Section 417.4 When it becomes necessary to close schools because of inclement weather or calamity, employees will receive their regular hourly rate of pay for all hours missed from work due to the inclement weather or calamity, provided they would have otherwise worked those hours during their regularly scheduled work day. Overtime premiums Employees who work on inclement weather or calamity days when schools are officially closed, shall not receive the following: (1) Their regular rate of pay times their regular number of hours. (2) In addition they will receive their regular rate of pay for all hours actually worked on calamity days. Transportation employees who work on inclement weather days or calamity days under Plan B shall be pyramided, compounded or paid twice compensated at their regular hourly wage rates for the same time workedall hours worked beyond their regularly scheduled driving time.
Section 517.5 An employee who is called in to work and who makes a separate trip both to and from work for a period of work other than the employee’s regularly scheduled work day, shall receive a minimum of two (2) hours pay.
Section 17.6 The working time of each employee is to be devoted exclusively to productive work and the Association agrees that its officers, representatives, agents and members will not solicit employees for Association membership or conduct any other Association business or activity during working time or otherwise interfere with any employees during working time, unless otherwise approved in advance by supervision. (c) The Employer will endeavour to provide as many forty (40) hour positions as can be accommodated while meeting operational requirements and to provide as many straight day, afternoon, and night positions as can be accommodated while meeting operational requirements. There will he no split shifts.
(d) Notwithstanding any other provision of this Agreement, the Employer may, at its discretion, allocate available work to probationary employees and may take compensatory time temporarily reassign Seniority List employees in shifts as may be required for the purposes of training, evaluation, the continuance of efficient operations, and/or accommodating probationary employee assignments. The Employer will endeavour to consider seniority in reassigning employees under this clause.
(e) The Employer will post four (4) week work schedules two (2) weeks in advance of the applicable work period, and endeavour to keep schedule changes to a minimum. A week is defined as Sunday to Saturday.
(f) The Employer may allow exchange of shifts at the rate request of two (2) employees, or changes to the posted schedule at an individual's request, provided such change in posted schedules be submitted in writing by both employees, in the case of a shift exchange, and the individual employee in the case of a requested change to the schedule, and the Employer's approval is obtained in advance and that no overtime premium is paid and no additional cost to the Employer results from such exchange of shifts or change in posted schedule.
(g) The Employer will endeavour to distribute all overtime hours on an equitable basis amongst full-time seniority list employees in the classification where the overtime is required provided the employees are willing to participate in overtime. Employees not wishing to participate in overtime will advise the Employer in writing and onethe Employer shall be able to rely upon such notification until it is revoked by the employee in writing. Part-half time employees shall be offered the hours only after all full-time employees have refused.
(h) Full-time employees who work overtime hours may choose to take time off in lieu of pay overtime but will not be required or compelled to do so. All lieu time taken will be at time and one half (1 ½) as per the overtime rate. Employees requirement of Article 17(a) and shall be permitted to take compensatory scheduled at a mutually agreeable time between the employee and the Employer. The time off must be taken within twelve forty-five (1245) months days from the date it was earned, failing which the overtime hours will be paid in accordance with Article 17(a). Employees The employee must elect and indicate to the Employer his/her decision to accept lieu time at the time the employee agrees to work the overtime hours.
(i) Wherever possible, shift changes scheduled by the Employer will commence only after a scheduled day off.
(j) Schedules may be altered by mutual consent of the Employer and employee, and no overtime shall be payable as a result of said change to the schedule except in accordance with Article 17(a) and (b). Notwithstanding the above, said changes in schedule cannot earn in excess of seventy occur less than forty eight (7048) hours prior to the commencement of the scheduled work week.
(70 k) In the event one of the following holidays: New Year's Day, Good Friday, Victoria Day, Thanksgiving Day, Christmas Day and Boxing Day falls during a given week and an employee is scheduled off work on the day concerned to enjoy the holiday, he shall be deemed, for purposes of computing overtime under 17(a) only, to have worked eight (8) hours times one and one half = 105 hours) of compensatory time in a calendar year. If an employee responds to this overtime notice, he/she must accept the assignment.

All work performed by hourly rated employees in excess of eight (8) hours per day or bargaining unit members over forty (40) hours per week. The County in any one week shall pay be considered as overtime and paid at the overtime rate of time one and one-half of (1 ½) times the regular straight time bargaining unit members hourly rate (including shift differential) of pay for the position the bargaining unit member was working when the overtime occurred in accordance with the Fair Labor Standards Act. The Employer shall solely be responsible for deciding when to work overtime or when overtime is needed.
