be assigned to replace the absent employee for the duration of the shift. In the interest of full transparency, at the Employer’s direction, the employee will be paid a composite Master Work Schedule for two (2) hours of work.
g) A work schedule of two (2) weeks’ duration will all employees in each respective location shall be posted in a conspicuous location. 14.03 There shall be two (2) fifteen-minute rest periods during eight (8) hour shift each shift and a thirty (30) minute lunch period. Save for express authorization, all breaks and meals are mandatory with the exception of clerks working alone. For every four consecutive hours a clerk that changeworks alone he/she shall be paid an additional fifteen (15) minutes of straight pay to compensate for the loss of the break time.
14.04 Overtime shall be paid at the rate of time and one-half for all hours worked in excess of eight (8) hours in one day or in excess of forty (40) hours in any one week. Overtime shall not be mandatory unless the Employer requires it to properly staff its facilities in which case the employee(s) with the least seniority in the classification shall be required to work.
14.05 Overtime will be divided as evenly as practicable amongst those employees normally performing the work within the classification in which the overtime is required. Every reasonable effort will be made to even out the hours amongst the forementioned employees during the life of this agreement.
14.06 There shall be a five (5) minute wash-up period before lunch and at the end of the shift.
14.07 All employees will be paid on Thursday of each week.
14.08 All work performed including money-related duties such as banking transactions, counting of float, totaling of dally receipts, etc. shall be conducted during working hours.
14.09 The Employer agrees not to create split shifts.
14.10 In the event of an error by the Employer on an employee's pay that results in an overpayment, the Employer shall discuss with the Employee a repayment plan that Is reasonable and feasible in mutual agreement with the Employee. If an employee leaves the employ of the Society of Saint ▇▇▇▇▇▇▇ ▇▇ ▇▇▇▇ before the repayment is completed the Employer shall deduct the remaining amount in full from the employee's final pay.

HOURS OF WORK AND OVERTIME. 19.01 Nothing in this Agreement The following is intended to define the normal hours of work for employees, but shall not be construed as, or interpreted as, as a guarantee of hours of work, whether work per day, day or per week, or otherwisedays of work per week.
19.02 Subject to Article 19.01a. For full-time employees, the Employer shallregular hours of work shall average seventy-five (75) hours bi-weekly with a seven and one-half (7½) hour daily shift excluding the meal period. 10.03 Call-in
11.01. The Employer shall maintain a list of employees who wish to be available for call-in. Employees shall be listed in order of seniority in accordance with Article 7.02 of the Collective Agreement. The call-ins shall be filed based on the principles of rotational seniority. The basic principles of this rotation are unpaidas follows:
a. The initial call-in shall begin with the most senior employee on the list who would have less than seventy-five (75) hours in a bi-weekly period,
b. The subsequent call-in shall begin with the person listed below the last employee to accept a call-in,
c. If it is not clear who is next, the most senior employee will be called first. An employee on the list must be bypassed if and only if one of the following reasons apply:
a. the employee is free of any employment related duties or obligationsalready scheduled,
b. the employee would be entitled to overtime if called-in (for example, according to Article 10.04b.). However, if After the Employer designates an employee to be available during their meal break, and requires them to remain on the Employer’s premisescall-in list has been completed, the Employer may elect to first call only employees bypassed for reason “a.” and attempt to arrange a mutually agreeable schedule change. The Employer must then call employees who were bypassed for reason “b.” above in the order in which they appear on the list. The Employer may then elect to call employees who have not indicated a desire to be on the call-in list, or employees excluded from the list under paragraph 4 below. Should there be an indication that the replacement required will pay them be for an extended period of two (2) days or more, keeping in mind the continuity of care, those shifts will be offered to one available part-time staff member, in order of seniority. Each call will be indicated on that part-time call-in sheet as "worked”, “no answer", "refused". "No answer" and "refused" shall be counted as "worked” for the meal breakpurpose of call-in rotation. Notwithstanding the payment, if the break is interrupted, then subject to operational requirements, the Employer will endeavour to extend or reschedule the interrupted portion of the meal break.
e) For each 3-3/4 hours of a shift, the Employer shall schedule the employee to a paid 15 minute break.
f) If an employee reports to work at the regularly scheduled time for her shift and no work on any dayis available, as required such employee will be entitled to four (4) hours pay at the employee's regular rate provided that:
a. the employee has not been previously notified by the Employer to the contrary;
b. if requested by the Employer, and starts work, the Employer shall pay the employee shall perform for a minimum of four (4) hours such available work as the Employer may assign;
c. the employee has kept the Employer informed of work at the regular wage, unless the work is suspended for a reason completely beyond the Employer’s controlher current address and phone number. If an employee reports for work on any day as required by the Employer, and the employee is fit and able to begin work, but does not commence work, at the Employer’s direction, the employee will be paid for two (2) hours of work.
g) A work schedule of two (2) weeks’ duration consecutive days off.
(b) The ordinary working shift for Dietary Attendants and Cooks will be posted seven and one-half (7.5), or four (4) hours;
(c) The ordinary working shift for Service Attendants will be nine and one-half (9.5), seven and one-half (7.5), or six (6) hours;
(d) The ordinary working shift for Dishwashers is four (4) hours;
(e) The ordinary working shift for the Linen Folder (a position created to allow employment to challenged populations) is one (1) hour;
(f) The ordinary working shift for the Maintenance Attendant is five (5) hours.
(g) Time worked in excess of 44 hours in a conspicuous locationweek shall be considered as overtime. The All employees who work schedule in excess of 44 hours in a week shall be paid one and one half (1 ½) times their regular rate of pay for the excess hours, or provided compensating time off at that rate.
(h) If an employee is required to remain on shift until his/her replacement has arrived they shall be paid at straight time, unless the length of stay means that their weekly hours exceed 44, whereupon they will be posted compensated at least time and one half (1 ½) times their regular rate of pay for time worked, or they will be given equal time off which may be accumulated. Time off will be taken within a two (2) month period at a time mutually agreeable to the employee and the Supervisor.

HOURS OF WORK AND OVERTIME. 19.01 Nothing in this Agreement
22.01 The standard work week for employees shall be construed as, or forty (40) hours per week.
22.02 The provisions of this Article are not to be interpreted as, as a guarantee of or a limitation upon the hours of work, whether work to be done per day, day or per week or otherwise nor as a guarantee of working schedules but shall serve to assist the parties in the computation of regular pay and overtime pay. An employee who has worked more than his/her regular scheduled hours in a day shall be entitled to overtime pay for those excess hours if he/she works his/her full scheduled work week, or otherwise. The requirement of working his/her full scheduled work week does not apply to a reduction in hours:
(a) If the Company reduces his/her regularly scheduled straight time during the rest of the week.
19.02 Subject to Article 19.01, the Employer shall, when creating job postings, be guided by the following principles, subject to operational requirements.
a) Full shifts shall be of eight (8) hours duration, inclusive of a meal break.
b) Shifts of lesser duration may be scheduled.
c) Any shift of five (5) hours duration, or longer, will have a 30 minute meal break.
d) Generally, meal breaks are unpaid, and If the employee is free off work because of any employment related duties union business, bereavement leave, vacation, approved leave of absence or obligationshospitalization.
22.03 Employees will be given a thirty (30) minute lunch period without pay during their working shift.
22.04 There shall be no pyramiding of overtime rates.
22.05 Overtime shall initially be on a voluntary basis. However, if the Employer designates Company is unable to secure sufficient volunteers from amongst persons who have previously satisfactorily performed the work, such persons shall be required to work in reverse order of seniority. The Company shall keep up-to-date records of all overtime worked for employees' inspection.
22.06 Employees shall be allowed an employee to uninterrupted ten (10) minute rest period approximately midway through each half shift.
22.07 Those functions operating on a three (3) shift per day basis are currently scheduled as follows: Plant 7:00 a.m. - 3:00 p.m. Warehouse 7:00 a.m. - 3:30 p.m. Plant 3:00 p.m. - 11:00 p.m. Warehouse 3:30 p.m. - 12:00 a.m. Plant 11 p.m. - 7:00 a.m. Warehouse To be available during their meal break, and requires them to remain on the Employer’s premises, the Employer will pay them for the meal break. Notwithstanding the payment, discussed if the break is interrupted, then required subject to operational requirements, the Employer will endeavour to extend or reschedule following:
(a) This shall not prevent the interrupted portion scheduling of the meal break.
e) For each 3-3/4 hours of a shift, the Employer shall schedule the employee to a paid 15 minute break.
f) If an employee reports for work on any day, individual functions at other times as required by operations. The Company agrees to discuss any changes in advance with the Employer, Union.
(b) The lunch break for persons on such functions are twenty-five (25) minutes paid and starts workthe rest break of fifteen (15) minutes paid is once per shift.
22.08 Whenever any permanent changes to any scheduled shifts are required, the Employer shall pay Company will communicate the employee a minimum details of four (4) hours of work at such change to the regular wage, unless the work is suspended for a reason completely beyond the Employer’s control. If an employee reports for work on any day as required by the Employer, and the employee is fit and able to begin work, but does not commence work, at the Employer’s direction, the employee will be paid for two (2) hours of work.
g) A work schedule of two (2) weeks’ duration will be posted in a conspicuous location. The work schedule will be posted at least two (2) weeks Union prior to its effective date. If the Employer changes the schedule, an employee will be given at least twenty-four (24) hours notice of that change.

