The Suitable Duties clause defines the types of work or tasks an employee may be assigned if they are unable to perform their usual duties, often due to injury or illness. In practice, this clause allows an employer to temporarily modify an employee’s role, such as assigning lighter tasks or alternative responsibilities that match the employee’s current capabilities. Its core function is to facilitate a safe and structured return to work, ensuring the employee remains productive while accommodating their health needs and supporting workplace rehabilitation.
Suitable Duties. 20.2.1 Suitable duties are duties (which may also be described as a role or position) which an excess employee could reasonably be expected to perform to a reasonable standard, within a reasonable period of time and with a reasonable level of training, education and/or other support. 20.2.2 Unless the employee agrees, or requests otherwise, duties which require some a variation to the excess employee’s full time or part time hours of work per week will not be considered to be suitable.
Suitable Duties. 1.13.2.1 Suitable duties are duties (which may also be described as a role or position) which an excess employee could reasonably be expected to perform to a reasonable standard, within a reasonable period of time and with a reasonable level of training, education and/or other support. 1.13.2.2 Unless the employee agrees, or requests otherwise, duties which require some a variation to the excess employee’s full time or part time hours of work per week will not be considered to be suitable. 1.13.2.3 Consideration for assignment of an excess employee to suitable duties will include the following: i. due consideration to the employee’s personal circumstances; ii. the distance from home to the workplace(s) (providing every effort is made so as not to require relocation of the employee’s household); iii. any potential variation to existing starting and finishing times. 1.13.2.4 While the transfer of an excess employee to suitable duties does not require the agreement of the employee, every effort will be made to assign an excess employee to suitable duties by agreement. 1.13.2.5 A suitable role, duties or position may be at a lower classification/remuneration level than an employee’s current substantive classification level, providing the classification does not provide a salary of less than 75% of the employee’s substantive salary. Transfer of excess employees to duties, roles or positions with a lower classification/remuneration level should only be considered when other options provided for in the Public Sector Act and this Appendix have been exhausted.
Suitable Duties. 14.13.2.1 The duties to which an excess employee may be redeployed will only be considered suitable (unless the employee otherwise agrees) where: i. The hours of work remain the same or similar; ii. It is a reasonable distance/location from the employee’s residence to the new place of employment; iii. There is a reasonable expectation that the excess employee will be able to perform the duties to a reasonable standard, within a reasonable period of time and with a reasonable level of training, education and/or other support; and iv. There are no extenuating factors specific to the employee/worksite that would make it unreasonable for the employee to perform the ongoing permanent role. 14.13.2.2 As a minimum, the assessment of suitability will require the excess employee’s completed Support and Training Needs Assessment Template (incorporating transferable skills, knowledge and attributes) to be matched against a proper skills analysis/breakdown of the particular vacancy, and a considered deficit assessment and support, training and education bridging plan developed; all of which are required to be provided to the excess employee. Only then can these tests of reasonableness be made by the case manager, in consultation with excess employee, and the vacancy manager. 14.13.2.3 Excess employees are to be made aware that, while every effort will be made to secure duties with which they agree, they can be required to accept other duties, where the above assessment of suitability has been completed. 14.13.2.4 In that context, assignment of excess employees to duties with a lower classification/remuneration level is only to be considered when other options provided for in the Public ▇▇▇▇▇▇ ▇▇▇ ▇▇▇▇ and this clause have been exhausted.   • Position; Duties (a) The Executive shall serve as the President of the Company under this Agreement during the Employment Term. As President of the Company, the Executive shall have such duties, authorities and responsibilities commensurate with the duties, authorities and responsibilities of persons in similar capacities in similarly sized companies and such other duties and responsibilities as the CEO of Kaman or the Company’s Board of Directors (the “Sub Board”) shall designate that are consistent with the Executive’s position as President of the Company. (b) During the Employment Term, the Executive shall use the Executive’s best reasonable efforts to perform faithfully and efficiently the duties and responsibilities assigned to the Executive hereunder (including applicable obligations under state law) and devote substantially all of the Executive’s business time (excluding periods of vacation and other approved leaves of absence) to the performance of the Executive’s duties with the Company, provided the foregoing shall not prevent the Executive from (i) participating in charitable, civic, educational, professional, community or industry affairs or, with prior written approval of the Sub Board, serving on the board of directors or advisory boards of other companies; and (ii) managing the Executive’s and the Executive’s family’s personal investments so long as such activities do not materially interfere with the performance of the Executive’s duties hereunder or create a potential business conflict or the appearance thereof. If at any time service on any board of directors or advisory board would, in the good faith judgment of the Sub Board, conflict with the Executive’s fiduciary duty to the Company or create any appearance thereof, the Executive shall promptly resign from such other board of directors or advisory board after written notice of the conflict is received from the Sub Board. (c) The Executive further agrees to serve without additional compensation as an officer and director of any of the Company’s subsidiaries and agrees that any amounts received from any such corporation may be offset against the amounts due hereunder.

  • Certain Duties and Responsibilities The duties and responsibilities of the Trustee shall be as provided by the Trust Indenture Act. Notwithstanding the foregoing, no provision of this Indenture shall require the Trustee to expend or risk its own funds or otherwise incur any financial liability in the performance of any of its duties hereunder, or in the exercise of any of its rights or powers, if it shall have reasonable grounds for believing that repayment of such funds or adequate indemnity against such risk or liability is not reasonably assured to it. Whether or not therein expressly so provided, every provision of this Indenture relating to the conduct or affecting the liability of or affording protection to the Trustee shall be subject to the provisions of this Section.

  • Duties of Custodian WITH RESPECT TO THE BOOKS OF ACCOUNT AND CALCULATION OF NET ASSET VALUE AND NET INCOME The Custodian shall cooperate with and supply necessary information to the entity or entities appointed by the applicable Board to keep the books of account of each Portfolio and/or compute the net asset value per Share of the outstanding Shares or, if directed in writing to do so by the Fund on behalf of such Portfolio(s), shall itself keep such books of account and/or compute such net asset value per Share. If so directed, the Custodian shall also calculate daily the net income of each applicable Portfolio as described in the Prospectus and shall advise such Portfolio and the Transfer Agent daily of the total amounts of such net income and, if instructed in writing by an officer of the Fund on behalf of such Portfolio to do so, shall advise the Transfer Agent periodically of the division of such net income among its various components. Each Fund acknowledges and agrees that, with respect to investments maintained with the Underlying Transfer Agent, the Underlying Transfer Agent is the sole source of information on the number of shares of a fund held by it on behalf of a Portfolio and that the Custodian has the right to rely on holdings information furnished by the Underlying Transfer Agent to the Custodian in performing its duties under this Agreement, including, without limitation, the duties set forth in this Section 9 and in Section 10 hereof; provided, however, that the Custodian shall be obligated to reconcile information as to purchases and sales of Underlying Shares contained in trade instructions and confirmations received by the Custodian and to report promptly any discrepancies to the Underlying Transfer Agent. The calculations of the net asset value per Share and the daily income of each Portfolio shall be made at the time or times described from time to time in the Prospectus.