C. Bargaining unit members will be offered overtime in their classification only. Effective October 5, 2013 overtime will be rotated, in the classification the work occurs, starting with the most Senior Bargaining Unit Member in that classification and down through the list until the work is completed. This Section does not apply to Bus Drivers.
D. Bargaining unit members will be paid for all required overtime worked by Stillwater Center employees time lost when the schools in which they work are closed owing to an epidemic or other public calamity. Nothing in this article shall be construed as requiring payment in excess of a bargaining unit member regular wage rate for any time worked while the school in which the bargaining unit member is employed is officially closed for reasons set forth in this paragraph.
1. On days the Superintendent or Board declares a calamity, bargaining unit members in the custodian classification will be required to check their assigned building performing tasks such as snow removal, cleaning sidewalks, securing the building, checking the heating and cooling systems.
2. Bargaining unit members who cannot report on calamity days to fulfill their tasks in D-1 above may use personal leave with the Superintendent’s approval.
E. Bargaining unit members called out to work will be paid a minimum of two (2) hours pay or the hours they actually worked if greater.
F. Employees directed to use their own personal vehicle in the course of their assigned duties will be reimbursed mileage at the IRS rate to be paid on a quarterly basis.
G. Custodians will not be required to use their private vehicles to carry school equipment from one school location to another.
H. The parties intend to memorialize the current practice regarding bus drivers driving extra routes instead of a substitute driver. In the event a bus driver drives one extra route a day (am or pm), the bus driver shall receive an additional $25 for the extra route. In the event the bus driver drives two extra routes (am and pm), the bus driver shall receive an additional $50 for the two extra routes in the same day. If the substitute driver rate increases, the parties agree to re-open Article 27, Paragraph H only, regarding compensation for driving the additional route.

In the event a custodian completes a scheduled eight (8) hours per day or eighty hour shift and works an additional regularly scheduled 8-hour shift after having already worked their 8-hour shift, the custodian shall receive an additional fifty dollars (80$50) hours bifor working the additional, complete 8-weeklyhour regularly scheduled shift. For example, 1 hour 10 minutes shall equal 1 1/2 hours of overtime; 1 hour 46 minutes shall equal 2 hours of overtime.
3. Compensation for overtime during the week shift shall be paid in the following payroll period except for hours worked during the last three days of a payroll time frame with those payments being made on the next payroll period.

Section 3. Management shall endeavor to distribute authorized overtime among all employees in each classification within a department on a non-preferential and equal basis. The County shall establish a rotating seniority list by job classifications, within each division, for overtime assignments when overtime work is necessary. The list shall begin be prepared with the most senior person in the job classification. Management shall request the employee's name who appears officer being first on the list to and the most recently hired officer being last on the lists. The rate of compensation for the extra work scheduling shall be at the agreed upon rate between the Township and employee and shall be for the amount of time set forth in the posting of this extra work duty.
5. For overtime selection purposes, the Township shall not schedule overtime when to do so would create greater than a 12-hour shift or work slot for the affected employee. For the purposes of calculating the 12 hours, the Township is only referencing Township hours of employment and not extra work scheduling.
6. The overtime is availablelists referenced in paragraph 4 shall be posted within the department.
7. When The parties agree that the employee is unable to present work schedules shall remain in effect and unchanged, with the overtime exception of those officers whose schedule shall be in accordance with the Side Bar Agreement dated January 28, 2005 which has been offered signed by the representatives of both parties. HOURS OF WORK AND OVERTIME. Section SECTION 1. The normally scheduled This Article is intended to define the normal hours of work per day or week in effect at the time of this Agreement. Nothing contained herein shall consist be construed as preventing the Facility from restructuring the normal work day or work week; from establishing the work schedules of employees; or establishing part-time positions. This Article is intended to be used as the basis for computing overtime and shall not be construed as a guarantee of hours of work per day or week, provided, however, if the work force is to be reduced, it shall be accomplished by lay-off rather than any reduction of hours for part time employees.
SECTION 2. The standard workweek for full-time employees shall be forty (40) hours for those who work on an eight (8) hours in approximately two segments plus that time hour per day schedule and thirty-six (36) hour/week for an unpaid lunch period in between, five those on a twelve (5) days a week, Monday through Friday, except where there is a continuous twenty-four (2412) hour per day operation or where there is a continuous seven (7) day a week operation made necessary because schedule exclusive of the nature of the worktime allotted for unpaid meal breaks.

