Site Safety and Security Measures. 5.8.1. The Licensee is required to make its own arrangement for firefighting which shall confirm to the IS Code of Practice/fire services norms of the State and all other applicable statutory bodies. 5.8.2. The Licensee shall comply with all safety regulations as applicable, in its design, access arrangements and operations on Project Site. 5.8.3. The Licensee shall be responsible at its cost, for procurement, transport, receiving, unloading and safe keeping of all plant and machinery, equipment, materials and other things required for the construction and operation and maintenance of the facilities. 5.8.4. Unless otherwise stated in this Agreement: a) The Licensee shall ensure not to allow any unauthorized person to enter into the Project Site except authorized person. b) The authorized persons during the construction phase shall be limited to the employees of the Licensee, employees of subcontractors of the Licensee, and employees and persons authorized by SSCL/Licensor. 5.8.5. Employees/staff of the Licensee shall not be deemed or construed to be the employees of SSCL/ Licensor. The Licensee undertakes that its employees/staff shall make no claim against the SSCL/Licensor for any reason whatsoever, throughout the License Period. Further, the Licensee also agrees that the SSCL/Licensor shall not be liable for any accident/injury or claims of the workers/employees employed by it or by its contractor/sub- contractors during the execution of the development works, under this Agreement, throughout the License Period. 5.8.6. If during the License Period, any loss of property and/or loss of life takes place, the Licensee is only responsible for the same and liable for payment of damages/compensation etc. and SSCL/Licensor shall not be liable for any such claims. The Licensee would be responsible including the payments arising out of any third-party claims. The Licensee is advised to procure necessary insurance for meeting such liabilities at its own cost and a copy of the same shall be submitted to the Licensor for verification. 5.8.7. The Licensee shall be solely liable for the above-mentioned obligations/responsibilities. In case any liability, on account of the Licensee’s failure to comply with the above, falls on SSCL/Licensor, the Licensee shall fully indemnify SSCL/Licensor and holds the Licensor indemnified against non-compliance of any such obligations/loss/damages etc. 5.8.8. Site Safety and Security Measures. (i) The Lessee is required to introduce and observe at all times, appropriate measures for safety, security and orderliness on the Project Site. (ii) The Lessee is required to make its own arrangement for fire fighting which shall confirm to the IS Code of Practice / Delhi Fire Services norms and all other applicable statutory bodies. (iii) The Lessee shall comply with all safety regulations applicable, in its design, access arrangements and operations on Project Site. During construction period of the Project, the Lessee shall be responsible for the operation of machinery and any other work and shall take all precautions to ensure safety of the staff, laborers and public. (iv) The Lessee shall be responsible at its cost, for procurement, transport, receiving, unloading and safe keeping of all plant and machinery, equipment, materials and other things required for the construction and operation and maintenance of the facilities. (v) Unless otherwise stated in this Agreement: (a) The Lessee shall be responsible for keeping unauthorized persons off the Project Site, during the construction period. (b) Authorized persons during the construction phase shall be limited to the employees of the Lessee, employees of subcontractors of the Lessee, and employees and persons authorised by DMRC. (vi) Employees/staff of the Lessee shall not be deemed or construed to be the employees of DMRC. The Lessee understands and undertakes that its employees/staff shall make no claim against the DMRC for any reason whatsoever, throughout the lease period. Further, the Lessee also agrees that the DMRC shall not be liable for any accident/injury or claims of the workers/employees during the execution of the development works, under this Agreement, throughout the lease period of 30 (Thirty) years. (vii) If during the lease period, any loss of property and/or life takes place, the loss and account of the same shall be borne entirely by the Lesseeand DMRC shall not be liable for any such claims. The Lesseewould be responsible for the payments arising out of any third party claims. The Lesseeis advised to procure insurance for meeting such liabilities at its own cost. (viii) The list of banned activity which may cause fire hazard and affect safety of station and stabling yard are enclosed under Annexure-13 of RFP and Schedule H of this Agreement. The storage and trade of goods & material mentioned under Schedule-G shall not be allowed.

The Licensee shall be responsible at its cost, for procurement, transport, receiving, unloading and safe keeping of all plant and machinery, equipment, materials and other things required for the construction and operation and maintenance of the facilities. v. Unless otherwise stated in this Agreement: (a). The Licensee shall ensure not to allow any unauthorized person to enter into the Project Site except authorized person.