HOURS OF WORK AND OVERTIME. 19.01 14.01 The standard hours of work for which each employee shall receive their basic hourly rate shall be forty-four (44) working hours in a one (1) week period. Where an employee works hours outside of their regularly scheduled hours of work at the request of the Employer, the Employer agrees not to alter an employee's regularly scheduled hours of work, unless mutually agreed upon between the Employer and the employee.
14.02 Nothing in this Agreement Article shall be construed as, or interpreted as, to mean a guarantee of hours of work, whether work or work per day, day or per week, or otherwise.
19.02 Subject 14.03 For the purposes of this Article, a day shall commence at 12:01 a.m. and shall end at 12:00 midnight. A week shall commence at 00h01 Friday and shall end at 24h00 Thursday. The normal pay for employees shall be bi- weekly and paid on a Thursday by direct deposit at no charge to Article 19.01the employee. In the event a pay day falls on a statutory holiday, the pay will be deposited on the business day immediately preceding the holiday subject to the employee having a bank account at a major Canadian financial institution.
14.04 It is agreed by the Parties that part-time employees shall not be used to displace full-time employees.
14.05 Hours worked by an employee in excess of forty-four (44) hours in a week shall be paid at a rate of one and one-half (1½) times the employee's regular hourly wage. All hours worked in excess of twelve (12) hours shall be paid at the rate of one and one-half (1½) times the employee's regular hourly wage. All employees will be entitled to eleven (11) hours rest between shifts. Where employees are receiving overtime within a pay period due to the operation of this Article, the Employer shall, when creating job postings, be guided by agrees not to cancel any scheduled shift or hours of work of an employee for the following principles, subject to operational requirementspurposes of avoiding any further overtime payments.
a) Full shifts 14.06 Overtime shall be worked on a voluntary basis except:
(i) in an emergency beyond the control of eight the Employer;

(iv) The Employer agrees to begin work, but does not commence work, at provide transportation to the Employer’s direction, affected employee where the employee will be paid for two (2) hours is required to stay in accordance with this Article and the employee has no means of workpublic transportation.

g) 18.02 A work schedule showing the hours of two (2) weeks’ duration will each employee shall be posted by Thursday at 11:00 am for the following week. Any changes to the work schedule which result in a conspicuous locationreduction of an employee's scheduled work - week requires notice of forty-eight (48) hours in advance. The Changes to the work schedule will be posted at least two (2) weeks prior to its effective date. If the Employer changes the schedule, which result in an employee will be given at least increase to an employee's scheduled work week requires twenty-four (24) hours notice, in advance, in order to compel an employee to report to work, except in cases of sickness, bereavement or accident causing a shortage of staff. (a) Each employee shall be allowed one fifteen (15) minute rest period for each four (4) hour work segment, exclusive of that changethe meal period, and such time shall be regarded as time worked. No employee shall be required to work five (5) consecutive hours or more without being provided with a one-half (½) hour unpaid meal period.
(b) Where the Company compels employees not to take their meal break due to service requirements, they shall be granted an additional hours’ pay in lieu of said meal break at regular straight time.
(c) Where the Company compels employees not to take their rest breaks due to service requirements, they shall be granted an additional hours pay in lieu of said rest breaks at regular straight time.
(d) The above payments (in lieu of break entitlements) shall be paid on if the manager or supervisor on duty decides service requirements make it impossible for the employee to take rest or meal breaks during his shift.
18.04 Once a full-time employee reports to work on his regularly scheduled day, he shall receive guaranteed pay for eight (8) hours save and except food and beverage servers, who shall receive six (6) guaranteed hours. Part-time and banquet employees shall receive four (4) guaranteed hours. Notwithstanding the above, full-time employees may be scheduled for four

f) If an employee reports for work on any day, as required by the Employer, and starts work, the Employer shall pay the employee a minimum of four (4) hours of work at the regular wage, unless the work is suspended for a reason completely beyond the Employer’s control. If an employee reports for work on any day as required by the Employer, and the employee is fit and able to begin work, but does not commence work, at the Employer’s direction, the employee will be paid for two (2) existing hours of work.
g) A 5.02 Authorized work schedule performed, in excess of the standard workweek or standard workday, shall be paid at the premium rate of time and one-half the employee's regular straight time rate of pay.
5.03 The normally assigned hours of work shall be as follows: Day work: 8:00 a.m. to 4:30 p.m. Two shifts: 6:00 a.m. to 2:00 p.m. 2:00 p.m. to 10:00 p.m. Three shifts: 8:00 a.m. to 4:00 p.m. 4:00 p.m. to midnight midnight to 8.00 a.m. Employees on day work will be allowed one-half hour for lunch, without pay; employees on shift work will be allowed time for lunch not exceeding thirty minutes, with pay. It is understood that lunch periods will be staggered so that production can continue without interruption.
5.04 Time and one-half the straight time shall be paid for work performed on Saturday and double the straight time rate shall be paid for work performed on Sunday.
5.05 An employee who is required to work a minimum of two (2) weeks’ duration hours' overtime continuous with his regular shift shall be paid a $6.00 meal allowance. An additional meal allowance will be posted paid to such employee in the event he is required to work a conspicuous locationminimum of seven hours' overtime continuous with his regular shift.
5.06 The Company will schedule for each employee, a break period of ten minutes during the first half and a second break period of ten minutes during the second half of each regular shift.
5.07 An employee called in to perform work not continuous with his regular work period (i.e. left and called back early or called in early on an emergency unscheduled basis), shall be paid a minimum of four hours' pay at time and one-half his regular straight time rate. In no event will there be a duplication with the overtime provisions of the Collective Agreement.
5.08 It is understood that, except in cases of emergency, overtime will be distributed as equally as is reasonable amongst those employees who are qualified and normally perform the work. The work schedule Company will approach such employees on a voluntary basis but, in the event that sufficient volunteers are not available, the company shall detail the qualified junior employees to perform the required overtime work. If an employee reports needs to be relieved of active work time for any period of time during their work on any day as required by shift, they must request to use their own leave and such requests are subject to supervisory approval prior to the Employer, and the use of such leave. An employee is fit and able not required to begin work, but does not commence work, at the Employer’s direction, the employee will be paid for use their leave to take their two (2) hours fifteen (15) minute breaks (or rest period), which cannot be combined. Insofar as is possible, breaks (or rest periods) shall be scheduled in the middle of workeach half of the shift. It is understood and agreed that the inability to permit an employee to take a rest period shall not be the basis for any claim for overtime compensation.
g7.3.1.2 Full-time employees in the Senior Airport Operations Specialist classification (3514) A may not leave Airport property, unless performing work schedule off-site as directed by their supervisor, and must be available to perform activities that are work related during their entire work shift. If an employee needs to leave Airport property and/or is unavailable to perform activities that are work related for any reason during their work shift, they must request to use their own leave and such requests are subject to supervisory approval prior to the use of such leave.
7.3.1.3 Full-time employees in the Animal Services Officer classification (3252), and/or full-time employees in the Senior Animal Services Officer classification (3251) may be required to respond to emergency calls and must be available to perform activities that are work related during their entire work shift. If an employee is unavailable to perform activities that are work related for any reason during their work shift, they must request to use their own leave and such requests are subject to supervisory approval prior to the use of such leave.
7.3.2 Full-time employees in the Community Service Officer I/II classification (6131/6132) and/or in the Senior Community Services Officer classification (6133) will work without an unpaid lunch period during their shift, including but not limited to working a straight ten (10) hour shift for four (4) days a week without an unpaid lunch.
7.3.2.1 For the duration of their work shift, full-time employees in the Community Service Officer l/ll classification (6131/6132) and in the Senior Community Service Officer classification (6133) will be required to perform activities that are work related and, during their work shift, they may not be relieved of active work time. If an employee needs to be relieved of active work time for any period of time during their work shift, they must request to use their own leave and such requests are subject to supervisory approval prior to the use of such leave. An employee is not required to use their leave to take their two (2) weeks’ fifteen (15) minute breaks (or rest periods), which cannot be combined. Insofar as is possible, breaks (or rest periods) shall be scheduled in the middle of each half of the shift. It is understood and agreed that the inability to permit an employee to take a rest period shall not be a basis for any claim for overtime compensation.
7.3.2.2 For the duration will of their shift, full-time employees in the Community Service Officer l/ll classification (6131/6132) and in the Senior Community Service Officer classification (6133) may be posted required to respond to emergency calls and must be available to perform activities that are work related during their entire work shift. 7.4 The work period for purposes of the Fair Labor Standards Act may be designated for each employee as appropriate so that there is no overtime built into the regularly scheduled workweek.