SECTION 4. Overtime, approved by the supervisor or department head, shall be offered to employees qualified to perform the available work within the department or classification. If the contingent/intermittent staff and overtime sign up, which gives all employees the opportunity for overtime per seniority, does not accomplish filling of staff needed, the supervisor will ask staff on duty in accordance with the facility’s need and may then last minute mandate per seniority list on a rotating basis to provide a sufficient number of employees to complete the work. (See Article 25 Schedule Posting).
A. Overtime shall be compensated for all hours in active pay status in excess of forty (40) hours per week and shall be paid at the rate of time one and one-half (1-1/2) times regular rate of pay.
B. Compensatory time will be granted at a rate of 1-1/2 times the overtime hours earned. The employee has the right to choose compensatory time or overtime pay. This request for compensatory time must be made to the Business Office. The employee cannot change their decision more than once a calendar year.
C. No more than one hundred twenty (120) hours of compensatory time may be accumulated. Of the one hundred twenty hours (120), sixty hours, plus any carryover, may be used as time off or cashed out upon the written request of the regular straight time hourly rate employee. The other sixty (including shift differential) for all required overtime worked by Stillwater Center employees in excess of eight (8) hours per day or eighty (8060) hours bi-weeklyearned, may only be used as a payout. Overtime is time worked continuous Once the employee reaches one hundred twenty (120) hours of compensatory time, their status will automatically return to the regular work schedule whether it precedes or follows that shiftovertime pay status (minus carryover).
Section 3D. When the maximum hours of compensatory time is reached, payment for overtime work shall be made in cash. Management No more than twenty (hours of comp time may be carried into the next year.)
E. Upon termination of employment, an employee shall endeavor be paid for unused compensatory time that is accrued but unused.
F. Hours not worked, but paid for because of vacation shall be considered as active pay status for the purpose of calculating an employee’s entitlement to distribute authorized overtime.
G. Compensatory time requests must be made in writing in accordance with normal scheduling procedures in advance of anticipated time off unless such time off is required because of emergency nature, then such requests shall not be unreasonably denied.
SECTION 5. In the event that an unpredictable service related emergency exists whereby the Facility is liable for controlling such an emergency, overtime among all shall be required of those employees in each classification within a department qualified to perform such emergency work and currently at work and then on a non-preferential and equal basis. HOURS OF WORK AND OVERTIME. Section 1The normal work week for Full-Time Employees shall be thirty-seven and one half (37.5) hours worked per week and seven and one half (7.5) hours worked per day over five (5) days Monday to Sunday which is inclusive of any breaks but does not include the meal break. D. The employee’s administrator or designee shall maintain a record of all overtime and compensatory time on the Overtime Pay/Compensatory Time Worksheet. This record will show hours of overtime worked and hours paid or used under compensatory time by the employee. Employees who have worked may elect overtime for which they are entitled to pay at the rate of time one and one-half may take (1.5) times the employee’s regular hourly rate or compensatory time at the rate of time one and one-half (1.5) hours for each hour worked. However, prior to overtime work, the employee and the administrator shall mutually agree if compensation is to be in the form of compensatory time or overtime pay. If receiving compensatory time in lieu of overtime pay, the employee and the administrator shall, prior to overtime work or as soon thereafter as possible, reach agreement on when to use the compensatory time. Any compensatory time not taken during the pay at period in which it is earned shall be reported on District payroll. E. Employees shall receive notice of schedule changes at least 48 hours in advance. HOURS OF WORK AND OVERTIME. Section 1. The normally scheduled hours Employees assigned to a duty schedule of work shall consist of eight (8) hours in approximately two segments plus that time for an unpaid lunch period in between, five (5) days a week, Monday through Friday, except where there is a continuous twenty-four (24) hour per day operation or where there is a continuous seven hours on duty and forty-eight (748) day a week operation made necessary because hours off duty who work in excess of 106 hours in the nature of the work.established

Voluntary overtime will be signed up for and granted utilizing the voluntary overtime function (VOT) in Telestaff. Voluntary overtime shifts will be awarded based on the total number of overtime hours the employee has worked in the current calendar year. The employee with the least amount of hours will be awarded the overtime first. It is the expectation of everyone, that if a shift is awarded, the employee will work. An employee may cancel an overtime shift at least sixty-eight (68) hours before the scheduled overtime shift if the employee arranges for another employee with equal qualifications to work the overtime which has been offered shift. If the employee must cancel the overtime due to him/hersickness, family, or unforeseeable reasons, the scheduling supervisor chief must be contacted for approval. If it is deemed an employee shall not is habitually using sickness as a means to cancel the overtime due to being moved to an unfavorable assignment, that employee’s rights of VOT may be offered suspended for a period of time agreed upon by administration and the union and the employee will be subject to discipline Section 4. Employees shall be permitted to take compensatory time within twelve (12) months from the date it was earned. Employees may not earn in excess of seventy (70) hours (70 hours times one and one half = 105 hours) of compensatory time in a calendar year. The Employer staffing supervisor will pay unused compensatory time more than twelvedistribute the mandatory overtime from the top of the list. If the mandatory overtime is refused, the employee will remain at the top of the list. Approved refusal options are outlined in the department SOP's and will be strictly adhered to. When the employee works the mandatory overtime, regardless of if the shift was a full shift or a few hours, that employee goes to the bottom of the list.

