When a firefighter leaves the City’s employment, the balance of his comp time will be paid to him. Section 7. Overtime Pay. Section 1A. In determining an employee’s eligibility for overtime pay, all paid status time shall be considered as time actually worked. This process shall continue until such time as the offer of overtime is accepted by an employee within the department. 3. Should an employee on an approved leave become eligible for actual time spent at an identified overtime opportunity, then that employee shall be the first employee to be offered the next overtime rate opportunity which becomes available following his/her return to work. 4. Should the department be unable to contact an employee following the identification of an overtime need, then that employee shall be the first employee offered the next overtime opportunity which becomes available. 5. Notwithstanding the foregoing, there may be situations which require a department to offer an overtime opportunity to an employee other than the next eligible individual on that department’s seniority list (time e.g., an emergency situation), then the department shall advise the Human Resources and one-half)Employee Relations office of this matter within 72 hours of its occurrence. Section f) An employee regularly scheduled to work during the work week but works less than forty (40) hours because of an action taken by the Company (excepting disciplinary action) will be credited with forty (40) hours worked in the computation of overtime rate in the period Monday through Saturday. Section g) Paid holiday and sick hours shall be counted in the computing of the forty (time 40) hours worked per week required for overtime pay. Section h) Whenever possible, any employee, when required to work overtime during the regular work week, must be notified by noon of that day, except when a breakdown in operations occurs, and one-half)if an employee is required to work on Saturday, he must be notified no later than the end of his regular shift on Thursday. Section i) When overtime is required at the beginning or the end of a regular work shift or on Saturdays, employees who regularly perform such work operations during the regular work shift shall be given preference of overtime work assignments insofar as practical. Section j) The Company will make every effort to achieve equalization of overtime within a classification and department in accordance with seniority on a rotating basis. Section k) The Company and the Union realize that overtime work may be required in order to assure an orderly flow of production and to meet sales commitments. To this end, the Union and its members agree that the employees covered by this Agreement will perform such overtime work as it is required and as requested. Should an employee refuse to work overtime, in absence of a compelling reason, he or she may be subject to disciplinary action. Section l) Any incorrect assignments of overtime or violations of the provisions of this Article will be resolved by the aggrieved party being offered the next opportunity to work available overtime rather than direct payment of any type.

Overtime Pay. Section 1: It is the policy of the CITY to keep to an absolute minimum the necessity for any HPOA Member to work in excess of his regularly scheduled tour of duty. Call in extreme need: Maintenance employees on this list will be called only in the event that the lists developed from numbers 1 and 2 (above) are exhausted, or conditions are such that snow removal cannot be performed in any other manner, on a seniority-rotating basis. B. The District shall maintain records of overtime calls which the Union shall be paid for actual time spent able to review at reasonable times. C. For purposes of this agreement the following shall not constitute overtime rate subject to the above procedures: 1. Snow removal work performed by Motor Equipment Operators if it occurs during their regularly scheduled shift; 2. Snow removal overtime work which requires a special motor vehicle license (time and one-halfi.e,, Class III), need not be offered to any individual not holding such a license.