HOURS OF WORK AND OVERTIME. 19.01 Nothing in this Agreement
13.01 The normal work schedule for each employee shall be construed asmade available to an employee or Union Representative upon request.
13.02 An employee who reports for his/her scheduled shift and finds that no work is available will be paid for four and one half (4.5) hours or the length of his/her scheduled shift (whichever is less) at his/her regular rate of pay unless the employee received forty-eight (48) hours notification not to report to work or the unavailability of work is the result of cause beyond the control of the Employer, i.e. fire, flood, strike or interpreted asan act of God, etc. Clarity Note: ‘Act of God’ shall not include disruptions of work related to snowstorms
13.03 The Employer agrees to distribute excess work as equitably as possible among available, qualified employees. This work will be offered to employees in the classification normally assigned to perform work.
13.04 The Employer agrees to pay time and one-half (1 1/2) the hourly rate established in Schedule "A" for all hours paid in excess of forty-four (44) hours in a guarantee work week.
13.05 The Employer will not reschedule any employees for the purpose of avoiding overtime.
13.06 Available overtime opportunities shall be offered equitably, on a rotational basis, to employees who have expressed their desire to work overtime and are available.
13.07 The parties agree that bargaining unit employees employed on the date of ratification of this Collective Agreement will suffer no reduction in hours of work, whether per dayfor the life of this Agreement, unless a tenant vacancy occurs resulting in a decrease in the area to be cleaned, or week, or otherwisea request is made by the customer to reduce operating costs. Nothing in this article shall prevent the Employer from laying off employees pursuant to the lay-off provisions (11.04).

Any changes to the work schedule which result in a conspicuous locationreduction of an employee's scheduled work - week requires notice of forty-eight (48) hours in advance. The Changes to the work schedule will be posted at least two (2) weeks prior to its effective date. If the Employer changes the schedule, which result in an employee will be given at least increase to an employee's scheduled work week requires twenty-four (24) hours notice, in advance, in order to compel an employee to report to work, except in cases of sickness, bereavement or accident causing a shortage of staff. (b) Where the Company compels employees not to take their meal break due to service requirements, they shall be granted an additional hours’ pay in lieu of said meal break at regular straight time.
(c) Where the Company compels employees not to take their rest breaks due to service requirements, they shall be granted an additional hours pay in lieu of said rest breaks at regular straight time.
(d) The above payments (in lieu of break entitlements) shall be paid on if the manager or supervisor on duty decides service requirements make it impossible for the employee to take rest or meal breaks during his shift.
18.04 Once a full-time employee reports to work on his regularly scheduled day, he shall receive guaranteed pay for eight (8) hours save and except food and beverage servers, who shall receive six (6) guaranteed hours. Part-time and banquet employees shall receive four (4) guaranteed hours.
18.05 Overtime for all employees shall be defined as all hours worked by an employee in excess of forty (40) hours in any week, eight (8) hours per working day, on an employee's scheduled day off during his vacation period or on each consecutive day of work after five (5) days.
18.06 All overtime shall be paid at the rate of time and one-half the regular rate of pay.
a) At the employee’s option, overtime shall be compensated in one of the following manners:
i) Pay, subject to statutory deductions;
ii) Compensatory time off in lieu, converted to the straight time equivalent.

HOURS OF WORK AND OVERTIME. 19.01 Nothing in this Agreement 11.01 The following paragraphs and sections are intended to define the normal hours of work and shall not be construed as, or interpreted as, as a guarantee of hours of workwork per day or per week or of days of work per week. The Company will endeavour to staff all shifts on a volunteer basis. In the event that the number of volunteers is less than the shift requirements, whether per dayall other departmental workers will fill the remaining vacancies on a rotating basis. The Company reserves the right to limit the number of volunteers on any shift, or weekif the combined skill level of a shift is below Company standards. Volunteers steadily employed on any shift other than Shift 1, or otherwise.
19.02 Subject will not normally be required to Article 19.01participate in any rotation schedule. Leadhands will be exempt from rotation. Employees who have more than 30 years seniority may request permanent assignment to Shift 1. The total number of employees assigned to Shift 1 may not exceed 25% of the total number of departmental employees. Should more employees request assignment than are allowed, the Employer shall, when creating job postings, requests will be guided by the following principles, subject to operational requirementsgranted on a seniority basis.

(a) The basic work week for employees covered by this Agreement shall consist of a five (5) day, or week, or otherwise.
19.02 Subject to Article 19.01, the Employer shall, when creating job postings, be guided by the following principles, subject to operational requirements.

The current schedule of hours as at date of ratification shall not be changed unless, due to sensitive products, cross contamination, H.A.C.C.P. requirements and physical restrictions to separate packaging requirements make it impossible to meet customer requirements in which case start times will only be changed as is necessary. Affected employees will be notified by Friday of the previous week. The incumbents doing the job now will be asked first, then the Company will ask employees in order of seniority and if there are insufficient volunteers to work, the company will schedule the junior most employee in reverse order.
(c) A work schedule will be posted on the bulletin board by Friday noon hour for the following week.
(d) With the exception of the unpaid meal period which shall be one-half (½) hour in duration, or longer, will have a 30 minute meal breakdaily hours of work shall be consecutive. The Company agrees to continue its present practice of providing cooked meats that are brought to the lunchroom by an employee designated by the ▇▇▇▇▇▇▇ in the kitchen to be consumed on Company premises.