Section 2. A one-half (1/2) hour lunch period will be provided within the (8) hour shift. Actual shift hours will be adjusted to meet individual school schedules. However, any call back occurring on a Saturday or Sunday shall be paid at double time at with a minimum of two hours call back pay. If the work for which the employee was scheduled to report is not available, or if there is no substitute work which is within the employees reasonable capacity to perform, they shall be paid nevertheless for six (6) hours pay. The rate of time pay will be the straight hourly base rate for the job they are scheduled to report on, plus any shift premium that applies, if they refuse to accept substitute work, they will not be pad any reporting pay. The Company shall not be liable for reporting pay if it has notified the employee not to report for work at lease eight (8) hours in advance of their scheduled reporting time. This provision will not apply the event that the lack of work is due to unforeseen extenuating circumstances. Five minute wash-up periods will be given to all employees prior to lunch periods and one-half in lieu of pay at the overtime rateshift end. The standard work day for Permanent Full-time Employees will consist of eight (8) hours and the standard work week will consist of hours as scheduled by the Employer. In the event that not all of the qualified employees on a shift or in a department are required to work overtime, opportunities to work overtime will be pyramidedoffered by the Company as equitably as possible to the employees who are qualified to perform the overtime work that is required. The Company will establish and maintain a “rolling seniority list” for overtime opportunities. The most senior on the list of qualified employees will be the first offered to fulfill an overtime requirement. The next overtime opportunity will be offered to the next employee in order on the seniority list and so on until all employees on the list have been afforded the opportunity to work overtime. Each time that this process has been completed, compounded or paid twice the process will begin again with the first and most senior employee on the list. If a sufficient number of qualified employees do not accept the overtime work, the Company may require qualified employees with the least job classification seniority to perform the overtime work. In no event will the Company be required to pay for time not worked under this Article. All new hire employees that are within their 90 day probationary period will be added to the same time workedrolling seniority list in order of date hired and will be afforded equitable opportunity for overtime as indicated above.
Section 5. Employees who have worked will be notified as soon as practical regarding the scheduling of any overtime work.
Section 6. There will be no pyramiding of any premium or overtime pay for which the same hours worked.
Section 7. Employees will be granted one (1) thirty (30) minute uninterrupted unpaid lunch period during each workday. Lunch periods will be scheduled by the Company based upon work requirements from the Government. The Company will endeavor to schedule lunch periods approximately half-way through the scheduled shift. The Company will provide sanitary break room facilities for employees to observe their lunch break and if not in the proximity of such facilities, employees will be allowed to utilize assigned vehicles to travel to such facilities.
1. A worker may not depart a worksite for a lunch period or for any other reason unless the work site is left in as safe condition.
2. The lunch period will be observed between 11:30 AM and 12:00 Noon daily unless otherwise approved by the employees immediate supervisor and/or manager. The lunch periods may be modified to accommodate the splitting of similar craft workers lunch periods. In this case, a lunch period may be observed between 12:00 Noon to 12:30 P.M.
3. For second and third shift employees, their lunch period may be as they are entitled deem appropriate and as record on their time card. If the employee receives a service order call, he/she should notify the caller that he/she is taking their lunch period and will respond to the service order as soon as they complete their lunch. This should be noted on the service order that is received.
4. In the case of service order, work order or preventive/recurring maintenance work orders, the worker shall document on the applicable work management document any all times that his/ her lunch period is taken at other than the designated time.
