Negative Balance. Each time you initiate a transaction using your Account, you authorize the Bank to reduce the funds available in your Account by the amount of the transaction and all associated fees. You are not allowed to exceed the available amount in your Account through an individual transaction or a series of transactions (creating a “negative balance”). Nevertheless, if any transaction causes the balance in your Account to go negative, including any purchase transactions where the retailer or merchant does not request authorization, you shall remain fully liable to us for the amount of any negative balance and any corresponding transaction fees. You may also be liable for any related Insufficient Funds/NSF Fee(s) as set forth in Exhibit 1. We reserve the right to bill you for any negative balance or to recoup such negative balance from your Account or any other account you have at the Bank. You agree to pay us promptly for the negative balance and any related fees. We also reserve the right to terminate your Account if you create one or more negative balances. If you fail to pay us amounts owed under this Agreement, we may refer your Account, and collection of amounts owed, to a collection agency.
Negative Balance. 12.1. If any action results in a negative balance in your Account, you must reimburse Paynetics the amount of the negative balance immediately upon request. Paynetics may charge the amount of the negative balance against the funds on any other Accounts held by you, including any subsequently loaded funds. Paynetics may suspend Accounts and Cards until it is reimbursed for the negative balance in full and may take legal action against you to recover such amount.
Negative Balance. If your account has a negative balance for any reason, you agree to pay the amount of the negative balance without notice or demand from us. You also agree to reimburse us for any costs we incur in collecting the amount of any negative balance, including reasonable attorneys’ fees and the costs of litigation. We may refuse any check or other item or withdrawal request if it is not made in a manner specifically authorized for your type of account. We utilize automated collection and processing procedures which rely primarily on information encoded onto each item, whether or not that information is consistent with other information on the item. You agree that LGFCU does not fail to exercise ordinary care in paying an item solely because our automated procedures do not provide for sight-review. You may request a stop payment order on any check drawn on your account. If the account is a joint account, any joint owner can stop payment of any item drawn on the account. To request a stop payment order, please contact your local branch, call ▇▇▇.▇▇▇.▇▇▇▇, log on to Member Connect at ▇▇▇▇▇.▇▇▇, or you may send a written request to P.O. Box 29606, Raleigh, NC 27626. The stop payment order must describe the check with reasonable certainty (for example, the payee, account number, check number, and exact amount of the check), and we must receive your order in time to act on it. LGFCU will not be responsible for failing to stop payment of a check if you provide us with untimely, incorrect or incomplete information. Stop payment orders on checks remain in effect for 12 months. We may pay a check once the stop payment order expires. In order for the stop payment to continue for another 12 months, you must complete a new stop payment order. If you want the stop payment order to expire in less than 12 months, you may provide us written notice requesting to cancel the stop payment order. Negative Balance. When a Negative Balance occurs, ▇▇▇▇▇ has the right to offset future compensation owed to PROVIDER or Participating Provider with the amount owed to ▇▇▇▇▇ and the right to bill PROVIDER or Participating Provider for such Negative Balance(s). ▇▇▇▇▇ will automatically, when possible, apply the Negative Balance to other outstanding payables on PROVIDER’s account. In some instances it may be necessary for ▇▇▇▇▇ to send an invoice to PROVIDER for outstanding Negative Balance(s). The PROVIDER is responsible to remit payment to ▇▇▇▇▇ upon receipt of invoice. ▇▇▇▇▇ retains the right to seek assistance from various collection agencies and/or to suspend or permanently terminate PROVIDER from further participation in ▇▇▇▇▇’ network in accordance with the suspension and termination provisions set forth in this Agreement.
