Returning to the Bargaining Unit. An Employee who accepts a position outside of the bargaining unit who subsequently returns to the bargaining unit, shall, upon the Employee’s return, be paid a monthly salary no less than the monthly salary the Employee would have been paid had the Employee remained in the bargaining unit, not including discretionary (i.e., merit) raises.
Returning to the Bargaining Unit. Employees who leave the bargaining unit, but maintain employment with the Employer, who then seek to re-enter the bargaining unit: 40.3.1. ▇▇▇▇▇ be placed in the salary schedule lane in accordance with their level of education and at the salary schedule step that they were at previously plus the additional years working with the Employer. 40.3.2. The employee’s seniority will be based on their years of employment with the 40.3.3. If the employee held non-provisional status when they left the bargaining unit shall maintain that status upon return to the bargaining unit.
Returning to the Bargaining Unit. A person who accepts a position with the Employer, but outside the bargaining unit shall have no rights under this Agreement. If the person is returned to the bargaining unit within ninety (90) calendar days, the employee's original bargaining unit seniority date will be restored. If the person is returned to the bargaining unit more than (90) calendar days after his/her movement out of the unit, they shall be placed at the bottom of the seniority list.
Returning to the Bargaining Unit. In the event the employee returns to the bargaining unit, the following shall apply: 1. The employee has the right to bump the least senior person in the same job classification he/she occupied prior to leaving the bargaining unit, providing that employee has less seniority than the returning employee. 2. Salary benefits shall be commensurate with the current contract.
Returning to the Bargaining Unit. (a) If an employee is a salaried position in the Protect Force Section (Plant Protection Department) returns to the bargaining unit within thirty (30) calendar days, he/shall be credited with total seniority accumulated before leaving the bargaining unit. (b) If an employee is medically disqualified from the Protective Force Section (Plant Protection Department) due to DOE requirements, then accepts a salary position in another LMUS Department, and later returns to the bargaining unit, he/she shall be credited with bargaining unit seniority accumulated before leaving the bargaining unit.
Returning to the Bargaining Unit. If a current bargaining unit member who has a continuing contract takes any management position and is non-renewed, that bargaining unit member will be able to return to the bargaining unit. No seniority is accrued during time in the management position. Upon return to a bargaining unit position, the employee would be placed at the step at which they left the bargaining unit position.

  • Work of the Bargaining Unit (a) In order to protect the standard of nursing care, the Employer shall not contract out the work normally performed by members of this bargaining unit except: i) For purposes of instruction, ii) In the event of an emergency situation, iii) When performing developmental or experimental work, or iv) When employees are not available due to an employee not reporting for work as scheduled or not being available for work. (b) Reassignment to other employees of work normally performed by members of the bargaining unit shall not result in the termination, layoff or reduction in hours of any member of the bargaining unit. (c) When it is decided to not fill a position following an employee’s resignation, the Home will provide the rationale in writing for this decision to the Union. The Union may request a meeting to make representations on this matter.