5. If the employee desires to travel to a location other than his or her current worksite for his or her convenience or for other reasons, the time to travel from and to the work site shall be part of the thirty (30) minute lunch period. Exceptions shall be preapproved by the employee’s immediate supervisor and/or manager. A fifteen (15) minute break will be provided to employees approximately half way through the first half of a shift and another fifteen (15) minute break approximately half way through the second half of a shift. Breaks must be taken in place whenever possible. If the Government has an intermittent closure of the military base for a specific reason, thus making it unable for employees to perform their jobs, the Company agrees to pay at these employees for these days lost to such closure. This provision does not apply if the rate of time and one-half may take compensatory time at the rate of time and one-half in lieu of pay at the overtime rate. Employees shall be permitted to take compensatory time within twelve (12) months Company does not receive reimbursement from the date it was earned. Section 513.02 The Union acknowledges that the Company has the right to require overtime work, and employees agree to cooperate with the Company in working overtime as required under this agreement. To this end, the parties agree that overtime required in accordance with Article 13.01 shall be mandatory. :. The Union and Company further agree that any further work assignments which result in any employee working greater than 60 (sixty) hours in any week shall also be mandatory to the extent that such assignments are permissible under the Employment Standards Act. The union agrees to assignment of such hours of work and agrees to support any application to the Director of Employment Standards which may be required in connection with any such assignment. When scheduling employees to work which would result in overtime, the Company will make reasonable efforts to distribute overtime amongst qualified employees who are willing to do the work. In the event no qualified employee is readily available and expresses a willingness to do the work, the Company will assign the overtime work as it deems fit, taking into account the proper operation of the business and the principle of reverse order of employee seniority.
13.03 Each employee is required to report to hislher assigned work location no later than the commencement of hislher scheduled shift. No employee shall leave his/her work location at the conclusion of hislher shift prior to both the finishing time of such shift and the arrival at the work of location of an employee to relieve him/her of hislher duties. If an employee does not relieve a worker immediately at the end of hislher shift, the worker shal1 remain at work at hislher workstation until a relief worker arrives.
13.04 Where employees are called in for emergency work, and such cal1-in results in the employee incurring a trip to and from the plant in addition to that required in connection with their scheduled shifts, they shal1 receive no less than four (4) hours' pay at their applicable wage classification wage rate. However, in an emergency call-in if the calculated overtime payment is greater, the greater shall govern.
13.05 In reporting for work, employees will not be paid if there is a lack of work due to fire, flood, power failure, or some other cause, clearly beyond the control of the Company.
13.06 The pay week shall be Sunday through Saturday.
13.07 There shal1 be one 30 (thirty) minute unpaid lunch break period in the first 5 hours of each shift and two 15 (fifteen) minute paid lunch break periods in the second 5 hours of each shift. The provisions shal1 constitute an agreement within the meaning of s. 20(2) of the Employment Standards Act.
13.08 An employee temporarily assigned to a higher rate of classification for four (4) hours or more will be paid the rate of the higher classification for all hours worked in that position provided they possess the necessary qualifications and certificates to perform the required duties. Employees who have worked overtime for which they are entitled temporarily assigned to pay at the a lower paid classification will maintain their current rate of time and one-half may take compensatory time at the rate of time and one-half in lieu of pay at the overtime rate. This shall be deemed to include the time for the employee to reach the pick-up point and for the employee to return the vehicle to base after discharging passengers. In the event of a breakdown or snow delay, the employee shall be paid at the applicable rate (70 hours times one school, charter, for the work being performed. When the employee's pay cheque is short of or more and one half = 105 the error is the Company's, the Company shall issue to that employee (cash or cheque) the full amount within hours) , under the amount shall be given on the next pay period. HOURS OF WORK AND OVERTIME. Section
1. The normally scheduled hours of work “normal” workweek for full-time custodians shall consist of eight (8) hours in approximately two segments plus that time for an unpaid lunch period in between, five (5) days consecutive workdays, with regular starting and ending times, except for a 30-minute unpaid lunch period. Overtime will begin after forty (40) hours actually worked during any week, Monday through Fridayexcluding sick leave. For the purposes of determining overtime hours, except where there is a continuous twenty-four (24) hour per day operation or where there is a continuous seven (7) day a week operation made necessary because of the nature of the worktime paid for vacation, personal, holiday, bereavement, and jury leave shall be treated as hours worked.
Section 2. The County overtime rate will be based on the base rate and shift differential.
3. It is recognized that during the school year work schedules may be altered by the Director of Finance or his/her designee to serve the best interests of the school system. However, there shall be no permanent change in work schedules or in shift time without giving the Union an opportunity to discuss the matter ten (10) days in advance of such change.
