SCOPE & APPLICATION. This Agreement applies in the state of Victoria to:
a) the Company in respect to all of its employees engaged in building and construction work as defined by the Award.
b) Employees of the Company who are engaged in any of the occupations, callings or industries specified in the award.
c) The CFMEU.
d) Construction work in the cottage/housing industry shall not fall within the scope and application of this Agreement. For the purposes of this Agreement, cottage/housing industry means the construction, erection, assembly, maintenance ornamentation or demolition of a single occupancy dwelling, and multiple occupancy residential units being of not more than two living levels height.
SCOPE & APPLICATION. 5.1 This agreement shall apply in the state of Victoria to: • The company in respect to all of its employees engaged in mobile crane and associated work as defined by the Mobile Crane Hiring Award 2002. • Employees of the company who are engaged in any of the occupations, callings or industries specified in the award. • The CFMEU (Building Unions Division and FEDFA Division) Victorian Branch.
SCOPE & APPLICATION. This Agreement will apply to and be binding upon all Employees of the Company on the Snowy Hydro 2.0 Project other than employees engaged as detailed below. This Agreement will NOT apply to: Tunnel excavation works including the operation of, commissioning or decommissioning of TBM’s; Administrative, supervisory (beyond the level of a Leading Hand) or managerial personnel, engineers, technicians, surveyors, paramedics, nursing or medical support personnel or security personnel; Persons engaged by other contractors in transportation or deliveries including but not limited to personnel, material, and/or equipment to and from the Project; Persons engaged in transportation or deliveries including, but not limited to, material and/or equipment to and from the Project including specialist vehicles to transport Pre-cast concrete products from the precast facility to site; Personnel employed by any subcontractor, specialist contractor and/or supplier; Off-site work associated with the Project performed by subcontractors; Warranty defects liability, repairs and/or maintenance work performed by or on behalf of the manufactures and/or distributors of goods, material or equipment provided to the Project; Manufacturing or fabrication of materials or supplies, including but not limited to all work performed at manufacturing facilities regardless of location such as precast concrete segments, structural steel, reinforcement cages, batch plants and any other precast products and reinforcement fabrications; Commissioning and operations of the Project; Camp operation; Work not contained within the scope of the Project; All work conducted on the Project relating to utilities.
SCOPE & APPLICATION. 1.1 The terms in this Appendix form part of this Agreement where the Proposal indicates that development services (“Development Services”) are being delivered as part of the Supply.
1.2 Development Services includes, but is not limited to:
a. the development of a website(s) or web application;
b. the development of software for use on any platform;
c. the development of any service, tool, method or idea by Us.
SCOPE & APPLICATION.
Section 34.1 This Agreement constitutes the sole and entire existing agreement between the parties and completely and correctly expresses all of the rights and obligations of the parties. All prior agreements, conditions, past practices, customs, usages, and obligations are expressly and completely superseded and revoked insofar as any such prior agreement, condition, past practice, custom, usage, or obligation might have given rise to any enforceable right.

Section 34.4 Time is of the essence in this Agreement. Any time period or time limit included in this Agreement has been carefully considered and represents the agreed absolute outside limit of time within which the applicable action or right must be exercised.
Section 34.5 As used in this Agreement, the term “employee” (singular or plural) refers only to employees in the bargaining unit. The words “he,” “his,” and “him,” as used in this Agreement to denote employees are understood to include both male and female employees.
Section 34.6 This Agreement shall be construed in accordance with standard principles of contract interpretation, federal labor law, and the law of the State of Washington.

Progression for employees is subject to satisfactory performance.
3.3 All allowances previously paid, including but not limited to those allowances known as “conclusion/task”, “adverse weather”, “driver”, “additional property”, and additional payments relating to skills and levels of responsibility will cease to be paid after 23 September 2009.
3.4 Existing rounds/schedules and staffing levels will not be affected as a direct result of implementing Single Status.
SCOPE & APPLICATION. This Agreement will apply to and be binding upon work performed by Employee(s) of the Company who are engaged in the classifications set out in Appendix A and Appendix B, and are employed to perform the following works on the Project: • Works constructed using Roadheaders; • Excavation of the permanent Tunnel and Caverns by mechanical or other means; • Installation of permanent tunnel supports and lining (horizontal excavation); • Shaft excavation for the purpose of Tunnel Access. • Tunnel excavation ancillary services (for example, electricians, fitters, and any other mechanical and electrical trades, who are engaged in relation to supporting the tunnel excavation operation and tunnel support works). • Excavation of permanent tunnel and cross passages by mechanical or other means including Drill and Blast; • Installation of temporary and permanent tunnel supports and lining (horizontal excavation); • Tunnel excavation ancillary services (for example, electricians, fitters and any other mechanical and electrical trades, who are engaged in relation to supporting the tunnel excavation operation and tunnel support works). Construction of roadworks, earthworks, bridges, structures, service relocations, associated buildings, urban design and structures and traffic management, this includes: • Cut and cover, decline and dive structures (including permanent supports for tunnel portal (vertical excavation)); • Civil construction works underground (including ancillary civil works); • Excavation from above ground where not for the purpose of tunnel access (vertical excavation)); • Site facilities works conducted aboveground; • Invert preparations work for final concrete pavements including blow piping and blinding and dental concrete works; • Demobilisations of site compounds, back-filling temporary accesses, making good temporary works, maintaining temporary services (post tunnel excavation). This Agreement will NOT apply to: • Personnel carrying out work not covered by classifications contained in this agreement; • Administrative, supervisory or managerial personnel, engineers, technicians, surveyors, paramedics, nursing or medical support personnel; • Persons engaged in the transportation or deliveries including, but not limited to, material and or equipment to and from the Project; • Security personnel; • Persons engaged on site through arrangements with bona-fide subcontractors; • Personnel employed by any subcontractor, specialist contractor and/or supplier; •...
