REINSTATEMENT AFTER RESIGNATION Clause Samples
The "Reinstatement After Resignation" clause outlines the conditions under which an individual who has previously resigned from a position may be rehired or reinstated to their former role. Typically, this clause specifies any waiting periods, eligibility requirements, or limitations on reinstatement, such as whether the individual must reapply or if certain benefits or seniority are restored upon return. Its core practical function is to provide clear guidelines for both the employer and former employee regarding the process and implications of returning to work after resignation, thereby reducing ambiguity and managing expectations.