(f) Any employee reporting for work unless otherwise notified a minimum of two (2) hours prior to the start of his/her shift, not to report for work, and for whom no work is available, shall be entitled to a minimum of three (3) hours at their straight time rate except when the employee:
a) is prevented by events outside the control of the Company;
b) is prevented from working because of an act of God such as power failure, flood or fire; or
c) did not keep the Company advised of his/her current address and telephone number.”
(g) The Company agrees it shall not use part-time or student employees within a classification which any Full Time employee(s) are on reduced scheduled hours or lay-off
(a) The Company agrees to pay employees for all hours worked in excess of or outside of the daily or weekly schedule at the rate of time and one-half (1 ½) the standard rate of pay. The Company agrees to pay employees at the rate of time and one-half (1 ½) for all authorized hours in excess of forty (40) hours in a week. Effective July 3, 1989, the Company agrees to pay employees at the rate of time and one-half (1 ½) for all authorized hours worked in excess of eight (8) hours in a day. It is recognized that the Company will require reasonable overtime work from time to time and the Union as agent of the employees agrees that the employees shall perform such overtime work, unless the employee has a legitimate personal commitment that prevents him from performing the overtime work. Overtime work shall be offered:
(1) To those employees who normally perform the work required.
(2) Amongst those that have sufficient ability and qualifications to perform the required work.
(3) By seniority. Should the factors in 2 above be relatively equal then 3 shall govern.
(b) Those employees who are required to work on Saturday or a paid holiday will be paid for all hours worked on such Saturday or paid holiday at time and one-half (1 ½) their regular hourly rate of pay and shall be guaranteed a minimum of three (3) hours’ pay at the premium rate.
(c) Those employees who are required to work on Sunday will be paid for all hours worked on such Sunday at two (2) times their regular hourly rate of pay and shall be guaranteed a minimum of three (3) hours’ pay at the premium rate.
(d) GenerallyEmployees shall not be given time off to avoid the application of overtime rates.
(e) In no event shall overtime or premium compensation be duplicated, meal breaks are unpaid, and the employee pyramided or compounded.
(f) Where two (2) or more hours of daily overtime is free of any employment related duties or obligations. However, if the Employer designates an employee to be available during their meal break, and requires them to remain on the Employer’s premisescontemplated, the Employer will pay them for the meal break. If an employee reports needs to be relieved of active work time for any period of time during their work on any day as required by shift, they must request to use their own leave and such requests are subject to supervisory approval prior to the Employer, and the use of such leave. An employee is fit and able not required to begin work, but does not commence work, at the Employer’s direction, the employee will be paid for use their leave to take their two (2) hours fifteen (15) minute breaks (or rest period), which cannot be combined. g7.3.1.2 Full-time employees in the Senior Airport Operations Specialist classification (3514) A may not leave Airport property, unless performing work schedule off-site as directed by their supervisor, and must be available to perform activities that are work related during their entire work shift. If an employee needs to leave Airport property and/or is unavailable to perform activities that are work related for any reason during their work shift, they must request to use their own leave and such requests are subject to supervisory approval prior to the use of such leave. 7.3.1.3 Full-time employees in the Animal Services Officer classification (3252), and/or full-time employees in the Senior Animal Services Officer classification (3251) may be required to respond to emergency calls and must be available to perform activities that are work related during their entire work shift. If an employee is unavailable to perform activities that are work related for any reason during their work shift, they must request to use their own leave and such requests are subject to supervisory approval prior to the use of such leave.
7.3.2 Full-time employees in the Community Service Officer I/II classification (6131/6132) and/or in the Senior Community Services Officer classification (6133) will work without an unpaid lunch period during their shift, including but not limited to working a straight ten (10) hour shift for four (4) days a week without an unpaid lunch.
7.3.2.1 For the duration of their work shift, full-time employees in the Community Service Officer l/ll classification (6131/6132) and in the Senior Community Service Officer classification (6133) will be required to perform activities that are work related and, during their work shift, they may not be relieved of active work time. If an employee needs to be relieved of active work time for any period of time during their work shift, they must request to use their own leave and such requests are subject to supervisory approval prior to the use of such leave. An employee is not required to use their leave to take their two (2) weeks’ fifteen (15) minute breaks (or rest periods), which cannot be combined. Insofar as is possible, breaks (or rest periods) shall be scheduled in the middle of each half of the shift. It is understood and agreed that the inability to permit an employee to take a rest period shall not be a basis for any claim for overtime compensation.
7.3.2.2 For the duration will of their shift, full-time employees in the Community Service Officer l/ll classification (6131/6132) and in the Senior Community Service Officer classification (6133) may be posted required to respond to emergency calls and must be available to perform activities that are work related during their entire work shift. If an employee is unavailable to perform activities that are work related for any reason during their work shift, they must request to use their own leave and such requests are subject to supervisory approval prior to the use of such leave.

HOURS OF WORK AND OVERTIME. 19.01 Nothing in 10.01 It is understood and agreed that this Agreement Article is intended to provide the basis of a work week and shall be construed as, or interpreted as, not constitute a guarantee of hours of work, whether work per day, day or per week, number of days per week or otherwise.
19.02 as a guarantee of work schedules. The Employer retains the right to arrange and rearrange the hours of work and the shift schedules of all employees to ensure maximum utilization of personnel and overall efficiency at the Employer’s operations. Subject to Article 19.01the other provisions of this Collective Agreement, should it be necessary for the Employer to change the present hours of work, the Employer shallwill provide affected employees and the Union with as much advance notice as possible, when creating job postings, be guided by the following principles, subject to operational requirementsbut not less than two weeks’ notice.
a) Full shifts 10.02 The current basic straight time work schedule shall be of eight (8) hours duration, inclusive of a meal break.
b) Shifts of lesser duration may be scheduled.
c) Any shift of five (5) hours durationdays, or longerforty (40) hour work week, will have Monday through Friday. When operating a 30 minute meal breakthree shift schedule, the Monday work day shall begin at the start of the Monday morning shift.
d) Generally, meal breaks are unpaid, and the employee is free of any employment related duties or obligations. 10.04 In an eight (8) hour shift there shall be a paid ten (10) minute break in the first half of the shift together with a twenty (20) minute paid lunch.
10.05 Where employees are scheduled to work a minimum of two (2) hours overtime, employees shall be provided with one (1) paid ten (10) minute break on overtime shifts that changefollow immediately after the employee’s scheduled shift and every completed two (2) hours of work thereafter. Where possible and depending on business circumstances, the first break shall be taken prior to the commencement of the overtime work.

