Section 7.8. Overtime defines the rules and conditions under which employees are eligible for overtime pay. Typically, this clause outlines the threshold of hours worked beyond the standard workweek that qualify as overtime, the applicable overtime pay rate (such as time-and-a-half), and any necessary approval procedures. Its core function is to ensure fair compensation for extra work and to provide clear guidelines for both employers and employees regarding overtime eligibility and payment, thereby reducing disputes and ensuring compliance with labor laws.

Overtime. 6 Overtime assignments shall be distributed by District seniority for Custodial, Grounds, Trades, and 7 Warehouse employees who are already at the job site and/or on the particular work project for which 8 overtime is being assigned. Child Nutrition Services and Paraeducators shall be assigned at the 9 building level by seniority. In the event no school building employees accept the overtime, employees 10 from other school buildings may be offered the overtime by classification seniority. In the assignment 11 of overtime, the District agrees to provide employees with as much notice as is practicable under the 12 circumstances. No overtime assignment will be made unless the employee is contacted directly.
Section 7.8. Overtime. 16 Normally, overtime assignments shall be distributed in accordance with the seniority provisions as 17 hereinafter provided. In the assignment of overtime, the District agrees to provide the employee with 18 as much advance notice as practicable in the circumstances. Normally, employees designated to work 19 overtime on days outside their regular workweek will be advised of the possibility no later than 20 twenty-four (24) hours prior to the end of the last shift before the overtime commences.

Employees designated to work overtime on days outside their regular 41 workweek will be advised of the possibility no later than twenty-four (24) hours prior to the end of the 42 last shift before the overtime commences. The provisions of this section shall not apply in the event of a 43 bona fide emergency or unforeseen condition over which the District has little or no control. 44

Section 7.8. Overtime. All compensated hours over forty (40) in one week will be paid at time and one-half (1½) the 9 employee’s hourly rate of pay. Holiday, vacation and other approved leave hours will be considered 10 hours worked for the purpose of the computation of overtime.

If no one in 27 the building volunteers for the overtime and the need for work is known greater than forty-eight (48) hours in 28 advance, it shall be offered on a District-wide seniority basis via email notification. If the need for the work is 29 known less than forty-eight (48) hours in advance, it shall be offered via telephone on a seniority basis to those 30 employees signing up on an “48-hour” overtime list. If no employee volunteers to work overtime hours, the 31 supervisor may offer the overtime work to a substitute employee, and if no substitute is available, then the 32 supervisor shall recall the employees on the “48-hour” overtime list. If no employee volunteers at this time, 33 assignment will be at the supervisor’s discretion.
Section 7.8. Overtime. 17 Extra and new additional hours of three (3) per day or less, and overtime, shall be distributed to 18 employees at the site or school in accordance with the seniority provisions set forth in this Agreement, 19 except in emergency situations or when the District determines that scheduling and/or program 20 delivery prohibits distribution of additional hours by this method. In the assignment of overtime, extra 21 and additional hours, the District agrees to provide the employee with as much advance notice as 22 possible in the circumstances. Normally, employees designated to work overtime on days outside their 23 regular work week will be advised of the possibility no later than twenty-four (24) hours prior to the 24 end of the last shift before the overtime commences. Overtime assignments must have the prior 25 approval of the supervisor. Overtime for Transportation Department personnel is covered in 26 Article XVIII.
Section 7.8. Overtime. 47 Overtime assignments shall be offered by seniority in the building, unless the overtime opportunity is 48 job specific.
