PARTIAL EXEMPTION Clause Samples
A Partial Exemption clause defines circumstances under which a party is excused from fulfilling certain obligations under a contract, but not all of them. Typically, this clause specifies which duties or liabilities are exempted and under what conditions, such as when performance becomes impossible due to specific events or regulatory changes. Its core practical function is to provide flexibility and fairness by allowing limited relief from contractual responsibilities without voiding the entire agreement, thereby addressing situations where strict enforcement would be unreasonable or impractical.
PARTIAL EXEMPTION. Where a Salaried Employee is paid in accordance with clause 3.2.1 (c) of this Agreement they will be excluded from the following provisions of this Agreement: Clause Number Clause Title
3.2.1 (a) Wages
PARTIAL EXEMPTION. Salaried employees or commission-based employees who are in receipt of a weekly wage equal to or greater than an Employee Level 6 shall be exempt from the provisions of clause 4.1 and 4.2.
PARTIAL EXEMPTION. 1.12.1 Employees in receipt of $19.19 per hour or greater for Full Time or Part Time Employees and $23.60 per hour or greater for Casual Employees, shall be exempt from Part 4 of this Agreement. All other terms and provisions of this Agreement shall apply.
PARTIAL EXEMPTION. 1.12.1 As an alternative to being subject to all the Agreement provisions a Full time or Part Time Employee in receipt of a gross income in excess of $44,040.10 pa gross or part thereof meaning in excess of $22.28 per hour for a Part Time Employee, shall be exempt from Part 4 (Hours of Work) of this Agreement.
1.12.2 Provided that all leave accrued under Part 5 of this agreement will be calculated and accrued on the basis of a 38 hour week on the rate paid to the Employee regardless of the hours worked by that Employee. (eg, the maximum annual leave per completed year of service under this clause shall be 152 hours and the maximum sick leave per completed year of service shall be 76 hours).
PARTIAL EXEMPTION. Any Employee who is in receipt of a rate of $18.00 per hour worked (equivalent to $35,568.00 gross per annum) or greater shall be exempt from Part 4 of this Agreement, all other Parts shall apply in accordance with this Agreement.
PARTIAL EXEMPTION. 1.12.1 Any Employee who is in receipt of a rate equivalent to $35,568 or greater gross earnings per annum shall be exempt from Part 4 of this Agreement, all other Parts shall apply in accordance with this Agreement.
PARTIAL EXEMPTION. Provided that where a full-time Employee is being paid a salary equivalent to or more than 25% in excess of the adult wage rate for a similar class of employee within this Agreement the Employee will be excluded from the provisions of this Agreement except for the following provisions of the Agreement: Clause 2.1 Contract of Employment Clause 2.2 Redundancy
PARTIAL EXEMPTION. Any employee covered by this agreement who is a salaried employee is exempted from the following provisions:— • clause 3.4; • Part 4; and • paragraph 5.2(8)(b)11.
PARTIAL EXEMPTION. The leasing company is deemed to be involved in making one supply, that of leasing services which is taxable. Partial exemption rules do not apply to the industry. Therefore, the lessor is entitled to claim the full input tax incurred on leased as well as non-leased assets and other business expenses.
PARTIAL EXEMPTION. 2.1 As an alternative to being subject to all Agreement clauses, a full time Employee remunerated in excess of the highest classification level prescribed in this Schedule, may mutually agree in writing with the College not to be bound by Agreement provisions regarding: • Hours of work; • Breaks; • Time in lieu; • Shift work; and • Weekend work.
2.2 A copy of the terms of the agreement will be supplied to the Employee.
2.3 The overall terms and conditions of an agreement under this clause must not be less favourable than the Agreement.
2.4 The College or an Employee may withdraw from an agreement made under this clause by giving the other party one month’s written notice.