HOURS OF WORK AND OVERTIME. 19.01 Nothing in 31.01 It is expressly understood and agreed that the provisions of this Agreement shall be construed asArticle (Article 31) are for the purposes of computing overtime, or interpreted as, and that the statement of Regular Hours of Work herein is not a guarantee of that the work will be provided, nor that the hours of workwork will not be changed if found necessary or desirable by the Home, whether in the interest of efficiency or economy.
31.02 As it is understood and agreed that the Home is a twenty-four (24) hours per day, or weekseven (7) days per week continuous operation, or otherwiseand the service must be maintained on a rotating basis, it is agreed that the nursing staff and any other employees directed to do so, may be required to work three (3) shifts on a rotating basis of one (1) week intervals, whenever possible. The Home will endeavour to require the employee to work only two (2) shifts on a rotating basis. In the event that additional shifts are added to the schedule, the parties agree to meet to review the schedule to try and move staff to only two (2) shifts before creating a new position.
19.02 Subject to Article 19.01, the Employer shall, when creating job postings, be guided by the following principles, subject to operational requirements.
a) Full shifts 31.03 The regular working schedule for employees (which shall be posted at least one (1) month in advance) over a two (2) week cycle, shall consist of no more than seventy-five (75) hours with eight (8) days off in each four (4) week period, commencing with the first working schedule posted after the implementation of this Collective Agreement. No employee shall be scheduled to work for more than seven and one-half (7½) hours durationper day, inclusive nor to work for more than forty- five (45) hours in any seven (7) day period. Time off shall, as far as possible, be arranged so as to permit all employees to have an equal number of weekends off. This provision shall not apply in the case of employees who work weekends at their request. A weekend shall be defined as those shifts in which a meal breakmajority of the hours worked fall on a Saturday and a Sunday. This Article shall not apply to part-time employees.
b31.04 A part-time employee shall not be scheduled to work more than seven and one- half (7½) Shifts of lesser duration may be scheduledhours per day.
c) Any shift of five (5) hours duration, or longer, will have a 30 minute meal break.
d) Generally, meal breaks are unpaid, and the 31.05 An employee is free of any employment related duties or obligations. This Article shall not apply in the case of any labour dispute, emergency (such as fire, flood, power shortage, or storm) or employees returning to work without notice after absence.
31.06 Overtime shall only be earned by an employee for each hour or part thereof worked in excess of seventy-five (75) hours bi-weekly or seven and one-half (7½) hours per day. The Home agrees that overtime shall be paid at the rate of one and one-half (1½) times the regular hourly rate of pay. No overtime shall be paid to an employee who works in excess of his regularly scheduled hours of work, on a bi-weekly basis, as a result of exchange of shifts or for reasons of personal convenience.
31.07 The Home agrees that no employee shall be scheduled to work at a split shift unless mutually agreed by the regular wage, unless Home and the employee.
31.08 Opportunities for overtime work shall be distributed by the Home as equally as is practical among the employees who normally perform the work is suspended involved.
31.09 Employees will be paid a shift premium of twenty-eight cents (28¢) per hour for each hour worked between the hours of 3:00 p.m. and 11:00 p.m. Employees will be paid a reason completely beyond night premium of thirty-five cents (35¢) per hour for each hour worked between the Employer’s controlhours of 11:00 p.m. and 7:00 a.m.
31.10 Employees required to work overtime, without advance notice from the Home, for three (3) or more hours of overtime will receive a meal from the kitchen. If an employee reports for work on any day as required by the Employer, and the employee such is fit and able to begin work, but does not commence work, at the Employer’s directionavailable, the employee will receive a meal allowance of five dollars ($5.00).
31.11 New employees shall receive a minimum of three (3) working shifts of orientation, at the discretion of the Home, at fifty percent (50%) of the starting rate of pay to probationary employees but no less than minimum wage. During this orientation, the employee shall be paid for an extra.
31.12 An employee will endeavour to provide at least one (1) hour notice to the Home when he/she will not be able to attend a regularly scheduled day shift and two (2) hours of workwhen unable to attend an afternoon or night shift.
g) A work schedule of two (2) weeks’ duration will be posted in a conspicuous location. The work schedule will be posted at least two (2) weeks prior to its effective date. If the Employer changes the schedule, an employee will be given at least twenty-four (24) hours notice of that change.

(a) The basic work week for full-time employees will consist of forty (40) hours per week, made up of five (5) days of eight (8) consecutive hours’ duration.
(b) The schedules of hours for the following week will be posted by Thursday noon and shall be written in ink. If A copy of the weekly schedules with any changes when requested will be made available to the shop ▇▇▇▇▇▇▇.
(c) Full-time employees will be given three (3) days notice of a change in their work schedules, however, the three (3) days notice will not be required in case of sickness, accident or emergency i.e. snowstorm, power failure, floods or acts beyond the control of the Owner. In cases where the three (3) days’ notice need not be given, notice will be given as far in advance as possible.
(d) When a full-time employee is ordered to report to work on any day, he shall be guaranteed four (4) hours pay on that day. The only exception to this will be in the case of an employee verifying refrigeration equipment.
(e) The employer agrees not to schedule split shifts unless mutually agreed to by the Company and the individual employee.
(f) The employer may schedule staff meetings of approximately two (2) hours duration not more than two (2) times per calendar year. Where such meeting is scheduled on a Sunday, the Sunday work provisions of the Collective Agreement shall apply. Notwithstanding the above, employees will be paid straight time without premium pay for the duration of the meeting.
(a) Overtime at the rate of time and one-half (1½) the regular hourly rate will be payable after eight (8) hours in a day and forty (40) hours in a week.
(b) Overtime at the rate of two (2) times the regular hourly rate will be payable for all hours worked on Statutory Holidays and Sundays where the store is not open for customer shopping convenience. For employees hired after June 3, 2012, overtime at the rate of time and one-half the regular hourly rate will be payable for all hours worked on Statutory Holidays.
(c) The Employer agrees that the store will not be opened for customer shopping convenience on Sundays unless legally permitted to do so under the Retail Business Holidays Act.
(d) Sunday work shall be voluntary for all full-time and part-time employees hired prior to January 3, 2008 and they will continue to receive a Sunday premium of $1.60 for all hours worked on a Sunday. Sunday work will continue to be over and above the work week for full-time and part-time employees hired prior to January 3, 2008, unless mutually agreed otherwise between the Employer changes and the scheduleemployee concerned. Sunday is not voluntary for any employee hired after January 3, 2008. Similarly, for part-time employees promoted to full-time after January 3, 2008, Sunday is not voluntary. Sunday shall be part of the regular work week and shall be paid at regular time for any employee hired after January 3, 2008 or promoted to full- time after January 3, 2008.
(e) Any overtime that occurs on any given shift shall be offered to the employee in accordance with their seniority, on a shift basis, provided the employee has the knowledge, skill, ability and qualifications to perform the work.
11.04 During each work day, an employee will shall be given at least twentygranted two (2) rest periods with pay of fifteen (15) minutes in duration each and one (1) hour unpaid (one-four half (24½) hours notice hour by mutual consent) meal period, scheduled as near to the mid-point of that changeeach half shift and the mid-point of the daily shift as is practicable with store operations.

