Right to Reproduce Documentation. In accordance with 45 CFR 95.617(b), the State and the United States Department of health and Human Services shall have a royalty-free, non-exclusive and irrevocable license to reproduce, publish, or otherwise use and to authorize others to use for State or Federal government purposes, the copyright in any software, modifications and associated documentation developed, designed, or installed under the Contract.
Right to Reproduce Documentation. Subject to Section 10.2 of this Agreement, Distributor shall have the right to translate, reproduce and distribute any training and end‑user documentation provided by ABAXIS pursuant to this Agreement. If applicable, Distributor shall provide copies of certified English translations of such documentation to ABAXIS prior to any use in the Territory.
Right to Reproduce Documentation. The State and the United States Department of Health and Human Services shall have all rights required by 45 CFR 95.617. Equipment and Software Installation and Operation Installation for all equipment, software applications and interfaces will occur as described in the Master Work Plan. Any installations done by the Contractor or its designated agent shall be conducted by experienced and trained staff and shall not invalidate or void any manufacturers’ warranties. Installations shall not interfere with the execution of any other software components, application or interface. The Contractor shall conduct its installation services so as to minimize interference with normal activities of the Department and shall keep the site safe and clean at all times. The Contractor will restore the site to a condition no less finished than prior to the initiation of the installation. Upon completion of installation the Contractor will leave the site clean and free from all materials, tools and equipment not required after installation. The Contractor will be responsible for safety conditions in the areas of work performance that it controls. The Contractor shall have access to the system, in whole and in part, to provide services under the Contract, subject to the security regulations existing at the site and regulations that may be required because of the nature of the system. The Contractor shall continuously protect the system from damage, destruction, or loss caused by the acts or omissions of its staff, and shall protect the Department’s real and personal property from damage arising from the acts or omissions of its staff in connection with installation and operation of the system. The Contractor shall be responsible for any loss, destruction, or damage to the Department’s property, which results from or is caused by the Contractor’s acts or omissions. The Contractor shall deliver to the Department and maintain and replace documentation. This will include, as applicable, system documentation, user documentation, software development documentation and disaster recovery and back-up planning documentation. The documentation shall be provided in electronic and hardcopy form.

  • Right to Receive Documentation a. Periodic Statements. Transfers and withdrawals made through any ATM or POS terminal, debit card transactions, audio response transactions, preauthorized EFTs, online/PC transactions, mobile access device transactions or ▇▇▇▇ payments you make will be recorded on your periodic statement. The reports must be signed by the employee, approved by the appropriate official, and coincide with a pay period. These time records should be used to record the distribution of salary costs to the appropriate accounts no less frequently than quarterly. (iii) Formal agreements with independent contractors, such as consultants, must include a description of the services to be performed, the period of performance, the fee and method of payment, an itemization of travel and other costs which are chargeable to the agreement, and the signatures of both the contractor and an appropriate official of Grantee. (iv) If third party in-kind (non-cash) contributions are used for Grant purposes, the valuation of these contributions must be supported with adequate documentation.

  • Licensed Documentation If commercially available, Licensee shall have the option to require the Contractor to deliver, at Contractor’s expense: (i) one (1) hard copy and one (1) master electronic copy of the Documentation in a mutually agreeable format; (ii) based on hard copy instructions for access by downloading from the Internet

  • Right to Refuse Unsafe Work Employees have the right to refuse to perform unsafe work pursuant to the Occupational Health and Safety Regulations of the Workers Compensation Act.
