Section 9.7.3. 2 The employee will retain accrued sick leave, vested vacation rights, and seniority rights while 3 on leave of absence. However, vacation credits, sick leave, and seniority shall not accrue while 4 the employee is on leave of absence.

Section 9.7.3. 46 Vacated positions shall be posted within seven (7) calendar days unless the District informs the 47 Association in writing of its intent to dissolve the position or to vacate it for the duration of the 1 current school year. The District will provide one week of advance notice of its intent to modify the 2 FTE hours of any position, so as to solicit input from the Association as to impact. Offers of 3 employment shall be made to bargaining unit members through the Human Resources Department.

Section 9.7.3. 21 Employees who are laid off may retain retirement benefits in accordance with the rules of the 22 retirement system.

Section 9.7.3. 5 The FMLA leave may be taken: (a) because of the birth of a child and to care for a newborn child, 6 (b) because of the placement of a child with the employee for adoption or ▇▇▇▇▇▇ care, or (c) to care 7 for a child or a spouse or parent who has a serious health condition, or (d) because of the 8 employee's own serious health condition. If both parents of the child are employed by the District, 9 they together are entitled to a total of twelve (12) weeks of leave, and leave may be granted to only 10 one parent at a time.
