Overtime Distribution. Employees The Board and the Union recognize that there will be periods when management must request employees to work overtime. Both parties shall strive to ensure that a work force is available when needed. A. Overtime Distribution. Overtime Distribution. Employees A. If requested to work overtime, an employee will be expected to do so unless he/she is excused for good cause. B. All overtime work to which overtime pay is applicable shall be canvassed annually distributed as equally as possible among qualified and capable employees within a reasonable period of time and within the classification affected. C. An overtime distribution list shall be kept current within the classification affected. Overtime worked shall be added to determine if they want the overtime distribution sheet within a period of four (4) days. Only overtime worked in the primary dispatch center, the back-up dispatch center, the communications trailer, or at an off-site location where basic primary dispatch functions are provided will be added to the overtime distribution list. The majority of said off-site overtime would be distributed through regular overtime distribution methods. However there may be rare occurrences when a dispatcher may be “assigned” to cover a special event and the overtime is not distributed through the regular procedures. Under that circumstance, the off-site overtime would be added to the Overtime Distribution List and would count towards total cumulative hours. Overtime gained as a result of attending a training or conference will not be posted on the overtime distribution list and will not be factored in when determining total overtime hours. On January 1 of each year the overtime distribution list shall be zeroed out. Each year, following the zeroing out of overtime accumulation, the initial order of call-in shall be by seniority (highest first) until each employee has accumulated overtime worked or charged on the overtime distribution list. D. When an overtime assignment occurs, the first employee able to be offered reached with the lowest number of overtime opportunities outside hours worked on the overtime distribution list for the classification affected shall be directed to work the overtime. That employee may trade with another regular employee within the same classification. The employee taking the hours must call and confirm they are taking the hours on a taped phone line. In cases where a more eligible employee for an overtime assignment calls back after a less eligible employee has been directed to work, the directed employee shall have the option to keep the overtime assignment or have it reassigned to the more eligible employee. E. Overtime assignments shall not result in an employee being required to work more than eighteen (18) continuous hours, inclusive of their regular hours of workshift, in any twenty- four (24) hour period. The procedure shall be followed until the required employees have been selected for the overtime work. An accurate record of overtime shall be equitably distributed on a rotating basis by overtime maintained in all departments showing the numbers of hours worked, hours called, hours refused and hours worked among those who normally perform the workon continuation for each department employee. Specific arrangements for implementation of these overtime provisions The record shall be worked out updated daily and reflect an accurate total of all hours each week. This overtime record shall be posted on the respective department bulletin board every week but may be done more frequently at the department level. Overtime rosters shall be purged at least every twelve (12) months. Such arrangements shall recognize that in discretion of the event the Appointing Authority or designee has determined the need for overtime, and if a sufficient number of employees is not secured through the above provisions, the Appointing Authority or designee shall have the right to require the least senior employee(s) on a rotating basis who normally performs the work to perform said overtimeDepartment. The overtime distribution policy list shall be available for employee review on a daily basis. Employees currently on vacation or authorized sick leave are exempt from eligibility list rotation while on vacation or authorized sick leave. Distribution of overtime may be affected by the preceding as indicated, by the ability of the employee to operate the necessary equipment, or by an emergency situation beyond the control of the Employer. The above shall not apply to the continuation of shift. It is understood and agreed that an employee working on a job at the end of a shift upon which job overtime is required shall be given the first opportunity to work such overtime notwithstanding any provisions of this Agreement to the contrary. The City in assigning overtime shall ask down the overtime list by each classification necessary to perform overtime work which and shall require overtime up the seniority list, least senior employee first in the classification necessary, until a full complement of employees is specific to a particular employee's work load or specialized work assignment or when the incumbent is required to finish a work assignmentsecured. An Where an employee who is offered but refuses an overtime assignment shall be credited on the roster with the amount of overtime worked by the employee who accepted the overtime opportunity. An employee who agrees to work report to overtime and then fails to report for said overtime report, or is required to work when utilizing the seniority list in inverse order, such absence shall be credited with the amount of overtime hours accepted unexcused and the employee shall be considered absent without approved leave, subject to discipline unless the employee can prove that extenuating circumstances prevented was unable to work for reasons acceptable to the Employer. In such cases The bypassed employee(s) shall be allowed to make up the employee lost overtime. The employee, if more than one, by charged overtime, will be credited as if placed at the overtime opportunity was refused. In the event of an emergency as determined by the City, the Appointing Authority or designee may assign someone to temporarily meet the emergency requirements, regardless top of the overtime distribution rosterlist until the lost time has been made up respectively. After the employee(s) time is made up they will be placed in the appropriate spot on the overtime list. All time is charged as outlined in Section 8, paragraph 5 of the contract. If lost hours are at double time or time and a half, lost hours can be made up with the first available overtime calculated to make up the loss; i.e., 12 hours double time lost could be made up with 16 hours time and a half or a combination not necessarily consecutive but cumulative. On the call back of a bypassed employee at the end of the regular shift, an "unavailable" shall not be charged unless the employee has had normal travel time home.

An employee who is offered but refuses an overtime assignment record shall be credited on current through and including the roster with second preceding Sunday. At the end of each week, the amount of overtime worked by the each employee who accepted shall be entered after his name on that record. Insofar as practicable, and subject to the overtime opportunityscheduling procedure agreed to between the parties, overtime work shall be scheduled so that there will be no great overtime differential between employees. If an employee refuses overtime work when he is scheduled for it, he shall be charged with such overtime work as though he had worked it. An employee who agrees desiring to work overtime beyond the end of his regular shift or prior to his next regular shift must indicate his availability for such overtime work by signing the daily overtime availability sheet no later than two (2) hours after the start of their regularly scheduled shift. If overtime is scheduled beyond the end of the shift, the schedule for such overtime will be posted prior to 3:00 a.m. for the midnight shift, 11:00 a.m. for the day shift, and then fails 7:00 p.m. for the afternoon shift, insofar as practicable. If overtime work is scheduled prior to report the employee's next regular shift, the schedule for said such overtime shall will be credited with posted before the amount end of the employee's regular shift for that day, insofar as practicable. The Union agrees not to file a grievance on overtime differential as long as the Company does not arbitrarily refuse to offer overtime work to the low man on the overtime roster in the Electrical Department. After completion of the pay period including the last day of December of each year, the overtime hours accepted and for each Electrician who has completed the employee shall be considered absent without approved leave, unless the employee can prove that extenuating circumstances prevented the employee from reporting. In such cases the employee probationary period will be credited as if set at zero (0) on the overtime opportunity was refused. An overtime spread of sixteen (16) hours between the low employee in the overtime group and the high employee will be considered a reasonable and fair distribution of overtime among employees in the group. In cases where an employee is more than sixteen (16) hours behind, he will be offered the first available hours to make up for the shortfall. Overtime work offered and refused will be counted as overtime worked. An employee may elect not to be called for overtime by informing his supervisor, however he will be charged when his name comes up to be asked. If no one is available for overtime the supervisor may elect to force beginning with the employee(s) who is at work in the classification who is next on the list to be forced.
