TERM CONTRACTS. Except as otherwise provided herein, prices must remain firm for the entire contract period, including any periods of extension or renewal. At the time of any renewal or extension of the contract, the city or the selected Bidder may request a price adjustment based upon the economy. All requests for a price adjustment must include detailed documentation and rationale to support the requested adjustment. The party to whom a request for price adjustment is made may, in its sole discretion, accept or reject the request. Any price adjustment must be mutually agreed upon in writing by the Parties, and shall be effective for the applicable renewal term.
TERM CONTRACTS. 1. The Board shall appoint teachers to term contracts only when they are filling a specific position of one (1) month or more not to exceed one (1) year, where the position is temporarily existing or is vacant due to a teacher being on leave of absence.
2. The Board agrees to notify the Union of any positions temporarily existing which the Board will be filling. Notification shall be given to the Union prior to the filling of the position. The Superintendent or their designate shall, upon request, meet with the Union to discuss the nature and circumstances of the temporarily existing position.
3. a. Term contract teachers shall be granted full-time continuing contracts of employment not later than upon the completion of fifteen (15) months aggregate service in the employment of the Board.
TERM CONTRACTS. In certain circumstances we need to employ people for a specified period of time. You will only be employed on a term contract in the following situations: To ensure there is visibility of the use of term contracts, a regular monitoring process will be resolved between the parties, including scope to include the City of Newcastle Consultative Committee.
TERM CONTRACTS. A term contract means a contract providing for employment throughout a semester with a workload of fifty percent or greater of the normal full-time load. A term contract may be for either part-time or full-time employment, will be for a definite term not to exceed one (1) fiscal year, and will terminate automatically at the end of the term. Such contracts are renewable solely at the discretion of the Board. Reasons for the issuance of term contracts may include, but are not limited to, the following: funding by grants or special projects outside the Board's legislative appropriation, temporary replacement of a faculty unit member on educational or other leave of absence, a temporary manpower need created for the interim of a job search, for an unanticipated increased workload, or for a vacancy within a school term where it is more appropriate to fill the position temporarily. If a faculty unit member's contract is changed to a probationary contract, the number of years the faculty unit member has served under term contracts may be credited, at the discretion of the Board, towards fulfillment of the period necessary for consideration for a continuing contract. Term contracts will not be used to avoid the proper application and use of probationary or continuing contracts. Faculty unit members with term contracts will be evaluated at least once per year and informed of any deficiencies. Evaluations and plans to correct deficiencies will be conducted in accordance with Article XI, Evaluation.
TERM CONTRACTS. (i) The employer may only employ a person on a term contract of employment in the following situations:
a) for the life of a specific task or project that has a definable work activity, or
b) to perform the duties associated with an externally funded position where the length of the employment depends on the length of the funding, or
c) to perform the duties associated with a vacant position until the vacant position is filled on a permanent basis, provided that the duration is not longer than is reasonably necessary to undertake recruitment for the vacant position, or
d) to temporarily replace an employee who is on approved leave, secondment, workers compensation, or acting in a different position or working reduced hours under a flexible work and leave arrangement, or
e) to undertake training and work as part of an apprenticeship, traineeship or student work experience program in conjunction with an education institution, or
f) to trial a new work area, provided that the duration is not longer than is reasonably necessary to trial the new work area, or
g) to perform the duties associated with a vacant position during the intervening period between when the employer has made a definite decision to introduce major changes in production, program, organisation structure or technology that are likely to have significant effects on the employment in the vacant position and the date that the changes are implemented; or
h) to accommodate time limitations imposed by law or sought by the employee (e.g. visa restrictions); or
i) to perform seasonal work (also see subclause 21E(xi) of this Agreement).
(ii) Notwithstanding the above, all term contracts of employment entered into prior to 1 November 2010 may continue until the expiry of their fixed or maximum term.
TERM CONTRACTS. 36.1 The provisions of the Award shall apply.
TERM CONTRACTS. PURCHASING DEPARTMENT CITY OF LINCOLN/LANCASTER COUNTY, NEBRASKA
TERM CONTRACTS. A term contract may be either part-time or full-time and will be of a definite term not to exceed one year or overlap two (2) fiscal years, unless the contract is for a spring-summer or a summer- fall appointment or is otherwise approved by the Board. A term contract will terminate automatically at the end of the term, unless the Board expressly renews the contract. Reasonable effort will be made to notify such faculty unit members, more than thirty (30) days prior to the end of their term, that they will have no further term appointment contract. Failure to so notify will not result in the extension of the appointment. As used in this agreement, “consecutive full-time contracts” include any combination of contracts for nine or more months, so long as no more than five months lapse between the end date of one contract and the start date of a subsequent contract. The parties recognize that faculty unit members who have received several consecutive full- time contracts will come subjectively to expect continued employment on the same basis. Under this agreement, in the absence of an award of tenure, such unilateral expectations, however natural they may be, can never become constitutionally protected property interests.
TERM CONTRACTS. Faculty Members both on full and part-time appointments not eligible for tenure will be offered multi-year contracts under the following conditions:
1. The Faculty Member has been appointed to the same bargaining unit position for five (5) consecutive years; or
2. Where a multi-year Limited Term Contract would serve the mutual needs of the Employer and the Faculty Member. Limited Term Contracts shall be for three (3) years, with the expiration term of the contract rolling forward one (1) year at the end of each year of the three (3) year term.5 A Limited Term Contract may be terminated prior to its expiration, provided that the Faculty Member is given at least four (4) months’ notice, and all other temporary contracts of shorter duration in the individual’s Program, Division, or Department have been given prior notice of termination. Limited Term Contracts for a period of one (1) year up to three (3) years shall be offered to Lecturers who have taught for at least eight (8) semesters over a seven (7) year period in the same unit.
TERM CONTRACTS. (i) Council may employ a person on a term contract in an ongoing position that is evaluated as Professional/Specialist Band 3, Level 4 or the Executive Band 4 of the agreement only where:
(a) Council and the employee agree, and
(b) where the contract includes a clause that a further term contract for the position shall be offered to the employee if the employee’s performance remains at a satisfactory level during the term of the contract and the position continues to exist at the end of the term of the contract, and
(c) the term of the contract is a minimum of three years and a maximum of five years.
(ii) This clause only regulates the use of term contracts for ongoing positions.
(iii) Term contracts shall not be offered for on-going positions below Band 3 Level 4 of the