If an employee reports needs to be relieved of active work time for any period of time during their work on any day as required by shift, they must request to use their own leave and such requests are subject to supervisory approval prior to the Employer, and the use of such leave. An employee is fit and able not required to begin work, but does not commence work, at the Employer’s direction, the employee will be paid for use their leave to take their two (2) hours fifteen (15) minute breaks (or rest period), which cannot be combined. 7.3.1.3 Full-time employees in the Animal Services Officer classification (3252), and/or full-time employees in the Senior Animal Services Officer classification (3251) may be required to respond to emergency calls and must be available to perform activities that are work related during their entire work shift. HOURS OF WORK AND OVERTIME. 19.01 Nothing in Section 14.1. The work day shall be from the beginning of the employee’s regular shift to the beginning of the same shift on the next day.
Section 14.2. The work week shall begin at 0001 hours on Monday and end at 2400 hours the following Sunday (168 hours later).
Section 14.3. The normal basic hours of work for employees covered by this Agreement shall be eight and one-half (8.5) hours per day and forty two and one-half (42.5) hours per week; however, nothing herein shall be construed as, or interpreted as, as a guarantee of hours of work, whether per day, or week, or otherwisehours.
19.02 Subject Section 14.4. Days off for full-time employees shall be consecutive wherever reasonably possible.
Section 14.5. Work schedules shall be posted ten (10) days prior to Article 19.01the beginning date, if possible, for the following twenty-eight (28) day period. Employees may mutually agree to exchange schedules, provided the Company approves.
Section 14.6. When it is necessary for an employee to work unscheduled hours, he shall not be laid off during his regular schedule to offset overtime. He shall be permitted to work his regular scheduled days as if no work was performed outside his schedule.
Section 14.7. In addition to Section 14.8, the Employer shall, Company shall allow an overtime list of those full time employees requesting to be called for available overtime when creating job postings, no part-time employees are available; and a separate list will be guided maintained for the full time employees not wishing to be utilized for casual overtime.
a. The overtime list being allowed is contingent on the following conditions:
(1) More than one (1) employee on a particular shift request to be on the overtime shift.
(2) Full time employees sign an agreement to be on the overtime list. List to be maintained by the following principles, subject to operational requirementsShift Captains.
a(3) Full shifts Employees on the overtime list may request to be taken off the list at any time but, will not-be allowed to return to the overtime list for sixty (60)-days.
(4) Overtime hours will be maintained for three (3) month periods, referred to as quarters. At the end of each quarter, all overtime hours worked or refused will be removed from the overtime list and all employees on the list will begin the new quarter with zero (0) hours.
b. The Company may supersede the Overtime List if:
(1) Less than two (2) employees on a particular shift remain on the overtime list, in which case all full time employees will be considered in accordance with Article 14.8.
(2) A national emergency; natural disaster or any condition that requires the Company to use demand overtime exists.
(3) All employees on the overtime list are unavailable to work overtime. Then, the available overtime will be filled in accordance with Section 14.8; however, nothing contained herein shall be of eight (8) hours durationconstrued that any full time employee, inclusive of a meal breakprovided he is not on the refusal list, has relinquished his right to refuse or accept the available overtime, as provided for in Section 14.11.
b) Shifts of lesser duration Section 14.8. It is understood that the Company may be scheduled.
c) Any shift of five (5) hours duration, first attempt to fill any scheduled or longer, will have unscheduled absence with a 30 minute meal break.
d) Generally, meal breaks are unpaid, and the part-time employee is free of any employment related duties or obligationsto avoid overtime. However, if the Employer designates absence can only be filled at an employee to overtime rate, it shall be available during their meal breakdistributed among employees as equally as possible. When an absence occurs that will cause overtime, and requires them to remain the following procedure will be followed:
(1) Full-time employees on the Employer’s premises, overtime list who are scheduled to work the Employer succeeding shift will pay them for be offered the meal break. Notwithstanding the payment, if the break is interrupted, then subject opportunity to operational requirements, the Employer will endeavour report to extend or reschedule the interrupted portion of the meal break.
e) For each 3-3/4 hours of a shift, the Employer shall schedule the employee to a paid 15 minute break.
f) If an employee reports for work on any day, as required by the Employer, and starts work, the Employer shall pay the employee a minimum of four (4) hours early.
(2) Should all full time employees on the overtime list refuse the available overtime, scheduled full time employees not on the overtime list on the succeeding and preceding shifts will be offered the opportunity to report four (4) hours early or four (4) hours over respectively.
(3) employees on the succeeding shift refuse the available overtime, then the full time employee on the overtime list on the preceding shift will be offered the opportunity to work eight (8) hours overtime.
(4) The Company is then only obligated to call full time employees on the overtime list on their scheduled days off for eight (8) hours overtime only.
(5) If all full time employees on the scheduled days off refuse the overtime then the Company may offer eight (8) hours or four (4) hours overtime to a part time employee working the succeeding or preceding shift, or to a part-time employee who has worked out for the week and are on their scheduled off days; however, no employee will be forced to work sixteen (16) hours in succession.
(6) In the event a full time employee on the overtime list on the succeeding shift desires to report four (4) hours early for this overtime, then full time employees on the preceding shift on the overtime list will be offered the opportunity to work four (4) hours over if the full time employees on the preceding shift, on the overtime list refuse the available overtime, then full time employees on the refusal list may be offered the opportunity after which a part-time employee on the preceding shift may be offered the opportunity to work four (4) hours over.
(7) Should all full time employees refuse the available overtime, then the full time employees on the overtime list, on the succeeding and preceding shift with the least amount of overtime worked, or offered, will be forced to work.
(8) Should full time employees on the overtime list be unavailable, then the full time employee on refusal list on the succeeding and preceding shift with the least worked or offered, will be forced to work.
(9) In any case, the full time employee with the least amount of overtime, worked or offered will be offered the overtime first. Should the full time employee’s time be equal, the senior full time employee will be asked first. Should a full time employee be forced to work. It is understood that those employees requesting in writing, not to be utilized for overtime, may still be utilized in the event of demand overtime.
Section 14.9. Any employee called in to work at a time other than his normal shift will be guaranteed four (4) hours work or four (4) hours pay at the regular wage, unless the work applicable hourly rate. A call out is suspended for a reason completely beyond the Employer’s control. If considered to be after an employee has completed his normal shift and has punched out and departed from Building 2201. Whenever an off duty employee is called by a supervisor, or his designee, must speak to the employee for the overtime, the supervisor, or his designee, must speak to the employee for the overtime to be accepted or refused.

When an employee is scheduled and reports for work on any day as required by the Employerat his regular starting time, and the employee upon instruction of his supervisor is fit and able to begin worknot used, but does not commence work, at the Employer’s direction, the employee will he shall be paid for two four (24) hours at his regular rate of workpay. HOURS OF WORK AND OVERTIME. 19.01 Nothing in this Agreement shall be construed as, or interpreted as, a guarantee of hours of work, whether per day, or week, or otherwise.
19.02 Subject to Article 19.01, the Employer shall, when creating job postings, be guided by the following principles, subject to operational requirements.
aSection 1. Five (5) Full shifts shall be of eight (8) hour days, Monday through Friday inclu- sive, forty (40) hours, shall constitute the workweek. Eight (8) hours durationwithin each twenty-four (24) hour period shall constitute the workday. The parties agree to follow the past practice of the summer hours work schedule of 6:00 a.m. to 2:30p.m. on or around Memorial Day to Labor Day as determined by management and local president or designee. This change does not apply to shift workers.
Section 2. A thirty (30) minute lunch intermission time shall be provided between the hours of 11:00 A.M. and 1:00 P.M. The thirty (30) minute lunch intermission time shall be defined as the period between the time work stops on the job site to the time work starts on the job site. The workday as defined in Section 1 of this Article shall be exclusive of this thirty (30) minute time period, inclusive and shall apply to non-shift labor only. If non-shift employees are requested to work during their lunch period and are not given an opportunity to eat lunch, they shall be compensated at the double time rate.
Section 3. The Employer may establish another regular work week for a minimum number of individuals or crews, provided the Union shall be notified. However, there shall be no changes in the work week to avoid paying overtime. Temporary employees hired between May 1st and October 1st may perform work similar to that being performed by Union members.
Section 4. When it is necessary that employees continue to work for three (3) hours or more after their regular quitting time, they shall be furnished a meal break.
b) Shifts of lesser duration at the Employer's expense. No alcoholic beverage may be scheduled.
c) Any shift of five (5) hours duration, or longer, will have served when a 30 minute meal break.
d) Generally, meal breaks are unpaid, is at the Employer's expense and the employee is free returning to work. Employees shall be paid a minimum rate of any employment related duties or obligations. However, if the Employer designates an employee to be available during their meal break, and requires them to remain on the Employer’s premises, the Employer will four (4) hours pay them for the meal break. Notwithstanding the payment, if the break is interruptedat double time unless prearranged (Section 11), then subject to operational requirements, the Employer will endeavour to extend or reschedule the interrupted portion of the meal break.
e) For each 3at time and one-3/4 hours of a shift, the half. The Employer shall schedule furnish additional meals for such men at intervals of not more than six (6) hours thereafter while they continue to work. Men working emergency overtime shall be furnished a meal at intervals of not greater than six (6) hours, commencing with the employee to a paid 15 minute break.