4. It is recognized that the assignment of overtime work is the function of the employer in keeping with its responsibility for meeting its obligations to the citizens of the community. Subject to the requirements of the ▇▇▇▇ ▇▇▇▇▇▇▇ Regional School District for overtime work, overtime will be assigned on an equitable basis to Employees in accordance with their skills and familiarity with the work as determined by the employer. For usual and customary overtime opportunities (those that, in the opinion of the District, may not require special skill, familiarity with equipment, physical ability, stamina, safety considerations, or other special circumstances), there will be a rotating list based on the years of service of all eligible Employees. It is the District’s discretion whether overtime will be made available district-wide, by individual building, or some combination thereof. An Employee assigned overtime duty as a result of special circumstances will not lose his/her spot in the rotation for usual and customary overtime opportunities. If volunteers for overtime work are not available, the employer reserves the right to assign Employees to such work. Payment of overtime shall be made in the next scheduled pay period.
5. When Employee has been assigned or volunteered for overtime work to cover a function occurring on school property, his/her primary responsibilities will be to support the activities associated with that function. However, it is expected that the Employee will perform tasks associated with his/her regular job responsibilities during those periods of time when custodial support is not immediately needed by those attending the function.
6. An Employee who is called back to work on the same day after having completed his/her assigned work shall be paid at the rate of time and one-half of the regular straight time hourly rate (including shift differential) for all required overtime hours worked by hourly rated employees on such recall. S/he will be guaranteed a minimum of two (2) hours work. During the hours between 12 midnight and 4:00 AM, s/he will be guaranteed a minimum of three (3) hours work. An Employee does not have to complete the full two or three hours to be compensated for the call-back pay.
7. A custodian in excess of eight (8) hours each building will be paid one hour per day or forty (40) hours per week. The County shall pay overtime at the rate of time and one-a half of the regular straight time hourly rate (including shift differential) for all required overtime worked by Stillwater Center employees in excess of eight (8) hours per day or eighty (80) hours bi-weekly. HOURS OF WORK AND OVERTIME. Section 1. 11.01 The normally scheduled hours of normal work week shall consist of forty (40) hours and the employee shall not be requested to work at his regular rate of pay for more than forty (40) hours per week averaged over a total of a four (4) week period. The normal workday of shift shall be eight (8) hours per day with a thirty (30) minute paid meal break. Employees will be required to remain on Hospital premises and be available for work if needed during the meal break.
11.02 The Employer will post schedules of work four (4) weeks in approximately two segments plus that time advance. This is for an unpaid lunch period in between, five (5) days a week, Monday through Friday, except where the convenience of both the Employer and the employees. Schedules may be varied to meet emergencies. The establishment of the necessary work schedules shall be deemed to be the responsibility and prerogative of the Chief Engineer. Mutual change of shift between employees shall be allowed provided normal service is maintained and there is a continuous twenty-four (24) hour per day operation or where there no additional cost to the Employer. This is a continuous seven (7) day a week operation made necessary because subject to the approval of the nature Chief Engineer, with approval not being unreasonably withheld.
11.03 Hours of work performed in excess of the work.
Section 2. The County regularly scheduled hours shall pay overtime be paid at the rate of time and one-half half. When an employee is required to work more than eight (8) hours in any consecutive twenty- four (24) hour period, overtime rates shall apply. This premium shall not apply where a schedule is changed by mutual agreement, or the standard schedule provides less than sixteen (16) hours between shifts. Overtime shall be equitably distributed among employees who are available and qualified to perform the required work. Employees who work overtime will not be required to take time off in regular hours to make up for overtime worked.
11.04 Time off in lieu may be taken subject to the approval of the Chief Engineer. Such time off will be the equivalent to the premium rate the employee has earned for working overtime.
11.05 The Hospital shall revert to payment of the premium rate if time off is not taken within sixty (60) calendar days.
11.06 Premium payment (including both overtime and holiday premium payment) shall be calculated and paid under one provision on this agreement only, even though hours worked may be premium payment hours under more than one provision. In such circumstances the higher premium will be applied. The provisions of this clause will not negate any entitlement to shift premium or weekend premium.
11.07 In cases of absences for sickness or other reasons, it will be deemed to be the responsibility of the employee to notify the Hospital Switchboard at least four (4) hours before the time at which he was responsible for reporting to work. If the Hospital requires an employee to produce a medical certificate substantiating that the employee, in the opinion of the medical doctor, was unable to work because of illness in the case of absence of less than three (3) consecutive days, and such certificate is not customarily required in absences of that duration, the Hospital shall notify the employee in writing beforehand.
