Overtime Distribution. 22.01 The Company reserves the right to determine overtime work in accordance with requirements of the business including what shifts and classifications are required. 22.02 All hours worked in excess of 8 hours a day or 40 hours a week will be paid at the overtime rate of one and a half (1.5) times the employees regular wage rate. A copy will be made available to the committee person. 22.06 Shift and hours agreed to by initialling the confirmation sheet will be deemed to be scheduled hours for the purposes of attendance management. 22.07 Employees on overtime will work in selection at the beginning of their overtime shift. Overtime assignments will then be distributed based on seniority; skill, ability and qualifications after the daily allocation of assignments have been completed for full-time employees on regular time as required. 22.08 The Company reserves the right to call additional employees at home if required. The employees called will be contacted in order of seniority provided they have the skills, ability and qualifications for the required job. A union representative will be present when the individuals are called for overtime. 22.09 If there are still an insufficient number of volunteers for overtime work, overtime may be scheduled by inverse order of seniority for that shift provided the employee has the skill, ability and qualifications. 22.10 No employee on his/her regular scheduled shift shall be bumped from the work within his classification by an employee working on overtime. 22.11 Employees are not permitted to exceed the daily and weekly maximum hours of work as set out in the Ontario Employment Standards Act. Specifically daily overtime (earlies and stay lates) will not exceed 4 hours in a day. 22.12 Where an employee works four (4) or more consecutive hours of overtime before the start of his/her regularly scheduled shift, he/she will be granted one 15 minute rest period as close to the end of the four (4) hours overtime shift and thereafter will be granted further 15 minute rest periods for every four (4) hours worked. 22.13 Where an employee works four (4) or more consecutive hours of overtime after the completion of his/her regularly scheduled shift, he/she will be granted one 15 minute rest period at the end of his/her regularly scheduled shift and thereafter will be granted further paid 15 minute rest periods for every four (4) hours of overtime worked. 22.14 Unless all full-time employees who are canvassed to work decline, an employee who is absent from work on vacation, or leave of absence shall not be offered an overtime assignment. For clarity, an employee shall not be considered for overtime during the period commencing with his/her first regularly scheduled shift that he/she is on vacation, and ending with his first regular shift after the end of his/her vacation. 22.15 It is understood by the parties that employee’s are not entitled to work voluntary overtime from the first day the individual is suspended until the start of their next regular shift.

Overtime Distribution. 22.01 (a) Overtime will be distributed in such a manner that each employee within an overtime group will receive his fair share. An overtime spread of sixteen (16) hours for 8-hour shift employees, twenty (20) hours for 10-hour shift employees, and twenty-four (24) for 12-hour shift employees between the low employee in the overtime group and the high employee will be considered a reasonable and fair distribution of overtime among employees in the group. Overtime offered and refused will be counted as overtime worked. A record of overtime will be kept up to date and posted in an accessible location to enable employees to review. The overtime rules shall continue to be used as a means to implement the fair distribution of overtime within an overtime group. An employee can be on only one overtime list at a time. (b) Overtime will be distributed in four (4) six (6), eight (8) ten (10) and (12) hour increments. However, two (2) hour overtime increments can be offered in conjunction with a normally scheduled ten (10) hour work day. If a task cannot be completed during a scheduled shift, scheduled overtime, or emergency call-in, the Company reserves the right to request an individual having specific job knowledge, based on having worked on the task immediately prior to the need to continue the work task, to continue working for the amount of time needed to finish the task, but not longer than sixteen (16) continuous hours. Overtime lists will be created and maintained as listed in Appendix D. In scheduled overtime situations where an employee is improperly bypassed for overtime in violation of the Contract, the bypassed employee will be offered the same amount of bypassed hours at the employee’s convenience within four (4) weeks after the bypass is known. The overtime list will then be adjusted to reflect the overtime hours when worked. Alternate lists will be provided and time permitting, will be polled prior to a compulsory assignment. The Company agrees to meet with the Union to discuss and seek resolution of difficulties, which may exist in the administration of overtime distribution. These meetings between Company management and the appropriate Union officials will be held on a semiannual basis. (c) All overtime opportunities shall be charged when offered. An employee, who accepts an overtime assignment and then fails to report to work, will be charged double the hours for the purpose of overtime calculation. A standard form will be developed by the Union and the Company for the purpose of overtime distribution. This form will include a space for the employee Committeeperson to sign, which will be considered proof they were asked to work the overtime. Any offer of overtime that is refused, provided at least hours advance notice was given, will be charged to the employee as worked for the purpose of overtime distribution. Overtime outside of the employee’s classification is not considered for refusal. Shifts covered Friday night 3:00 PM – 11:00PM using overtime will go as follows: Equalization between the day shift in the category from 3:00PM – 7:00PM, ability and qualifications. 