The "Methods and Equipment" clause defines the standards and requirements for the techniques, tools, and machinery that a contractor or party must use to complete a project or perform services. Methods and Equipment. (1) The methods and equipment used by the Responsible Party and/or Contractor shall produce a satisfactory quality of work. Equipment used on any portion of the project shall be such, and its use so regulated, that no serious or irreparable damage to the roadway, adjacent property, or other streets or highways will result from its use. If damage does occur to these areas, suitable repairs shall be made at the Responsible Party’s expense. (2) When the methods and equipment to be used by the Responsible Party and/or Contractor in accomplishing the construction are not prescribed in the plans, specifications, or standards, the Responsible Party and/or Contractor is free to use any methods or equipment that will accomplish the work in full conformity with the requirements of the approved plans, specifications, and standards, as demonstrated to the satisfaction of the City Engineer.
Methods and Equipment. Add the following after the second paragraph: “Equipment which the Engineer feels could damage Thruway Facilities shall not be allowed to operate until adequate protective measures are provided such as wooden mats, bridging devices or rubber pads. The Engineer’s approval of such protective devices shall not relieve the Contractor from responsibility for damage. The Contractor shall be responsible for keeping equipment in good working condition. Operators shall be knowledgeable in all aspects of equipment operation and shall know the limitations of the equipment. Methods and Equipment. 4.21.1 The methods and equipment adopted by CONTRACTOR shall be such as will secure a satisfactory quality of WORK and will enable CONTRACTOR to complete the WORK in the time agreed upon. The selection and use of these methods and equipment is the responsibility of CONTRACTOR. 4.21.2 When the SPECIFICATIONS state the construction shall be performed by the use of certain methods and equipment, such methods and equipment shall be used unless others are authorized by ENGINEER. If CONTRACTOR desires to use a method or type of equipment other than those specified, he may make that request to PM/CM, who shall immediately forward the request to ENGINEER. The request shall be in writing and shall include a full description of the methods and equipment proposed to be used and an explanation of the reasons for desiring to make the change. If approval is given, it will be on the condition that CONTRACTOR will be fully responsible for producing construction work that performs the equivalent or better function as the original specifications. Approval by TOWN does not guarantee acceptance of the final Work, which will be determined by the ENGINEER, after evaluating whether equivalent or better function as the original specifications was or will be achieved. If, after trial use of the substituted methods or equipment, ENGINEER determines that the WORK produced does not meet the SPECIFICATIONS, CONTRACTOR shall discontinue the use of the substitute method or equipment and shall complete the remaining construction with the specified methods, equipment and quality, or take such other corrective action as ENGINEER may direct. No change will be made in basis of payment of the construction items involved nor in CONTRACT TIME as result of authorizing a change in methods or equipment under these provisions. CONTRACTOR may appeal a decision of ENGINEER under this Section to PM/CM. Any such appeal must be made in writing within forty-eight (48) hours of ENGINEER'S decision or the right to appeal is waived.
Methods and Equipment. All Equipment used for the Work shall be of size and mechanical condition to meet the requirements of the Work and to produce a satisfactory quality of Work. Equipment used shall not cause injury to E-470, adjacent property, or other highways. The Authority reserves the right to reject any vehicle and/or Equipment from the Worksite which do not meet these requirements. When the methods and Equipment to be used are not prescribed in the Contract, the Contractor shall use any methods or Equipment that will accomplish the Work in conformity with the Contract requirements. When the methods and Equipment to be used are specified in the Contract, other methods and Equipment shall not be used in the performance of the Work unless the Contractor receives prior written authorization from the Authority. If the Contractor desires to use a method or Equipment other than specified in the Contract, the Contractor may request approval from the Authority. The request shall include a full description of the methods and Equipment proposed to be used and the Contractor's explanation for the proposed change. The Contractor shall remain fully responsible for producing Work in conformity with the Contract. If the substituted methods or Equipment do not produce results conforming to Contract requirements, the Contractor shall complete the remaining Work with the originally specified methods and Equipment. Unacceptable Work shall be removed, repaired, replaced, or otherwise remedied, at the Contractor's sole expense, to conform with the specified and required quality. No increase will be made in the basis of payment for the Work items involved nor in Work Requests or Verbal Requests when a change in methods or Equipment is authorized.

The Contractor shall remove and replace unacceptable Work or repair deficient Work at no cost to The T/LPA.

C. When the Contract specifies the use of certain methods and equipment, such methods and equipment will be used unless others are authorized by the Owner. If the Contractor desires to use a method or type of equipment other than specified in the Contract, Contractor may request approval from the Owner to do so. The request will be in writing and will include a full description of the methods and/or equipment proposed and the reasons for desiring to make the change. If approval is given, it will be on the condition that the Contractor will be fully responsible for producing work in conformity with the Contract Documents. If, after trial use of the substituted methods or equipment, the Owner determines that the Work produced does not meet the Contract Documents, the Contractor will discontinue the use of the substitute method or equipment and will complete the remaining Work with the specified methods and equipment. D. The Contractor will remove any deficient Work and replace it with Work of specified quality, or take such other corrective action as the Owner may direct. No change will be made in basis of payment for items in the Contract involved or in Contract Time as a result of authorizing a change in methods or equipment under this Section.
Methods and Equipment. The Contractor shall employ persons who possess the skill required to properly perfonn the work under the contract When required by the Officer- in-Charge, whose decision shall be final, the Contractor shall replace any employee who lacks the skill to perform the work assigned to the employee or is discourteous or disorderly while perfonning such work. If acceptable to the Officer-in-Charge, a person who has been so replaced may be assigned other work on the project. Any such acceptance by the Officer-in-Charge shall not relieve the Contractor from performing the work in accordance with the contract.
