Employees shall not be required to work on days declared by the Board as school holidays unless the day is part of the employee's established work schedule (e.g. parochial school drivers) or failure to work on such holidays would impair the public service. Employees who perform their assigned duties on days when District schools are closed shall be entitled to all compensation and other benefits of this Agreement. 3. When any employee, other than an employee regularly assigned to work a holiday as set forth in Paragraph 2 above, is required to work on a designated holiday, such time shall be computed paid at the following rates: a. When the need to have overtime work performed is urgent, the supervisor shall not be required to notify an employee who resides over twenty (20) miles from the District Administration Building. At the beginning of each school year, each custodial employee may sign an overtime list for the building in which the employee is assigned and an overtime list for the District. If no employee assigned to the building whose name appears on that building's overtime list accepts an overtime assignment under this Section, the overtime will be offered to employees whose names appear on the District's overtime list on a rotating basis in the order of system seniority as defined in Article 15. A custodial employee may, upon request, examine the applicable building overtime list or the District overtime list. 8.5.5 Based 6. To be eligible to work offered overtime, an employee must have worked all of his/her regularly scheduled workday immediately preceding the overtime, unless the employee's absence on mutual agreement between such day is attributable to approved vacation or personal leave. 7. Such overtime compensation shall be in the form of pay or employees may receive compensatory time at the overtime rate in lieu of overtime pay upon approval of the Chief of the Department up to a maximum of 480 hours of accumulated compensatory time. All overtime hours in excess of 480 shall be in the form of pay. Any employee who has accumulated more than 480 hours of compensatory time shall not accumulate any more, including by merit trade, as set forth above in Section 4.11. Any overtime earned after the Fair Labor Standards Act threshold of 212 hours in a twenty-eight (28) day work period shall be in the form of pay in all cases. The FLSA period shall begin on mutual agreement between the employee first day of a pay period, with the beginning on June 14, 1995. Effective January 1, 2018, there shall be at least seven (7) chiefs on duty, consistent with the 2017 Memorandum of Agreement concerning Battalion 2. 5.3.1 Employees shall be hired for overtime from a voluntary overtime signup list. Overtime hiring procedures will be in accordance with the Settlement Agreement dated January 30, 2009. Overtime Pay. 8.5.1 a) The work day and work week of Supervisors of the Maintenance Department have been described previously. Each Supervisor will be available for a reasonable amount of overtime. The FLSA period shall begin on mutual agreement between the employee first day of a pay period, with the beginning on June 14, 1995. Overtime Pay. 8.5.1 Overtime hours 21.03.01 No overtime shall be defined as follows:compensated for unless work is performed at the direction of a supervisor or the lead with the authority from a supervisor to do so. Employees will receive forty-eight (48) hours notice prior to the weekend overtime if the Company is aware in advance. Overtime Pay. 8.5.1 Overtime 10.1 The Employer shall establish shifts which may vary from day to day, but which will be not less than four hours in length and not greater than ten hours per twenty‐four‐hour period and which shall be defined as follows: a. no more than five days within a seven‐day period. Hours worked in excess of eight (8) the assigned shift hours in any one day or hours worked in excess of over forty (40) hours within a seven (7) day period, will be compensated for at one and one‐half (1‐1/2) times the employee's regular base pay rate. For the purpose of computing overtime compensation, overtime hours worked shall not be pyramided, compounded, or paid twice for the same hours worked. Time‐worked for the purposes of calculating overtime shall include regular hours worked, holidays and annual leave. This article shall not apply to regular part‐time employees. 10.2 Employees, except those listed in Article 10.6, shall be recompensed for work done in excess of the normal hours established above in this Article by being granted compensatory time on a time and one‐half basis or by being paid on a time and one‐half basis for such overtime work. The Employer may elect to pay overtime or compensatory time at its sole discretion. Employees will be allowed to maintain up to 32 hours of compensatory time off “on the books”. All compensatory time off hours remaining in an employee’s bank at year end will be paid in cash as taxable income on the last day of the last pay period of the year. 10.3 Employees required to return to the work site during off duty hours shall be compensated for all hours worked, plus reasonable travel time to and from the work site. Employees required to perform work at home during non‐duty hours shall be compensated a minimum of one hour for such work. Only overtime authorized by the Employer shall be compensated. 