  • Safety Measures Awarded vendor shall take all reasonable precautions for the safety of employees on the worksite, and shall erect and properly maintain all necessary safeguards for protection of workers and the public. Awarded vendor shall post warning signs against all hazards created by the operation and work in progress. Proper precautions shall be taken pursuant to state law and standard practices to protect workers, general public and existing structures from injury or damage.

  • Safety and Security Procedures Contractor shall maintain and enforce, at the Contractor Work Locations, industry-standard safety and physical security policies and procedures. While at each JBE Work Location, Contractor shall comply with the safety and security policies and procedures in effect at such JBE Work Location.

  • Health, Safety and Security 14.1 The Employer recognizes a responsibility to provide an environment intended to protect the health, safety and security of Members as they carry out their responsibilities. To that end, the Employer agrees: (a) to maintain a Joint Health and Safety Committee (the JHSC) with broad representation drawn from all sectors of the University, including at least one (1) person appointed by the Association; (b) to cooperate with the Association in making every reasonable provision for the safety, health and security of Members; (c) to take reasonable measures to maintain the security of the buildings and grounds while at the same time maintaining reasonable access for Members who have a need for such access at times other than during regular working hours; (d) to ensure that the Association has the right to appoint at least one (1) person to any representative committee whose terms of reference specifically include the health, safety or security of Members as they carry out their responsibilities; (e) to comply with the Occupational Health and Safety Act, R.S.O. 1990, and relevant regulations thereto, as amended from time to time (the “Act”); (f) that Members may refuse unsafe work pursuant to and in accordance with the relevant provisions of the Act for so doing; (g) that Members report any known or potential dangers to their ▇▇▇▇; (h) In addition, the Employer agrees: i) to provide Members with health and safety training, personal protective equipment, and access to health and safety programs, policies and procedures; ii) to provide resources for the JHSC; iii) to compensate a CASBU Member who is eligible to be, and serves as, the person appointed by the Association to the JHSC when that service is outside the period of the Member’s contract; iv) to provide training for the person appointed by the Association to the JHSC directly related to their duties and responsibilities in connection with the JHSC; v) to recognize a JHSC Member’s right to be present during workplace safety testing and audits and receive written copies of any reports and recommendations from the testing/audits and a copy of a draft report if one is provided to the Employer; vi) to recognize a JHSC Member’s right to have advance notice when advance notice is given by the Ministry of Labour of any Ministry of Labour inspection and to accompany a Ministry of Labour Inspector during an inspection and receive a copy of any report produced by the inspector. 14.2 The parties agree that all personal communications must adhere to the Personal Harassment and Discrimination Policy and the Nipissing University Acceptable Use Policy. Effective June 10, 2006, universities are subject to the Freedom of Information and Protection of Privacy Act (FIPPA). All records in the custody and control of the University will be subject to FIPPA with exceptions as defined by the Act. Persons may request and have a right to access University information or records. A record is defined under the Act as any record of information however recorded, whether in printed or electronic form, film, or otherwise and includes drafts, post-it notes, margin notes, hard drive files, emails, voice mails, electronic agendas, address books, and recording devices. 14.3 Unless required under FIPPA, and for the purposes of this Article, files are documents under a Member’s control and stored on University property, either in paper or electronic form. Such files do not include the Member’s official file in the ▇▇▇▇’▇ office nor the Personnel File of the Member in the Human Resources office. 14.4 On termination of a Member’s employment for any reason other than cause, the Employer will permit, by appointment only, accompanied access for a period of fifteen (15) working days (or longer with the agreement of the ▇▇▇▇) by the former Member or the Member’s executors to the Member’s files, whether in paper or electronic format. The purpose of the allowed access is for transferring required documents to other faculty, the Chair, or the ▇▇▇▇. Where files are not required to support continued student academic needs or ongoing operational requirements, the former Member or designate may remove or destroy their personal files. Items that are clearly of a personal nature or are owned by the former Member such as furniture, pictures, books, etc., may be removed at this time.

  • Safety and Security Contractor is responsible for maintaining safety in the performance of this Agreement. Contractor shall be responsible to ascertain from the District the rules and regulations pertaining to safety, security, and driving on school grounds, particularly when children are present.

  • Security Measures Lessee hereby acknowledges that the rental payable to Lessor hereunder does not include the cost of guard service or other security measures, and that Lessor shall have no obligation whatsoever to provide same. Lessee assumes all responsibility for the protection of the Premises, Lessee, its agents and invitees and their property from the acts of third parties.