22.10 No employee on his/her regular scheduled then straight equalization from 7:00 PM – 11:00 PM. Overtime Distribution. 22.01 a) Where the Fire Chief or designee determines that overtime is to be offered, it will be offered to the employee in the same classification in which the overtime is needed who has the lowest total overtime hours (all personnel begin with 0 (zero) hours each year on May 1st). If that employee cannot accept the overtime, it will be offered to the employee in the applicable classification who has the next lowest total overtime hours. This will continue until all needed overtime shifts have been filled. Notwithstanding the foregoing, if at least three (3) officers are on duty, an overtime opportunity caused by the absence of an officer will be filled by a firefighter/paramedic. b) When an employee is absent due to illness or other reason that necessitates that the overtime be filled quickly, off-going personnel may be offered the overtime prior to calling off duty personnel who may have fewer overtime hours. All efforts will be made to fill such overtime voluntarily from off-going shift personnel or off duty personnel who live close enough and are able to report to duty by the start of the shift. c) In the event the Fire Chief or designee determines that an employee’s absence requires a hire back for a full 24-hour shift, the overtime shall be scheduled in eight (8) or twelve (12) hour increments for firefighters and lieutenants, respectively. When calling off duty personnel to offer overtime and there is no answer, the next employee on the overtime list will be called. Calls shall be made to the phone number designated by each employee to be used when attempting to fill the overtime shift. The Company reserves current phone list shall be kept with the right OT log sheet. d) In the event there are multiple duty days that the Fire Chief or designee has determined needs to determine be filled, the employee contacted shall have his choice of shifts on the first available duty day. Once the first duty day is filled, the overtime work list will then be readjusted, and the next available duty day will be filled in accordance with requirements Section 8.6. e) If the above overtime procedure does not result in an employee accepting the offered overtime, the employee with the least seniority in the classification needed shall be forced back. f) Employees who are off duty due to a vacation or H-day shall be included in the above overtime provisions but shall not be forced back. Employees who are off on vacation, H-day, personal or swap day shall not be forced back. Overtime Distribution. 22.01 A. Full Time employees requesting overtime shifts shall place themselves ‘available’ in the electronic time keeping system for the days and hours desired. The Company reserves Lieutenants will place em- ployees marked ‘available’ into open shifts only if the electronic time keeping system has not. Overtime will be distributed with an emphasis on spreading the hours evenly and fairly utiliz- ing the automated electronic time keeping system first; Lieutenants can interface secondly, if needed. If an employee has a need to alter the start or end time to a shift after it was accepted by him/her, he/she must contact the Lieutenants via email At no point should any employee contact the Lieutenants to request a particular station or partner. If the employee is placed into an open shift that is over 72 hours away, the Lieutenants shall send a notification to the em- ployee via the electronic time keeping system informing them they have been placed on a shift. If the Lieutenant places the employee into an open shift that is within 72 hours, he/she will contact that employee via phone call to ensure he/she is still able to work the shift. However, it is ultimately the employee’s responsibility to check the electronic time keeping system for their work schedule and station assignments after placing themselves ‘available’. If the Lieu- tenant has to move or cancel an employee’s station assignment or shift, they must contact the employee via phone call prior to the start of their shift. Full time employees will not be placed in an open overtime shift that is over 14 days away to allow adequate time for relief employees to be assigned shifts. Relief employees may bump full time employees assigned to a shift; however no bumping is allowed within 72 hours of the shift. Overtime Distribution. 22.01 Overtime within each classification in a Department will be distributed fairly and without prejudice. If an Employee is inadvertently missed in their proper rotation, they will be eligible for the next scheduled overtime, until their hours are equal to what they would have been had they not been missed. In no event will there be payment for time not worked. Where overtime is required immediately following a regular shift, Monday to Friday inclusive, such overtime will be offered to the necessary number of Employees who are working on the particular job requiring overtime. Where overtime is required on Saturdays Sundays, such overtime will be offered to the necessary number of Employees who are at work on the regular shift when such overtime is organized and who the least accumulated o overtime. In cases of selective overtime, the employee with the least accumulated overtime hours for the classification will be asked to work first, regardless of the shift presently being worked. Overtime for Chargehands will be calculated in the same category as the first class men in their departments. The only exceptions to the above will be by mutual agreement between the Company and the Business Agent or his substitute. In all of the above, when the overtime hours accumulated by Employees are equal, the overtime required will be offered on the basis of classification seniority. The ▇▇▇▇▇▇▇ of each department will maintain a list of the distribution of all overtime worked or charged to his Employees. These lists will be revised daily for the week ending on Saturday. By Wednesday forenoon of each week the ▇▇▇▇▇▇▇ will