10.4 An employee called back to work at a time other than the normally scheduled shift shall receive a minimum of two (2) hours pay at one and one‐half (1‐1/2) times the employee's regular base rate. Refusal to work such overtime may result in discipline. 10.6 The provisions of Section 10.1 ‐ 10.4 notwithstanding, all employees in the title of Senior Planner shall be eligible to receive overtime pay if they work over 1040 hours within a 26‐week period measured from the beginning of the first pay period of each year and the beginning of the 14th pay period of each year. Time earned over forty hours in a work week may be used with the supervisor's approval as straight time compensatory time off. However, at the end of each 26‐ week period the employer shall pay for any accumulated compensatory time at one (1) week. b. Equalization records will be available for inspection by members each time overtime is offered. 10. In the event of staffing shortage, an employee shall be forced in from the shift that is on its four-day off rotation. This shall be done in order of lowest seniority on that shift based on the classification that the opening is present. Example: Fire fighters will be considered first by lowest seniority for an open fire fighter position, and a Lieutenant will be considered first by lowest seniority for an open Lieutenant position. 11. All overtime for the Lieutenant positions shall be offered first to full-time employees of the same rank, and then to all members of the Fire Suppression Division. All overtime for the Fire fighter positions shall be offered first to full-time Fire fighters, then to Lieutenants in the Fire Suppression Division. Section I - Payroll Deductions 1. The Board shall take the necessary steps to allow, at the employee's request, and to the extent that law permits deductions to be made for union dues, tax sheltered savings programs, and separate segregated funds. Section J - EMS Bonuses 1. The City shall pay an annual bonus in June, upon proof of valid certification: a. Five hundred dollars ($500.00) for EMT-Basic. b. All time worked over fifty-three (53) hours in one week for employees on a twenty- four (24) hour work day schedule in the Fire Suppression Division shall be recorded as overtime and paid at one and one half (1 Y,) times his/her normal rate. 3. Paid time off, including paid personal leave, sick leave, vacation leave and bereavement leave shall be considered time worked for the purpose of determining the number of overtime hours worked. Employees responding to an alarm prior to the end of their shift shall be permitted to continue, beyond the end of the shift, until that run is complete. 4. Fire Department employees who participate, on their off-duty time, in any Department-related functions, shall be paid at the rate of time and one half (1 1/2) with a minimum of one (1) week. b. For employees who work alternative work schedules, hours worked in excess of employee’s regularly scheduled shift. For example, when an employee works four (4) days at ten (10) hours a day, an eleventh hour worked would be an overtime hour. c. Hours worked on any declared District employee holiday, legal holiday, Saturday or Sunday5. All overtime offered for special events shall be offered to full time employees first. Only after all full-time employees have been offered the opportunity to work shall paid-on-call employees be utilized to staff special events. d. Those unit members 6. Hours worked in excess of regular forty one (401) hour work week and hours worked on Saturday -- time and one-half employee's rate of pay. b. Hours worked 7. When a Captain is not on Sunday -- two times employee's rate of payduty, Captain upgrade pay will be given to the Lieutenant assigned to that shift. When a Lieutenant is not on duty, Lieutenant upgrade pay will be given to the most senior fire fighter assigned to that shift, and they will be transferred to station #2. c. Hours worked 8. A Captain assigned by the Chief will keep records of all overtime offered to employees. Overtime shall be offered first to the eligible full-time employee with the lowest total hours, and progress to the eligible employee with the highest total hours. Equalization records will be available for inspection by members each time overtime is offered. 9. In the event of staffing shortage, an employee shall be forced in from the shift that is on holiday -- regular pay its four-day off rotation. This shall be done in order of lowest seniority on that shift based on the classification that the opening is present. Example: Fire fighters will be considered first by lowest seniority for an open fire fighter position, and a Lieutenant will be considered first by lowest seniority for an open Lieutenant position. Likewise, Captains will be considered first by lowest seniority for an open Captain’s position. 10. All overtime for the holiday plus double time for all hours actually worked on the holiday. 8.5.4 Unit members have the right Captain positions shall be offered first to accept or reject overtime work compensated by either overtime pay or compensatory time off (CTO) offered at the discretion employees of the immediate supervisor. 