Project Site Conditions. ‌ 3.3.1 The physical and the ambient conditions including climatic, hydrological, hydro geological, ecological, environmental, geotechnical, geological, paleontological and archaeological conditions of the Project Site (the “Project Site Conditions”) shall be the sole responsibility of the Concessionaire. Accordingly, without limiting any other obligations of the Concessionaire that are included in the Project Deliverables, the Concessionaire shall be deemed as at the Signature Date to have: (i) carried out an investigation of all Project Site Conditions and of any extraneous material in or under the Project Site including its surface, sub-soil and groundwater to enable the Facilities to be designed and constructed and the Works to be carried out with due regard for the Project Site Conditions and the seismic activity (if any) in the region of the Project Site; (ii) for the purpose of such investigation in Section 3.4.1(i), inspect and examine the Project Site and surroundings; (iii) satisfied itself as to the nature of the Project Site Conditions, the surface, sub-soil and ground water of the Project Site, the form and nature of the Project Site, the load-bearing and other relevant properties of the Project Site, the risk of damage to property affecting the Project Site, the nature of the materials (whether natural or otherwise) to be excavated and the nature of the design, works and material necessary for the execution of the Works; (iv) satisfied itself as to the adequacy of its right of passage over, access to and through the Project Site and any accommodation it may require for the purposes of fulfilling any of its obligations included in the Project Deliverables, such as any additional land or buildings located outside the Project Site; (v) satisfied itself as to the possibility of interference by persons with rights- of-way across, access to or use of the Project Site with particular regard to the owners and users of any land adjacent to the Project Site; and (vi) satisfied itself as to the precautions, times and methods of working necessary to prevent or minimize nuisance or interference being caused to any third parties. 3.3.2 To avoid doubt, the Concessionaire accepts full responsibility for all matters in Section 3.4.1 and the Concessionaire shall:

The Contractor shall take all necessary precautions to prevent discharge water from washing onto paved streets at East Golden Gate. The discharge water shall be neutralized if it has been acidized or chlorinated. Sodium thyosulfate is an approved neutralizing chemical. The site must be kept well- maintained and clean throughout the project due to the public locations.

Project Site Conditions. The Builder is not responsible for environmental conditions that already exist at the Project site, such as contaminated soils, radon, existing lead paint, asbestos, PCBs, or mold, or the effect of weather conditions at the Project Site, including, but not limited to, wind, rain snow, frost, storm water and wetland flooding or other similar events. If Project site and/or weather conditions are encountered that interfere with the construction of the Work, Customer agrees to pay as an extra to Builder the cost of additional third-party activities necessary to address them, including, but not limited to: correcting unstable, abnormal or non-bearing soil conditions; removal of existing field drain tiles, rocks, boulders, stones, trees or stumps; providing and trucking fill or cutting to grade; furnace hook up, haying of footings and foundation, frost breaking and snow removal; additional footings, reinforcing, piers, additional depth of foundation walls to reach bearing ground, waterproofing or diversion of water and water pumping; concrete pumping; and any related costs needed to make the Project Site ready to properly receive the Work. Builder will be entitled to a Change Order and, if applicable, extension of time to complete the Work for existing site conditions resulting in an increased cost or Construction Delay, and Builder will provide notice to Customer of such costs or delay pursuant to Section 10. Unless otherwise provided in this Contract, Customer will not receive a deductive Change Order for the value of any excess soil removed from the Project Site. Builder will not remove, store or replace topsoil or other surface objects existing at the Project Site, unless expressly included in the Plans and Specifications or the Site Allowances.

Project Site Conditions. Developer shall have the sole responsibility of satisfying itself concerning the nature and location of Construction Work and the general and local conditions applicable to the land, including, without limitation, with respect to the following: (i) those affecting transportation, access, disposal, handling and storage of materials;

Project Site Conditions. The County shall disclose to Contractor any conditions at Project Sites that the County is aware of that may adversely affect the Work to be performed by Contractor. Contractor shall promptly inform the County of any issues it discovers when conducting due diligence at Project Sites which may adversely impact the Work or the Project Schedule.

Project Site Conditions. The DBOM Contractor shall make all further soil test borings and conduct analyses of subsurface conditions, inspections and applicable site history reviews of the Project Site (including those required by Section 6.2 (Project Site Suitability Confirmation)) and in each case as reasonably necessary under Good Engineering and Construction Practice to prepare for excavation and construction hereunder in accordance with Applicable Law.