give one copy to the ▇▇▇▇▇▇▇ representing his department, post one copy on the bulletin board, and retain one copy in his file. Commencing on January 1st in each year the classification overtime distribution lists will be revised as follows: the Employee with the least number of overtime hours will be considered as zero. Excess hours accumulated by each of the other Employees in the classification will be carried forward. The lists will then be maintained as in If an Employee is unavailable for, or refuses overtime work, the requested overtime hours will be charged against the Employee in the overtime distribution list in his classification at the applicable overtime rate converted to straight time hours. All new hires will be credited with the average overtime hours worked by all Employees in the classification which the new hire is entering. An Employee who has been recalled will be credited with the average overtime hours worked by all Employees in his classification during his lay-off. However, if an Employee has accumulated overtime hours on a temporary transfer, his overtime hours will be those that have been credited to him under or the average of his department, whichever is greater. An Employee who agrees to work overtime and does not report for work will be charged double the overtime worked converted to straight time unless he phones in prior to the commencement of the shift in which case he will be charged the overtime worked converted to straight time hours. An Employee who agrees to work overtime and who reports for work later than sixty minutes from the beginning of the overtime shift without notifying the Company may be replaced by another Employee who will have preference in completing the overtime shift. The replaced Employee will be charged double the overtime hours worked converted to straight time hours. The Company reserves has the right to determine temporarily replace an Employee who does not report for overtime work until a proper replacement can be found. A temporarily transferred Employee may not work overtime in accordance his temporary classification until all permanent Employees in the classification have been asked. Overtime Distribution. 22.01 (a) Where the Fire Chief or designee determines that overtime is to be offered, it will be offered to the employee in the same classification in which the overtime is needed who has the lowest total overtime hours (all personnel begin with 0 (zero) ▇.▇▇ offered to the employee in the applicable classification who has the next lowest total overtime hours. This will continue until all needed overtime shifts have been filled. Notwithstanding the foregoing, if at least three (3) officers are on duty, an overtime opportunity caused by the absence of an officer will be filled by a firefighter/paramedic. (b) When an employee is absent due to illness or other reason that necessitates that the overtime be filled quickly, off-going personnel may be offered the overtime prior to calling off duty personnel who may have fewer overtime hours. All efforts will be made to fill such overtime voluntarily from off-going shift personnel or off duty personnel who live close enough and are able to report to duty by the start of the shift. (c) In the event the Fire Chief or designee determines that an employee’s absence requires a hire back for a full 24-hour shift, the overtime will whenever possible be scheduled in twelve (12) hour increments for firefighters and lieutenants. When calling off duty personnel to offer overtime and there is no answer, the next employee on the overtime list will be called. Calls shall be made to the phone number designated by each employee to be used when attempting to fill the overtime shift. Other means of communication may be used after the phone call has been made. The Company reserves current phone list shall be kept with the right OT log sheet. (d) If the above overtime procedure does not result in an employee accepting the offered overtime, the employee with the least seniority in the classification needed shall be forced back. If someone is forced for one shift, they are offered the other shift before calling through the list again. If one shift is filled and then the other shift is forced, the force back person can “bump” the other for the full 24-hour shift IF the first person doesn’t take the full 24 hours to determine prevent the force back. (e) Employees who are off duty due to a vacation or H-day shall be included in the above overtime provisions but shall not be forced back. Employees who are off on vacation, H-day, personal day, swap, emergency or bereavement leave, shall not be forced back. Forty-eight (48) hours prior to the first duty day off and 48 hours after the last duty day off cannot be forced back. (f) Where an overtime opportunity requires special qualifications (e.g., haz mat certification, fire investigation certification), all bargaining unit personnel shall be notified via e-mail of the availability of overtime, and it shall be offered to whomever has the special qualifications, is available and has the lowest amount of overtime on a specified date. A signup sheet shall be posted for the overtime. (g) Probationary firefighters who have not been certified as paramedics shall not be eligible for overtime opportunities that require a paramedic certification. (h) Nothing herein shall be construed to require assigning overtime work to off-duty personnel where an employee is being held over to continue work in progress (e.g., a fire or EMS call or a mutual aid response). (i) All bargaining unit personnel shall be notified via e-mail of the availability of overtime for special events and the details concerning same. For clarity, an employee shall not be considered for overtime during the period commencing with his/her first regularly scheduled shift that he/she is on vacation, and ending with his first regular shift after the end of his/her vacation. 22.15 It is understood by the parties that employee’s are not entitled to work voluntary overtime from the first day the individual is suspended until the start of their next regular own shift.

