Maintenance, Testing and Repair Clause Samples

The Maintenance, Testing and Repair clause outlines the responsibilities for keeping equipment, systems, or property in good working order throughout the term of an agreement. It typically specifies which party is responsible for performing regular maintenance, conducting necessary inspections or tests, and carrying out repairs when issues arise. For example, in a lease, the tenant may be required to maintain HVAC systems, while the landlord handles structural repairs. This clause ensures that assets remain functional and safe, preventing disputes over upkeep and minimizing the risk of unexpected breakdowns or liabilities.
