Joint Trenching. Franchisee shall cooperate in the planning, locating and construction of its Cable System in utility joint trenches or common duct banks with other telecommunications providers. The Franchise Authority will provide advance notice to Franchisee when it plans to open a trench and Franchisee shall provide notice to the Town, in the form of any required permit under Section 3.1 herein, when it plans to open a trench.
Joint Trenching. For new developments, the City shall provide the Grantee with written notice of the issuance of development permits for planned developments within the Franchise Area requiring undergrounding of cable facilities. The City agrees to require the developer, as a condition of issuing the permit, to give the Grantee access to open trenches for deployment of cable facilities and at least ten (10) business days written notice of the date of availability of open trenches. When new construction or property development occurs, and all utilities are to be placed underground, Grantee shall participate in any joint trench coordinating committee or joint trench program established by the City within the Franchise Area. Grantee may participate in joint trench opportunities where a new development's dwelling units, when occupied, will not meet the line extension policy as set forth in Section 4.3 but shall participate where the new development's dwelling units, when occupied, would meet the line extension standards. Grantee as of the Effective Date of this Franchise has a program for service availability in new developments. Grantee will work directly with developers to enable provision of service to a new home upon occupancy. Grantee may be involved in all design aspects of the new construction or development that relate to the infrastructure required for Cable Service, including the provision of specifications and engineering assistance prior to construction. The costs of easements, trenching, and construction of the conduits required to bring Cable Service to the new construction or development may be borne by the developer or the property owner, as may be agreed upon by the developer, property owner and Grantee. Grantee will bear all costs of installing cable, amplifiers, and other equipment required to construct and operate the Cable System.
Joint Trenching. Franchisee shall use reasonable efforts to construct new underground areas of the cable system jointly with telephone and electric utilities.

  • Background Screening VENDOR shall comply with all requirements of Sections 1012.32 and 1012.465, Florida Statutes, and all of its personnel who (1) are to be permitted access to school grounds when students are present, (2) will have direct contact with students, or (3) have access or control of school funds, will successfully complete the background screening required by the referenced statutes and meet the standards established by the statutes. This background screening will be conducted by SBBC in advance of VENDOR or its personnel providing any services under the conditions described in the previous sentence. VENDOR shall bear the cost of acquiring the background screening required by Section 1012.32, Florida Statutes, and any fee imposed by the Florida Department of Law Enforcement to maintain the fingerprints provided with respect to VENDOR and its personnel. The parties agree that the failure of VENDOR to perform any of the duties described in this section shall constitute a material breach of this Agreement entitling SBBC to terminate immediately with no further responsibilities or duties to perform under this Agreement. VENDOR agrees to indemnify and hold harmless SBBC, its officers and employees from any liability in the form of physical or mental injury, death or property damage resulting from VENDOR’s failure to comply with the requirements of this section or with Sections 1012.32 and 1012.465, Florida Statutes.

  • Screening The Health Plan must work with contracted providers to conduct interperiodic EPSDT screens on RIte Care and all ACA Adult Expansion Population members under age 21 (i.e. 19 and 20-year old under this Agreement) to identify health and developmental problems in conformance with ATTACHMENT ED to this Agreement. Additional screens should be provided as Medically Necessary. At a minimum, these screens must include: • A comprehensive health and developmental history, including health education, nutrition assessment, immunization history, and developmental assessment • Immunizations according to the Rhode Island EPSDT Periodicity Schedule • An unclothed physical examination • Laboratory tests including lead, TB, and newborn screenings as medically indicated • Vision testing • Hearing testing • Dental screening oral examination by PCP as part of a comprehensive examination required before age one (1) • All other medically indicated screening services • And provide EOHHS with a list of established CPT/HCPC codes used to identify all billable services included in the EPSDT schedule.