8.5.5 Based on mutual agreement between the employee and the immediate supervisor, CTO will same rank. Overtime Pay. 8.5.1 Overtime hours 16.01 During the life of the Agreement, employees shall be defined as follows: a. Hours paid at the rate of time and one-half for all time worked in excess of eight (8) after forty paid hours in any one day or a week. 16.02 Overtime within a facility will be offered by classification by seniority within each department within shift. If workload requires additional workers, the Company will offer overtime by seniority within each classification from the daily overtime list. 16.03 Overtime will be offered first to all regular employees before being offered to temporary employees. 16.04 The Company shall endeavour to spread overtime equitably among all shifts. 16.05 Any employee covered by this Agreement working on the second (2nd) shift (between 11:30 am and midnight) shall receive an hourly shift straight-time wage differential of fifty cents ($.50) per hour for all hours worked on the shift. Any employee covered by this Agreement working on the third (3rd) shift, (between 6:30 p.m. and 6:30 a.m.) shall receive an hourly shift straight time differential of seventy-five ($.75) per hour for all hours worked on the shift. 16.06 Banked time may be offered, in excess conjunction with Voluntary Time off, Vacation and Floater requests, during certain periods of the year (i.e. holiday closures). a) Employees will work a specified number of overtime hours on a specified day and will bank all eligible overtime hours worked at a rate of time and one-half to be used on the established day of low or no production. Alternatively, an employee may be pre-paid for hours not worked (i.e. Inventory period) and agree to work a specified number of eligible overtime hours at a rate of time and one-half, on a specified day to pay back hours already paid. To be eligible for overtime hours, an employee must work or be paid for forty (40) hours in any one (1) weekthe week that the banked time is scheduled. b. Overtime Pay. 8.5.1 Overtime hours The City and the Union agree to the following: 10.1 In the event that the need for overtime should occur in the Fire Rescue Department overtime shall be paid at the rate of one-and-one-half (1-1/2) times the “regular rate of pay” for hours worked above the one-hundred and forty-four (144) hours worked for that twenty-one (21) day work period. The “regular rate of pay” is defined in accordance with the Fair Labor Standards Act (FLSA) as follows: all remuneration for hours worked by the firefighter divided by the total number of hours worked during the twenty-one (21) day work period. 29 U.S.C 207(a), 29 CFR §778.109 and all other relevant U.S. Department of Labor regulations. In determining the “regular rate of pay” for the overtime calculation, the total remuneration for the twenty-one (21) day work period is determined by: calculating the base hourly rate of pay (as set out in Appendix A) times the hours worked, and then adding all incentive pays (as set out in Article 24) and any State Supplemental Pay for that twenty-one (21) day period. For each twenty-one (21) day work period: incentive pay is determined by calculating annual incentive pay and dividing by 17.38 pay periods per year, and State Supplemental Pay is determined by calculating annual State Supplemental Pay and dividing by 17.38 pay periods per year. 29 CFR §778.0 to §778.603 and 29 CFR §553.1 to §553.233. All hours worked and paid are initially paid at the base hourly rate (as set out in Appendix A). After the end of each twenty-one (21) day work period, when any overtime hours are determined, the additional overtime pay (additional one-half the regular rate of pay) for hours worked over 144 hours in the twenty-one (21) day work period will be paid using the “regular rate of pay” as defined by the FLSA and as set out above. 10.2 When an employee receives sick leave pay that employee shall not be permitted to obtain overtime work from the overtime list until after a subsequent twenty-one (21) day work period has started, but that employee is required to work overtime in the twenty-one (21) day work period when they have received sick pay if directed by the Fire Chief or designee. 10.3 Overtime is caused when one or more of these four conditions are not met: a. Hours worked a) All in-service vehicles must be staffed with a company officer or acting company officer. The Battalion Chief or acting Battalion Chief may also assign other shift members to act as a company officer on a rescue vehicle. There must be two promoted company officers on duty working in excess the capacity of eight company officer per shift, not including the Stand-Alone Captain. b) One Driver/Engineer on duty working in that capacity. c) At no time shall less than three (8) 3) crew members be scheduled on an apparatus for a shift. In the event a scheduled employee calls out sick, needs to leave, sustains an injury, is re-assigned, or due to any other reason not planned for, the apparatus may remain or be placed in service with two signed off paramedics until a replacement is available. All efforts will be exhausted prior to the unit running with less than three (3) crew members. d) In the event that a Battalion Chief assigned to a 24-hour shift is on leave AND overtime is required to meet minimum staffing requirements, the vacancy shall be filled, to achieve minimum staffing requirements. Except as specified in this article, current overtime assignment practices will continue to the extent that circumstances are the same. If an employee accepts an overtime assignment for less than twelve (12) hours, then they shall not lose their position on the overtime list. Employees who were not contacted will not lose their positions on the list. 10.4 Except for mutuals, personnel shall not be scheduled for more than thirty-six hours (36) of continuous on-duty status, unless the Fire Chief or designee specifically approves. 