Section 5. A minimum of four (4) hours of at double time rate shall be paid to all employees who are required to report to work at the two (2) or more hours before regular wage, unless the work is suspended for a reason completely beyond the Employer’s controlstarting time. If an employee reports for work on any day as required by the Employer, and the employee is fit and able to begin work, but does not commence work, at the Employer’s direction, the employee will be paid for report less than two (2) hours before start, they shall receive double time pay until the regular starting time.
Section 6. Any employee called to work on Saturdays, Sundays and Holidays shall receive not less than four (4) hours at double time rate of pay. Any employee on call out shall be required to perform all emergency work within his classification during the call out period.
Section 7. All overtime shall be equally and impartially divided among bargaining unit employees doing the same class of work, insofar as practical. Bargaining unit employees should be called first on any overtime. If overtime is available in the office on holidays, weekends, vacations, personal days and other time off situations and the office personnel do not want to work, this overtime shall be divided between all other employees in the bargaining unit on a rotating basis so long as they are qualified. The overtime rate of pay shall be based on their own classification wage rate. This overtime shall be administered by their respective Superintendent or his designee. All emergency and other cases of overtime shall be equally and impartially divided among members of the bargaining unit on a rotating basis, by seniority in each job classification, and administered by their Superintendent or his designee. If Local No. 337 fails to provide an adequate number of qualified employees in the bargaining unit to work overtime in emergency situations, the Superintendent or his designee may fill the required positions with any employee deemed qualified outside of the bargaining unit.
g) A Section 8. All overtime work schedule on Sundays and holidays shall be paid at the double time rate. Employees shall be paid at the rate of two double time for all overtime not specified otherwise. Also, all employees who have worked more than eight (2) weeks’ duration will be posted in a conspicuous location. The work schedule will be posted at least two 8) consecutive hours, but not less than sixteen (2) weeks prior to its effective date. If the Employer changes the schedule, an employee will be given at least twenty-four (2416) hours notice of that changeimmediately preceding their regular shift, shall receive the double time rate for working their regular shift.

HOURS OF WORK AND OVERTIME. 19.01 14.01 The standard hours of work for which each employee shall receive their basic hourly rate shall be forty-four (44) working hours in a one (1) week period. 14.05 Hours worked by an employee in excess of forty-four (44) hours in a week shall be paid at a rate of one and one-half (1½) times the employee's regular hourly wage. All hours worked in excess of twelve (12) hours shall be paid at the rate of one and one-half (1½) times the employee's regular hourly wage. All employees will be entitled to eleven (11) hours rest between shifts. If that could otherwise be performed by an employee reports for with less than forty (40) hours per week without the FT employee’s consent. Consistent with same, Part-Time employees shall be capped at twenty-four (24) hours/week with any/all additional hours of work on any day as required being offered by the Employer, and the employee is fit and able seniority to begin work, but those Full-Time employees with less than forty (40) hours/week prior to being offered/assigned to Part-Time positions. The above does not commence workapply in situations where an employee has left during his/her shift for medical/personal emergency situations in which case the PT employee may be assigned to replace the absent employee for the duration of the shift. In the interest of full transparency, at the Employer’s direction, the employee will be paid a composite Master Work Schedule for two (2) hours of work.
g) A work schedule of two (2) weeks’ duration will all employees in each respective location shall be posted in a conspicuous location. The each store/work schedule will be posted location at least two (2) weeks one week prior to its effective datesaid monthly schedule taking affect. 14.03 There shall be two (2) fifteen-minute rest periods during eight (8) hour shift each shift and a thirty (30) minute lunch period. Save for express authorization, all breaks and meals are mandatory with the exception of clerks working alone. For every four consecutive hours a clerk that changeworks alone he/she shall be paid an additional fifteen (15) minutes of straight pay to compensate for the loss of the break time.
14.04 Overtime shall be paid at the rate of time and one-half for all hours worked in excess of eight (8) hours in one day or in excess of forty (40) hours in any one week. Overtime shall not be mandatory unless the Employer requires it to properly staff its facilities in which case the employee(s) with the least seniority in the classification shall be required to work.
14.05 Overtime will be divided as evenly as practicable amongst those employees normally performing the work within the classification in which the overtime is required. Every reasonable effort will be made to even out the hours amongst the forementioned employees during the life of this agreement.
14.06 There shall be a five (5) minute wash-up period before lunch and at the end of the shift.
14.07 All employees will be paid on Thursday of each week.
14.08 All work performed including money-related duties such as banking transactions, counting of float, totaling of dally receipts, etc. shall be conducted during working hours.
14.09 The Employer agrees not to create split shifts.
14.10 In the event of an error by the Employer on an employee's pay that results in an overpayment, the Employer shall discuss with the Employee a repayment plan that Is reasonable and feasible in mutual agreement with the Employee. If an employee leaves the employ of the Society of Saint ▇▇▇▇▇▇▇ ▇▇ ▇▇▇▇ before the repayment is completed the Employer shall deduct the remaining amount in full from the employee's final pay.

16.04 Employees reporting for work at one cemetery and subsequently working at another cemetery on the same day shall be paid for their travelling time.
16.05 Employees may be scheduledrequired to work at cemeteries other than their base property and if instructed the day previous to such employment they shall provide their own transportation on their own time. Such employees shall be compensated at the current rate per kilometer for the distance from their base property to the assigned property, less the distance from their home to the base property.
c) Any shift of five (5) hours duration, or longer, will have a 30 minute meal break.
d) Generally, meal breaks are unpaid, and the employee is free of any employment related duties or obligations. However, if the Employer designates an employee to be available during their meal break, and requires them to remain on the Employer’s premises, the Employer will pay them for the meal break. 16.07 Where employees notify their Cemetery Services Manager that they desire a change in their weekly work schedule, unless the work is suspended for a reason completely beyond the Employer’s control. If an employee reports for work on any day as required by the Employer, if satisfied that the normal work required at the property involved can be properly performed, may agree to such rescheduling. The Employer shall not be responsible or liable for overtime rate claims or other non-compliance with the provisions of this Agreement that may arise or accrue as a result of such rescheduling.
16.08 Time worked in excess of eight (8) hours a day and forty (40) hours a week shall be paid at the employee rate of one and one-half (1 ½) times the straight time hourly rate. Time worked in excess of eight (8) hours per day shall not be counted for the purpose of calculating overtime beyond forty (40) hours per week.
16.09 (1) Where the employer determines that overtime is fit required at a specific property, the following shall occur:
(a) Same Day Overtime: Such time shall be offered on a seniority basis to qualified employees assigned to such property and able beginning with those currently, or scheduled to begin work, but does not commence workbe, at work; or
(b) Other than Same Day Overtime: Such time shall be offered on a seniority basis as established by the Employerproperty’s directionovertime list to qualified employees assigned to such property, excluding those on sick leave. Employees on vacation or other leaves of absence will also not be eligible for overtime unless they have communicated their desire to remain on the employee will be paid for two (2) hours of workrotational list during such absence.

Section 2. All work performed in excess of eight hours in a day or forty (40) hours per week shall be deemed to be overtime and shall be compensated at the rate of one and one-half times the employee's regular hourly rate of pay, or in accordance with the requirements of applicable state law.
Section 3. The Employer has the right to require employees to work overtime as may be necessary to meet operating requirements. In the event overtime is required, the Operations Manager or his designee shall use the volunteer procedures below in the order in which they appear:
a) If the employee is at work and it is within their classification, they will be asked.
b) Volunteers will be asked beginning with the most senior qualified employee.
c) The least senior qualified employee will be required to perform the work. If the least senior employee refuses the overtime assignment, the Employer changes is free to fill the position from any available source. The least senior employee refusing overtime may be subject to discipline.
Section 4. The text in this Article shall not establish a guaranteed work schedule, an number of days or hours to be worked in a work week, or the hours to be worked in a day. A typical work week would be eight (8) hours per day and five (5) days per week.

