Site Restrictions. Developer hereby understands and agrees that the nature of the retail and entertainment components of the Project are critical to the approval of the public incentives offered by the UG and the State in connection with this Agreement. Further, Developer understands and agrees that the Project is required to be unique, including destination entertainment and retail users that are not currently available in the State. Accordingly, Developer hereby agrees as follows:
(a) During the Term (as defined in Section 7.1 below), no user of any kind for a retail or entertainment purpose within the District shall receive any direct benefit from STAR Bonds if such user has relocated from within the State.
(b) Additionally, Developer and the UG hereby agree that the following uses shall be prohibited within the Site:
(i) Any use which is offensive by reason of odor, fumes, dust, smoke, noise, or pollution, or which constitutes a nuisance or is hazardous by reason of fire or explosion, or injurious to the reputation of the Project. No oil, gasoline or flammable liquid shall be stored in bulk in greater than 55-gallon containers except in underground storage tanks.
(ii) Other than in connection with the existing C-Store in Project Area 2A, and the Go Car Wash in Project Area 2A, both of which are hereby expressly permitted, a gas station or car wash facility. However, the UG agrees that the foregoing restriction shall not apply to one (1) additional C-Store if it is a Quiktrip or Buc-ees (or upon UG approval, a first- class C-Store which is equivalent to or better than Quiktrip or Buc-ees in quality) and is located on State Avenue in Project Area 3 or Project Area 1.
(iii) A facility primarily used as a storage warehouse operation, mini-warehouse, or freight terminal; provided, however, that the foregoing restriction shall not in any way prohibit the operation of small warehouse or mini-warehouse if operated in connection with and ancillary to a permitted retail use.
(iv) A facility for the assembling, manufacturing, refining, or smelting (provided, however, this restriction shall not preclude the assembly of merchandise to be sold at a facility).
(v) Drilling, mining, exploring or the producing of oil, gases or other minerals.
(vi) Any use which involves the raising, breeding, keeping or selling of any animals or poultry except on a temporary basis, in which case such areas are to be cleaned and maintained by the owner of such portion of the Site so that it is not a nuisa...

D. He shall also protect his stored materials from theft or damage and arrange the materials for ready inventory to verify quantities listed on payment request.
E. The Contractor shall observe all ordinance, laws and regulations of all authorities having jurisdiction over the Construction operations.
Site Restrictions. Pursuant to Section 34 of the Lease, Landlord has agreed that Landlord shall develop a building on the Building 3 Site that is substantially of the same design as the buildings that constitute the initial Premises, including, without limitation, substantially the same amount of parking and substantially the same landscaping. In no event shall any building constructed on the Building 3 Site be greater than three (3) floors unless Tenant consents, which consent may be withheld by Tenant at its sole and absolute discretion.

Site Restrictions. Duke agrees that it will not place Coal Ash at the Site that was the by-product of generating electricity at a facility located outside of North Carolina. The Coal Ash placed at the Site by or on behalf of Duke will be of types consistent with “Coal combustion products” as such term is defined under the CAMA.

Contractor shall not permit any hazardous material or substance to be brought to or used on the site except to the extent such hazardous material or substance is necessary to and customarily used in the construction of projects like the Work.