10.5 A member may work up to 48 hours of continuous on-duty status in any one day order to prevent a forced overtime with approval from fire administration. 10.6 The Union is responsible for maintaining accurate overtime rosters for: Company Officer, Driver/Engineer, Firefighter, and Fire Inspector, until Telestaff, Executime or other City timekeeping system is operational. 10.7 Overtime assignments will be made on a position for position basis, i.e. the same rank or those on the promotional list or those on the acting list for the rank which caused the need for the overtime. 10.8 Non-shift employees shall be compensated at one-and-a-half times their “regular rate of pay” as defined by the FLSA for hours worked (or where paid leave, except sick leave, is granted by the City) in excess of forty (40) hours in any one (1) weekduring the workweek. Paid sick leave shall count as hours worked for purposes of calculating overtime. b. For 11.1 All Fire Rescue Department employees covered by the terms of this Agreement who are called back to work alternative work schedules, hours worked in excess after the completion of employee’s regularly scheduled shift. For example, when an employee works four their regular shift will receive a minimum of three (4) days at ten (103) hours a day, an eleventh hour worked would be an overtime hour. c. Hours worked on any declared District employee holiday, legal holiday, Saturday or Sunday. d. Those unit members who voluntarily elect a workweek other than Monday through Friday shall be ineligible for the provision of Section 8.5.1c only for the time they hold the noncall-standard workweek. Section 8.5.1c shall reapply to them if they were to return to a Monday-Friday workweek by transfer or promotion. e. Before implementing a program which uses the above exemption, the District agrees to consult with the Union. 8.5.2 Overtime must be approved or ordered in advance by the appropriate supervisor. 8.5.3 Overtime pay/compensatory time shall be computed back pay at the following rates: a. Hours worked in excess of regular forty (40) hour work week and hours worked on Saturday -- time one and one-half employee's (1-1/2) times their regular rate of pay. b. Hours worked 11.2 Reporting to work early or being held over after a work shift e.g. being required to work for a period of time which is outside the normal shift but contiguous to the normal shift, is not a call- back and is not subject to call-back pay. However, an employee will not be entitled to call-back pay if they are ordered to work before or after their scheduled shift if the employee is already in or at the Fire Station or work location at the time the employee is ordered to work. 11.3 When the Department provides at least seven (7) days advance notice, employees who are scheduled to work outside of a regularly scheduled work shift shall not be entitled to any call- back pay, and will be paid for the hours worked, as appropriate. Article 11.1 will be applicable to Fire Rescue Department employees for approved, after hours community risk reduction activities after all efforts are exhausted to schedule such activities during business hours. 11.4 Off-duty employees who are requested to appear by or on Sunday -- two behalf of the City for inquiries, investigations, or any other type of meeting as a result of actions taken or observations made while on duty, shall be paid a minimum of three (3) hours at one and one half (1-1/2) times employee's their regular rate of pay, provided that the appropriate chief officer is notified prior to the employee’s appearance. c. Hours worked 12.1 The normal work week for the term of this contract shall be no more than an average of forty-eight (48) hours. 12.2 Employees regularly scheduled to work a 24-hour shift shall do so, commencing at 0800 hours, with 48 hours of regularly scheduled time off after the completion of each shift. Those serving in the capacity of acting battalion chief may be required to work a schedule commencing at 7:30 a.m. 12.3 The normal work week for personnel not assigned to a forty-eight (48) hour work week shall be forty (40) hours. 12.4 Except for mutuals, personnel shall not be scheduled for more than thirty-six hours (or thirty-nine hours based on holiday -- regular operational need) of continuous on-duty status, unless the Fire Chief or his designee specifically approves. 12.5 The City will endeavor to provide as much notice as is reasonably possible prior to implementing a change in shift or a change from shift to a 40-hour work week. 12.6 Members of the bargaining unit, whose normal work week is 48 hours and who are temporarily assigned by the Chief to a 40-hour work week to accomplish an operational need of the department (except light duty or remediation) which is outside of their shift and is for a period of time in excess of 40 hours will receive an additional 5% pay over their base rate of pay for the holiday plus double duration of the operational assignment. 13.1 Except as otherwise set forth below, when an employee is assigned to work in a higher classification, they shall be paid an additional one dollar and eighty cents ($1.80) per hour for the higher classification. 