11.08 An employee called in to perform work after having completed his shift and gone home shall be paid for a minimum of four (4) hours pay at time and one-half. Any calls that occur during the minimum guarantee periods will be covered by the minimum guarantee. Where the call-in/call-back period is continuous with the regular scheduled shift the minimum guarantee shall not apply.
11.09 Where an employee is required to work during a period of days off, he shall be paid at one and one-half (1½) times his regular straight time hourly rate for work performed on his first day of rest and double time (including shift differential2x) for all hours worked on each additional day off during that period.
11.10 Stand-by Premium An employee who is required overtime worked to be on standby shall receive an allowance of three dollars ($3.00) per hour. Effective September 29, 2008, the stand-by hourly rated employees in excess allowance shall be increased to three dollars and 20 cents ($3.20) per hour of eight (8) hours per day or forty (40) hours per weekstand-by. HOURS OF WORK AND OVERTIME. 13.3 Company initiated changes to the schedule will be announced as far in advance as practicable. However, it is recognized there may be situations where such notice is not possible.
13.4 Where employees are not notified in person or by a phone call to their work telephone number (whether answered or not, but with a message or an answering system, if activated) that they are not needed to work the following day(s) prior to leaving for work, and where they attend at work, they be paid for actual hours worked subject to a minimum payment of 4 hours at the employee’s Regular Rate. If an employee does not have the answering system activated, the employee will receive no such pay. If additional hours are worked as a continuation of the employee’s regular hours rather than being called in after completing those hours, those additional hours are not treated as call- in pay. This provision shall have no application to employees classified as “on call” or standby.
13.5 It is acknowledged that from time to time it may be necessary for employees to perform work outside of their scheduled hours at all hours of the day or night. Such overtime is offered to employees who are in the Branch and Job Classification for which the work is available and awarded, in order of seniority to those who volunteer. If not enough employees volunteer or the employees who volunteer will exceed the maximum hours of work, the Company has the right to mandate such work as required, in reverse order of seniority on a rotating basis. An employee who has been authorized or mandated to work overtime will appropriately submit their time for this work. Overtime is paid once the employee works more than 40 hours per week. The County shall pay Overtime will be at 1 ½ times the employee’s Regular Rate.
(a) Employees are only eligible for overtime at when the rate of time and onehours are pre-half of approved by their Territory Manager, Field Services Manager, Duty Manager or Services General Manager.

If all employees in the classification refuse the overtime offered, then the Employer will assign the overtime to the most junior employee in the classification who has the qualifications, skills and ability to perform the work available.
7.03 An employee called back to work after their shift or on a scheduled day off will be paid for the time worked continuous worked, but not less than four (4) hours at the applicable overtime rates.

HOURS OF WORK AND OVERTIME. Section 1. 16.01 The normally scheduled provisions of this Article 16 are not to be interpreted as a guarantee of, or limitation upon, the hours of work to be done per day or per week or otherwise, nor as a guarantee of working schedules but shall consist serve to assist the parties in the computation of eight (8) regular pay and overtime pay. The current normal hours in approximately two segments plus that time for an unpaid lunch period in between, of work are five (5) days a of work per week, Monday through Friday, except where there is eight (8) hours of work per day to forty (40) hours per week.
16.02 There will be one (1) fifteen (15) minute paid break during each half (½) shift to be taken at a continuous twenty-four time designated by the Employer consistent with the operational needs of the Employer and as close to the middle of each half shift as possible. There will be a half (24½) hour per day operation or where there is a continuous seven unpaid meal period to be taken not more than five (75) day a week operation made necessary because hours after the starting time of the nature of the workshift.
Section 2. (b) The following premiums will be paid for:
(i) Afternoon Shift - One Dollar ($1.00) per hour

HOURS OF WORK AND OVERTIME. Section 1. The normally scheduled work week is forty (40) hours, the work day is eight (8) hours and the work year is 2,080 hours.
Section 2. The City shall be the sole judge of work the necessity for overtime and all assigned overtime must be worked. Regular overtime will be assigned by seniority within each respective division of the department. The least senior employee will be required to perform the work.