However, if the Employer designates hour shift without an employee to be available during their meal break, and requires them to remain on the Employer’s premises, the Employer will pay them for the meal break. Notwithstanding the payment, if the break is interrupted, then subject to operational requirements, the Employer will endeavour to extend or reschedule the interrupted portion of the meal break.
e) For each 3-3/4 hours of a shift, the Employer shall schedule the employee to a paid 15 minute break.
f) If an employee reports for work on any day, as required by the Employer, and starts work, the Employer shall pay the employee a minimum of unpaid lunch four (4) hours of days a week.
7.3.1.1 Employees in the classifications listed in 7.3.1 will be required to perform activities that are work at the regular wage, unless the related during their entire work is suspended for a reason completely beyond the Employer’s controlshift. If an employee reports needs to be relieved of active work time for any period of time during their work on any day as required by shift, they must request to use their own leave and such requests are subject to supervisory approval prior to the Employer, and the use of such leave. An employee is fit and able not required to begin work, but does not commence work, at the Employer’s direction, the employee will be paid for use their leave to take their two (2) hours fifteen (15) minute breaks (or rest period), which cannot be combined. Insofar as is possible, breaks (or rest periods) shall be scheduled in the middle of workeach half of the shift. It is understood and agreed that the inability to permit an employee to take a rest period shall not be the basis for any claim for overtime compensation.
g7.3.1.2 Full-time employees in the Senior Airport Operations Specialist classification (3514) A may not leave Airport property, unless performing work schedule off-site as directed by their supervisor, and must be available to perform activities that are work related during their entire work shift. If an employee needs to leave Airport property and/or is unavailable to perform activities that are work related for any reason during their work shift, they must request to use their own leave and such requests are subject to supervisory approval prior to the use of such leave.
7.3.1.3 Full-time employees in the Animal Services Officer classification (3252), and/or full-time employees in the Senior Animal Services Officer classification (3251) may be required to respond to emergency calls and must be available to perform activities that are work related during their entire work shift. If an employee is unavailable to perform activities that are work related for any reason during their work shift, they must request to use their own leave and such requests are subject to supervisory approval prior to the use of such leave.
7.3.2 Full-time employees in the Community Service Officer I/II classification (6131/6132) and/or in the Senior Community Services Officer classification (6133) will work without an unpaid lunch period during their shift, including but not limited to working a straight ten (10) hour shift for four (4) days a week without an unpaid lunch.
7.3.2.1 For the duration of their work shift, full-time employees in the Community Service Officer l/ll classification (6131/6132) and in the Senior Community Service Officer classification (6133) will be required to perform activities that are work related and, during their work shift, they may not be relieved of active work time. If an employee needs to be relieved of active work time for any period of time during their work shift, they must request to use their own leave and such requests are subject to supervisory approval prior to the use of such leave. An employee is not required to use their leave to take their two (2) weeks’ fifteen (15) minute breaks (or rest periods), which cannot be combined. Insofar as is possible, breaks (or rest periods) shall be scheduled in the middle of each half of the shift. 7.4 The work period for purposes of the Fair Labor Standards Act may be designated for each employee as appropriate so that there is no overtime built into the regularly scheduled workweek.
7.5 The City may establish a work schedule will be posted at least two other than Monday through Friday where the interests of, or service to, the public requires. Employees assigned to a five (25) weeks prior to its effective date. If the Employer changes the scheduleday, an employee will be given at least twenty-four (24) hours notice of that change.eight

HOURS OF WORK AND OVERTIME. 19.01 Nothing in this Agreement shall be construed as, or interpreted as, a guarantee of hours of work, whether per day, or week, or otherwise.
19.02 Subject to Article 19.01, the Employer shall, when creating job postings, be guided by the following principles, subject to operational requirements.
a) Full shifts shall be of eight (8) hours duration, inclusive of a meal break.
b) Shifts of lesser duration may be scheduled.
c) Any shift of five (5) hours duration, or longer, will have a 30 minute meal break.
d) Generally, meal breaks are unpaid, and the employee is free of any employment related duties or obligations. However, if the Employer designates an employee to be available for emergencies during their meal break, and requires them to remain on the Employer’s premises, the Employer will pay them for the meal break. Notwithstanding the payment, if the break is interrupted, then subject to operational requirements, the Employer will endeavour to extend or reschedule the interrupted portion of the meal break.

HOURS OF WORK AND OVERTIME. 19.01 Nothing 21.01 The normal hours of work paid at straight time for residential and community youth workers varies between 40-42 hours averaged over the schedule. Other schedules may be developed to respond to specific program needs that are between 42-44 hours. If this need arises within the duration of this contract, management will consult with the Union on this issue. The parties must agree to the proposed altered schedule.
21.02 Work in this Agreement excess of forty-two (42) hours per week shall be construed aspre-approved by the immediate supervisor and shall be paid at the rate of time and one-half. The Employer may require an employee to work in excess of noted limits to avoid serious interference with the ordinary working of the Employer’s operations, to deal with an emergency, or interpreted as, to ensure continued delivery of services. Employee’s may opt for equivalent time off in lieu of pay for overtime. Time off in lieu will be drawn down on a guarantee of hours regularly scheduled basis and also may be mutually scheduled between the employee and the Employer. Overtime shall be paid after fifteen (15) minutes of work, whether per day, or week, or otherwise.
19.02 Subject to Article 19.01, the Employer shall, when creating job postings, be guided by the following principles, subject to operational requirements.
a) Full shifts 21.03 All lieu time shall be of eight used within each fiscal year and cannot be accumulated thereafter. After ten (8) hours duration10) such days have been accumulated, inclusive of a meal break.
b) Shifts of lesser duration may be scheduled.
c) Any shift of five (5) hours duration, or longer, will have a 30 minute meal breakshall be taken within one (1) month of entitlement. If the supervisor and employee cannot agree upon the days to be taken off it shall be arbitrated by the Program Director having regard to the operational requirement of the department.
d21.04 The parties agree that:
(a) GenerallyOnce a schedule is implemented it remains in effect for one year unless the employer, meal breaks are unpaid, the program staff and the employee is free of any employment related duties or obligationsunion mutually agree. However, if the Employer designates an employee to be available during their meal break, and requires them to remain on the Employer’s premisesIf all three parties cannot agree, the Employer issue will pay them be resolved at the Labour/Management Committee level and a timetable for the meal break. Notwithstanding the payment, if the break is interrupted, then subject to operational requirements, the Employer will endeavour to extend or reschedule the interrupted portion implementation of the meal break.
e) For each 3-3/4 hours of a shift, the Employer shall schedule the employee to a paid 15 minute break.
f) If an employee reports for work on any day, as required by the Employer, and starts work, the Employer shall pay the employee a minimum of four (4) hours of work at the regular wage, unless the work is suspended for a reason completely beyond the Employer’s control. If an employee reports for work on any day as required by the Employer, and the employee is fit and able to begin work, but does not commence work, at the Employer’s direction, the employee will be paid for two (2) hours of work.
g) A work schedule of two (2) weeks’ duration will be posted in a conspicuous location. The work new schedule will be posted at least two (2) weeks prior to its effective dateestablished. If the Employer changes layoffs are involved necessitating a change in the schedule, an employee the above will not apply.
(b) No full-time position shall be given at least twentylost as a result of the implementation of the new schedule.
21.05 The Employer will attempt to provide three (3) days notice in the event of a change in days off.
21.06 The Employer will attempt to provide forty-four eight (2448) hours hours’ notice of that changea change in start times.
21.07 All employees shall be entitled to one, fifteen (15) minute paid rest period staggered in each half of a normal shift.
21.08 All overtime must be approved in advance by the supervisor or his/her designate.
21.09 When a shift cannot be filled in regular hours the following sequence shall apply:
(a) Off-duty full-time employees agency wide
(b) Off-duty relief agency wide
(c) On-duty full-time employees agency wide
(d) On-duty relief agency wide Notes: - The Employer’s current practice in making decision on staffing will remain in place (gender, program requirements, seniority). - On a quarterly basis, full time employees will declare interest in working overtime shifts.