13.2 Members who are on current lists for positions of Driver, Lieutenant and Captain shall work out of title in those positions, as assigned. The Battalion Chief or acting Battalion Chief may also assign other shift members to act as a company officer on a rescue vehicle to meet operational needs. 13.3 Personnel not on a promotional list may be assigned to work out of title when an on-duty employee takes unscheduled leave. 13.4 An acting Battalion Chief is the Lieutenant or Captain assigned on a temporary basis to coordinate and oversee the operation of the shift for the period assigned. An employee assigned as an acting Battalion Chief will receive additional compensation as outlined in 13.1. 13.5 An acting Fire Marshal is the Assistant Fire Marshal assigned on a temporary basis to coordinate and oversee the community risk reduction responsibilities for the period assigned. The Assistant Fire Marshal assigned as an acting Fire Marshal will receive additional compensation as outlines in 13.1. 14.1 Personnel assigned to a 48-hour work week covered by this Contract shall accrue paid vacation time as follows: (a) 0 - 60 months employment: 12 hours for each completed month of service. (b) 61 - 120 months employment: 16 hours for each completed month of service. (c) Over 120 months employment: 18 hours for each completed month of service. (d) Over 240 months employment: 20 hours for each completed month of service. 14.2 Personnel assigned to a 40-hour work week shall accrue paid vacation time for such periods as follows: (a) 0 - 60 months of employment: 8 hours for each completed month of service. (b) 61 - 120 months of employment: 10 hours for each completed month of service. (c) Over 120 months of employment: 12 hours for each completed month of service. (d) Over 240 months employment: 14 hours for each completed month of service. 14.3 Vacation leave may be accumulated but not in excess of 500 hours. Vacation leave in excess of the above amount shall be forfeited at the end of the calendar year. 14.4 Any employee who is separated from the service (resignation, death, retirement including entering DROP, or discharge) shall be compensated in cash up to 400 hours of accrued and unused vacation time at their rate of pay which is set out in Appendix A at the time of separation, provided they has been approved for benefits by the City Manager. 14.5 Schedules for vacation shall be subject to the approval of the Fire Chief or their designee and shall be based upon the needs of the Department. 14.6 Personnel assigned to a 48-hour work week shall take a minimum of 96 hours of scheduled vacation leave each calendar year after the first year of employment. Failure to take vacation leave of 96 hours shall result in the unused balance (i.e. the difference between the 96 hours minus the actual hours used) of vacation leave being forfeited at the end of the calendar year, unless the Fire Chief allows some carry over for exceptional reasons and upon conditions designated by the Fire Chief. 14.7 All vacation leave or compensatory leave for employees who are scheduled to work 48- hour work weeks must be taken in blocks of 12 hours, commencing either at 0800 hours or 2000 hours, or in 24-hour blocks, commencing at 0800 hours. Vacation and compensatory leave may be approved in 4-hour blocks at the end of the requesting employee’s prior shift only if leave slots are available for the next shift. All vacation and compensatory leave for employees who are scheduled to work a 40-hour workweek must be taken in half-hour increments. 14.8 Requests for vacation or compensatory leave in blocks of 4 hours or 6 hours for educational purposes may be granted, with the pre-approval of the Fire Chief or designee. 14.9 If two or more members independently agree to any mutual exchange agreement, it must be in one-hour blocks, subject to prior approval by the Battalion Chief. Mutual exchanges shall be permitted on a position for position basis, i.e. the same rank and between employees who are eligible and approved to work in the same capacity. Mutual exchanges shall not incur any costs to the City. A member shall only utilize a maximum of two (2) mutual exchanges in a 24-hour shift. 15.1 All employees covered by this Contract, that are assigned to a 48-hour work week when a holiday occurs, shall receive, in addition to their regular pay, eleven (11) hours pay at their rate for each of the following holidays: All employees on a 40-hour work week, covered by this Agreement, shall receive each holiday as a paid day off. 15.2 All employees covered by this Contract shall be allowed twenty-four (24) hours of personal leave accumulated at the conclusion of the first full pay period in October of each fiscal year. Personal leave must be scheduled and approved in advance, except for emergencies. Such leave must be taken in the fiscal year which it is awarded. Failure to take this personal leave within the specified time frame shall result in forfeiture of same. 15.3 All accrued holiday pay as of December 1st of each year will be paid in one (1) lump sum to all hours actually worked shift personnel on the first pay day in December, or December 10th, whichever comes later. 15.4 All employees who are scheduled to work during a holiday, and who incur any unscheduled leave shall not be entitled to holiday pay for that holiday. 