Section 3. Base pay contemplates, on the average, five shifts per week of eight hours each, as set forth in an assignment list published monthly under the direction of the Chief or his designee. When operating on an eight and half (8 hour shift with an unpaid lunch, there shall be a minute rest period during each half of a full shift and a five minute personal wash up at the end of each shift. When operating on an eight (8) hour shift with a paid lunch, there shall be one minute break one-third into the shift and a minute paid lunch two-thirds into the shift and a two minute clean up at the end of the shift. There shall be a ten-minute rest period prior to starting overtime at the end of the scheduled shift, providing that the overtime is to be at least two (2) hours in length. The Company reserves the right to require overtime for employees. HOURS OF WORK AND OVERTIME. Section 1. The normally scheduled A. E. Overtime opportunities shall be offered to employees on an equitable basis. Beginning on July 1 of each year, offers of overtime will be made as follows: The most senior qualified employee in the classification at the location will be offered the opportunity fIrst. The next offer of overtime will be made to the next most senior, qualified employee, and so on. If an employee refuses to work overtime when it is his tum, he shall be considered as having worked the overtime. Overtime will be offered through the entire list before returning to the beginning. At the end of July and each subsequent month, the list of employees will be updated in the order of amount of overtime worked (including time refused) and by seniority. Overtime will be offered in accordance with seniority, beginning with employees with the least overtime accumulated.
F. Employees shall be paid on a bi-weekly basis; Friday shall be the normal day when earnings for the two preceding weeks shall be paid.
G. The Board shall, when practicable, continue its established practice of paying employees at the regular work station to reduce lost travel time on pay day. Such statement shall show the employee’s name, the pay period and hours worked, all deductions made, and the net amount due the employee.
H. Nothing in this Agreement shall be construed as a guarantee of hours of work per day or week or of days of work per week or of work per year.

HOURS OF WORK AND OVERTIME. Section 1The regular work week for full-time employees shall not exceed forty hours worked in five days, Monday to Friday inclusive. The normally Employer does not guarantee to provide work for an employee for regularly assigned hours or for any other hours. Section 18.4. The Employer shall attempt to distribute opportunities to work overtime as equally as practicable among those employees in a department or job classification who are qualified and available to perform the work. A call-out list shall be prepared in each department of qualified employees in order of their respective seniority. As call-outs occur, the hours worked, if accepted or refused by the employee shall be placed next to the employee’s name. Once the initial list has been completed, calls will then be made to the qualified employee lowest in hours when such overtime occurs. The list shall be posted in each department where all employees will be able to view it on an every other week basis. The Employer reserves the right to require employees to work overtime to meet operational demands. Should the Employer have to force employees to work overtime, the employee lowest in hours who is available and qualified to perform the work shall be contacted first. This procedure shall be continued until the required number of employees have been obtained.
Section 18.5. Any bargaining unit employee may request to accumulate compensatory time off in lieu of receiving overtime pay for any authorized overtime worked. 14.08 Work scheduling shall be done daily and strictly in accordance with seniority in each classification provided the most senior employees are qualified to perform the work required. Jobs with the longest daily probability shall be afforded to the employee in the appropriate classification with the highest seniority, qualifications and ability.
14.09 Notwithstanding Article 14.08, work shall be offered to less senior employees once more senior employees have worked overtime for which they are entitled a minimum of 40 hours in any given work week. Once all seniority employees have 35 hours of work, the scheduling practice in Article 14.08 will apply.
14.10 An employee will not be scheduled to pay work more than 12 hours in any day.
14.11 Employees may, with prior approval, report directly to the job site at the rate designated time. Overtime will be reviewed quarterly. For the employee's name who appears first on the list to work purpose of equalization of overtime hours, when overtime is available. When the an employee is unable to work the overtime which has been offered to him/her, the employee shall not be offered overtime until his/her name again appears at the top of the listand declines, those hours will be recorded as “declined.” Shifts will be bid based on seniority. The rotating seniority list for overtime shall apply to regularly scheduled overtimeShifts will normally be bid once per year, and to emergency overtime when practicablehowever, circumstances may require more or less frequent bidding (e.g. new hire, promotions, etc.). The rotating seniority list shall not apply to hold- over overtime. Management reserves the right to require overtime for employees. Should it be necessary to require overtime, Management Bidding will begin assignments with the least senior employee normally take place in each job classification where overtime is worked and rotate such assignments from a list which begins with the least senior employee. When possible, Management shall give a twenty-four (24) hour notice of required overtimeDecember so they can take effect January 1st.
Section 4. Overtime premiums shall not be pyramided, compounded or paid twice for the same time worked.
Section 5. Employees who have worked overtime for which they are entitled to pay at the rate of time and one-half may take compensatory time at the rate of time and one-half in lieu of pay at the overtime rate. Employees shall be permitted to take compensatory time within twelve (12) months from the date it was earned. Employees may not earn in excess of seventy (70) hours (70 hours times one and one half = 105 hours) of compensatory time in a calendar year.