Overtime Distribution. 22.01 The Company reserves the right (a) Employees are required to determine perform overtime work in accordance with requirements of the business including what shifts and classifications are requiredas assigned. 22.02 All hours (b) Employees on each shift shall be accorded non-emergency overtime work opportunities on the basis of equal distribution of such opportunities. The employees called will be contacted in order of seniority provided they have the skills, ability and qualifications for the required job. Overtime Distribution. 22.01 (a) Where the Fire Chief or designee determines that overtime is to be offered, it will be offered to the employee in the same classification in which the overtime is needed who has the lowest total overtime hours (all personnel begin with 0 (zero) hours each year on May 1st). If that employee cannot accept the overtime, it will be offered to the employee in the applicable classification who has the next lowest total overtime hours. This will continue until all needed overtime shifts have been filled. Notwithstanding the foregoing, if at least three (3) officers are on duty, an overtime opportunity caused by the absence of an officer will be filled by a firefighter/paramedic. (b) When an employee is absent due to illness or other reason that necessitates that the overtime be filled quickly, off-going personnel may be offered the overtime prior to calling off duty personnel who may have fewer overtime hours. All efforts will be made to fill such overtime voluntarily from off-going shift personnel or off duty personnel who live close enough and are able to report to duty by the start of the shift. (c) In the event the Fire Chief or designee determines that an employee’s absence requires a hire back for a full 24-hour shift, the overtime will whenever possible be scheduled in eight (8) or twelve (12) hour increments for firefighters and lieutenants, respectively. When calling off duty personnel to offer overtime and there is no answer, the next employee on the overtime list will be called. Calls shall be made to the phone number designated by each employee to be used when attempting to fill the overtime shift. Other means of communication may be used after the phone call has been made. The Company reserves current phone list shall be kept with the right OT log sheet. (d) If the above overtime procedure does not result in an employee accepting the offered overtime, the employee with the least seniority in the classification needed shall be forced back. (e) Employees who are off duty due to determine a vacation or H-day shall be included in the above overtime provisions but shall not be forced back. Employees who are off on vacation, H-day, personal or swap day shall not be forced back. Forty-eight (48) hours prior to the first duty day off and 48 hours after the last duty day off cannot be forced back. (f) Where an overtime opportunity requires special qualifications (e.g., haz mat certification, fire investigation certification), all bargaining unit personnel shall be notified via e-mail of the availability of overtime, and it shall be offered to whomever has the special qualifications, is available and has the lowest amount of overtime on a specified date. A signup sheet shall be posted for the overtime. (g) Probationary firefighters who have not been certified as paramedics shall not be eligible for overtime opportunities that require a paramedic certification. (h) Nothing herein shall be construed to require assigning overtime work to off-duty personnel where an employee is being held over to continue work in progress (e.g., a fire or EMS call or a mutual aid response). (i) All bargaining unit personnel shall be notified via e-mail of the availability of overtime for special events and the details concerning same. A signup sheet shall be posted at Station #1, and the Chief or his designee will assign a date on which the sheet is removed from posting. The overtime will be assigned to qualified personnel with the lowest overtime as of the assigned removal date. If unforeseeable circumstances arise where there is not 24 hours’ notice of overtime availability, the email and posting notification can be waived by the Chief or his designee. The City agrees not to force back someone for special event overtime if it is less than 24-hours’ notice.