8.5.4 Unit members have 16.1 The City shall provide group health insurance for its regular full-time employees, covered by this Agreement, subject to the following conditions: The City may establish, change, supplement and implement the City health insurance program, including but not limited to changes in the Company, benefits, and all costs related thereto. The only exception to the foregoing sentence is that if the City exercises its right to accept implement any such changes, it will provide reasonable notice and discuss with the Union the explanation of changes and reasons therefore. The City agrees that it will continue as in the past to include the Union in the selection process for any insurance coverage contemplated by this Article. 16.2 Retirees may continue to participate under the medical insurance program provided by the City, subject to City requirements including paying the full insurance premiums for medical insurance coverage. 16.3 In the event a member is killed in the line of duty or reject overtime work compensated by either overtime pay or compensatory is injured when acting within the course of employment, in accordance with F.S. 440.091 and 440.16, the City will compensate the member and/or the surviving spouse and dependent children in accordance with F.S. 112.191. 17.1 Sick leave time off (CTO) offered will be earned at the discretion rate of the immediate supervisor. 8.5.5 Based on mutual agreement between the employee and the immediate supervisor, CTO will be taken within twelve (12) months hours for each month of service based on a forty-eight (48) hour work week. (There will be no limit to the amount of sick leave days accumulated.) Sick leave shall be granted for the following reasons: A. Personal illness or physical incapacity to such an extent as to be rendered thereby unable to perform the duties of their position. B. Attendance upon members of the date earnedfamily within the household of the employee whose illness requires the care of such employee. C. Enforced quarantine when established by the Department of Health or other competent authority for the period of such quarantine. 17.2 An employee who is absent from work due to an illness or disability may be required to submit a physician's statement of physical illness. When deemed necessary, the Fire Chief/designee may require proof of any illness. 17.3 Any employee of the bargaining unit who uses no sick time in any one of the four (4) quarters in the fiscal year will receive six (6) additional hours of vacation leave for each quarter in which no sick leave is used, as defined below: October 1 to December 31; January 1 to March 31; April 1 to June 30; July 1 to September 30. In these cases, if requested by the employee’s regularly scheduled shift, the Employer will make a reasonable effort to schedule the employee for another day off with pay and, if none is scheduled, then the employee will be paid for the day plus double time. 4. For example, when Lists of overtime worked shall be posted weekly. The Employer agrees to equal distribution of overtime within classifications and within departments to the extent this is equitable and practicable. A record of actual overtime hours worked by an employee works four (4) days at ten (10) hours a day, an eleventh hour worked would be an overtime hour. c. Hours worked on any declared District employee holiday, legal holiday, Saturday or Sunday. d. Those unit members who voluntarily elect a workweek other than Monday through Friday shall be ineligible for maintained and made available to the provision of Section 8.5.1c only for the time they hold the non-standard workweekUnion representatives. Section 8.5.1c shall reapply to them if they were to return to a Monday-Friday workweek by transfer or promotion. e. Before implementing a program which uses the above exemption, the District agrees to consult Employees who decline overtime will be credited with the Union. 8.5.2 Overtime must be approved or ordered in advance by the appropriate supervisor. 8.5.3 Overtime pay/compensatory time shall be computed at the following rates: a. Hours worked in excess of regular forty (40) hour work week and actual hours worked on Saturday -- time and one-half employee's rate the assignment for purposes of pay. b. Hours equitable distribution (e.g., an employee refusing an OT assignment of four hours will be credited as having worked on Sunday -- two times employee's rate of pay. c. Hours worked on holiday -- regular pay for the holiday plus double time for all four OT hours actually worked on the holidayweekly list. 8.5.4 Unit members have the right to accept or reject overtime work compensated by either overtime pay or compensatory time off (CTO) offered at the discretion of the immediate supervisor. 8.5.5 Based on mutual agreement between the employee and the immediate supervisor, CTO will be taken within twelve (12) months of the date earned. If the appropriate supervisor does not approve the use of CTO within twelve (12) months of its accrual, the unit member shall be paid overtime. 8.5.6 The immediate supervisor will make every effort to provide the opportunity for unit members to use compensatory time as earned, (i.e., four (4) hours worked equals six (6) hours off at one time, not to be fragmented). 8.5.7 Unit members shall elect whether overtime work shall be compensated by overtime pay or compensating time off. If the member elects overtime pay, such pay shall be paid within thirty (30) days of the work.
