Section 23.01. The Employer agrees that the Union may select representatives from the unit for assignment to committees.
Section 23.01. During the term of this Agreement, there shall be no lockouts, strikes, 18 slowdowns, or other concerted work stoppages.
Section 23.01. The Hospital will continue to make reasonable provisions for the safety of its employees. The Hospital will comply with all laws and regulations concerning the health and safety of employees working in Hospital owned or leased buildings.
Section 23.01. In event the Employer, in its sole discretion, decides to reduce the 25 number of personnel in any job classification, the employee in the job classification affected with 26 the least amount of job classification seniority shall be the first person laid off, provided the 27 Employer retains qualified employees to perform the remaining available work. In the event an 28 employee has more total bargaining unit seniority than an employee in an equal or lower paying 29 job classification, such employee may be allowed to replace that employee in the equal or lower 30 paying job classification at the lower rate of pay, provided that such more senior employee is 1 capable of performing the work in the equal or lower paying job classification.

The District will comply with WAC ▇▇▇-▇▇▇-▇▇▇ regarding communicating and 22 evaluating employee safety and health issues. Such concerns shall be addressed by the parties in labor 23 management meetings per Section 24.01. 24 25 * * * * * * * * * * * * 26 27 28 THIS AGREEMENT shall be in full force and effect from September 1, 2019 through August 31, 29 2022 and shall be reopened each year at the request of the union prior to June 1 to discuss Articles 17 30 and 18. THIS AGREEMENT shall be reopened to negotiation ninety (90) calendar days prior to the 31 anniversary date. 33 A year is defined as September 1 through August 31 of each year unless specifically addressed in an 34 Article or Section. 35 36 Savings Clause: Should any provision of this Agreement or any application of this Agreement to any 37 employee or group of employees be found contrary to law, then such provision or application shall not 38 be deemed valid and subsisting except to the extent permitted by law, but all other provisions or 39 applications shall continue in full force and effect. 40

  • Section 3.5 29 Neither the District, nor the Association, shall discriminate against any employee subject to this 30 Agreement on the basis of race, creed, color, sex, religion, age or marital status or because of a 31 disability with respect to a position, the duties of which may be performed efficiently by an individual 32 without danger to the health or safety of the disabled person or others.

  • Section 11.1 28 The District shall have the right to discipline or discharge an employee for justifiable cause. The issue 29 of justifiable cause shall be resolved in accordance with the grievance procedure hereinafter provided.

  • Section 2.2 17 The right to make reasonable rules and regulations shall be considered acknowledged functions of the 18 District. In making rules and regulations relating to personnel policies, procedures and practices, and 19 matters of working conditions, the District shall give due regard and consideration to the rights of the 20 Association and the employees and to the obligations imposed by this Agreement. 24 A R T I C L E I I I

  • Section 2.1 11 It is agreed that the customary and usual rights, powers, functions, and authority of management are 12 vested in management officials of the District. Included in these rights in accordance with and subject 13 to applicable laws, regulations, and the provisions of this Agreement, is the right to direct the work 14 force, the right to hire, promote, retain, transfer, and assign employees in positions; the right to 15 suspend, discharge, demote, or take other disciplinary action against employees; and the right to 16 release employees from duties because of lack of work or for other legitimate reasons. The District 17 shall retain the right to maintain efficiency of the District operation by determining the methods, the 18 means and the personnel by which operations undertaken by the employees in the unit are to be 19 conducted.

  • Section 3.4 26 Each employee reserves and retains the right to delegate any right or duty contained in this Agreement, 27 exclusive of compensation for services rendered, to appropriate officials of the Association.
