Priority consideration. A. Employees are entitled to priority consideration when reconstruction of a promotion action shows that, but for an error, e.g., incorrect qualification determination, failure to consider, improper rating, failure to follow required competitive procedures, the employee would have appeared on a promotion certificate. The employee shall be entitled to one bona fide consideration for the type of position affected by the error (same grade, same type of position, same promotion potential).
B. A priority consideration certificate shall be forwarded to the selecting official prior to the issuance of a competitive certificate. If no priority consideration candidate is selected, the selecting official must provide a written job-related justification for the non-selection.
Priority consideration. A. For the purposes of this Article, a priority consideration is the genuine consideration for noncompetitive selection given to an employee as the result of a previous failure to properly consider the employee for selection because of procedural, regulatory, or program violations. Employees will receive one priority consideration for each instance of improper consideration. A priority consideration does not give the employee a right or guarantee to be selected for any vacancy.
B. The procedures for processing priority consideration(s) shall be:
1. An eligible employee will be notified in writing by the SPO of entitlement to each priority consideration. Such notice will advise the employee that if a vacancy is announced and the employee wishes to exercise his/her priority consideration, he/she should submit the necessary application to the SPO with a written request that he/she wishes priority consideration for the vacancy.
2. Priority consideration is to be exercised by the selecting official at the option of the employee for an appropriate vacancy(s). An appropriate vacancy is one for which the employee is interested, is eligible, and which leads to the same grade level of the vacancy for which proper consideration was not given.
3. Prior to the referral of eligible candidates to the selecting official, the name(s) of the employee(s) requesting to exercise priority consideration will be referred to the selecting official. The selecting official will make a determination on the request prior to evaluating other candidates for the vacancy.
4. An employee's election to exercise a priority consideration does not preclude that employee from also filing an application as specified in the vacancy announcement.
5. In order to ensure compliance with this Section, the Union will be furnished statistics on priority considerations granted, exercised, and the results. Statistics will be kept and provided to the Union on a quarterly basis. The Union will also be notified in writing of each individual priority consideration completed.
Priority consideration. Status provided to a unit member who is in excess or who is assigned to a school that is going to be closed per Section 12.1.3. A unit member with priority consideration is ensured an interview and shall be selected for a vacancy regardless of seniority, unless there is an overriding issue of qualifications based on objective criteria as established in the posting. It is assumed that a unit member who exercises priority consideration status to obtain an assignment accepts the educational philosophy of the school/program. Priority consideration expires upon the placement of the unit member in a position or by September 1, whichever comes first.
Priority consideration. If the Contract Amount is $200,000 or more, Contractor shall give priority consideration in filling vacancies in positions funded by this Agreement to qualified recipients of aid under Welfare and Institutions Code section 11200 in accordance with PCC 10353.
Priority consideration. An employee who has received formal notice of separation from employment resulting from a pending layoff in accordance with Section 29.01 of this Article may elect to have his/her name forwarded for Priority Consideration for any County vacancy for which s/he meets the Minimum Qualifications. The names of qualifying employees will be sent to the Department Head of any department that has a vacancy as soon as possible, but no later than five working days after the Human Resources Department is notified by the department of the vacancy. The Department Head with the vacancy is not required to select anyone from the Priority Consideration list; however, they are required to interview all employees whose names are submitted to them before making a final decision on filling the vacancy. If the Department Head would still prefer to consider applicants from a Merit List, s/he may do so without rejecting from consideration anyone on the layoff list until a final selection is made for the vacant position. Employees who want to participate in this Priority Consideration program must submit a request in writing to the Human Resources Department and complete a current application (with resume if they wish) with the position title left blank. The Human Resources Department will have authority, only under this program, to copy the employee's application, fill in the position title, and forward it to the Department Head for consideration. The employee's right to participate in this program will terminate on the effective date/time of his/her layoff and separation from County employment. Employees who transfer to another department in accordance with this program are subject to the terms and conditions of a transfer as set forth in Sections 27.07 Probationary Period Upon Transfer and Article 28 Transfers, Reassignments, and Promotional Opportunity of this Agreement.
Priority consideration. Contractor shall give priority consideration in filling vacancies in positions funded by this Agreement to qualified recipients of aid under Welfare and Institutions Code, section 11200 in accordance with Public Contract Code, section 10353.
Priority consideration. Summer school may be offered and if offered Adult Education Community Education teachers teaching in the Adult Education Community Education Program during the preceding regular school year will be given priority consideration for employment during summer school.
Priority consideration. Employees who have been downgraded without personal cause and not at their own request while serving under a career or career-conditional appointment (or one of equivalent tenure) shall be entitled to priority referral for noncompetitive consideration for permanent promotion prior to a vacancy being filled by competitive promotion under Article 12. Such employees shall be entitled to priority referral and consideration only to vacancies for which the downgraded employee is highly qualified up to the grade level or the equivalent level of the position from which downgraded. Highly qualified repromotion eligibles will be determined by the appropriate progression level as identified in the applicable Promotion Plan Template.
Priority consideration. Priority consideration will be given to those qualified candidates who have entitlement to consideration under other regulatory requirements. These include employees affected by reduction-in-force or transfer of function in accordance with their eligibility and/or rights under the DOD Priority Placement Program, registrants in the OPM Interagency Career Transition Assistance Program (ICTAP), employees receiving priority consideration under EEO procedures, employees denied proper consideration because of an error or program violation, employees transferred or detailed to international organizations, individuals in the military service who have reemployment rights, DOD overseas returnees, and recovered disability annuitants and injury compensationers.
Priority consideration. Status provided to a unit member who meets minimum qualifications for the position, and for whom the District believes there is an adequate job fit for the position and environment. Priority consideration shall insure the unit member the position following an interview whenever the District determines the unit member is an adequate job fit for the position and environment.
