Transfer to a Vacant Position. 1. When a vacancy arises the specifications of said vacancy will be posted internally within the Division/Unit/Section for a period of ten (10) working days and interested bargaining unit employees within the same Division/Unit/Section and of the same classification as the vacancy will be permitted to submit a request to transfer to said vacancy to their immediate supervisor. 2. Upon completion of the ten (10) working day posting, the Sheriff or his designee will review all requests for transfer. 3. The Sheriff or his designee in his sole discretion reserves the right to “pass over” the most senior bargaining unit employee requesting the transfer, and to select any other qualified bargaining unit employee for legitimate operational reasons including but not limited to skills, knowledge and experience. 4. Transfer to a Vacant Position. Where alternative measures cannot be agreed upon, or will not prevent the layoff of employees, the employee about to be laid off shall have the opportunity to be transferred to a vacant position that the Employer wishes to fill at the same, higher or lower classification level, providing the employee meets the essential requirements of the position as specified in the Job Description. Candidates will be assessed against each of the essential requirements as specified in the Job Description by one or more of the following: Resume, references, interview questions, written or other tests. Such vacant position shall not be posted, as provided for in Article 15 (Selection Process) of this Agreement. The employee transferred into a higher band would go to the step in that band closest to, but not lower than their current salary. The employee transferred into a lower band would go to the step in that band closest to, but not higher than their current salary. An employee transferred in this way will be the subject of a trial period of four (4) weeks. In the event the employee proves unsatisfactory in the position during the trial period or is unable to perform duties of the position she/he will re‐enter the layoff process at Step IV.

  • Vacant Positions An employee on the reinstatement roster may bid on a vacant position in a different classification in the same manner as any other regular employee pursuant to this agreement.

  • Filling Vacant Positions During the time the procedures outlined herein are in effect, position vacancies to be filled shall first be offered to regular employees who have a contractual right to be recalled to a position in the involved job classification or who may have a right to “bump” or transfer to the position, as the case may be. In such circumstances, the seniority provisions of the Agreement shall be observed. If no regular employee has a contractual right to the position, the following shall be given consideration in the order (priority) indicated below: 1st Priority: Qualified Job Bank employees 2nd Priority: Employees on a recall list 3rd Priority: Employee applicants from a list of eligibles 4th Priority: Displaced certified temporary employees 5th Priority: Non-employee applicants from a list of eligibles The qualifications of an employee in the Job Bank or on a recall list shall be reviewed to determine whether they meet the qualifications for a vacant position. Whether the employee can be trained for a position within a reasonable time (not to exceed three months) shall be considered when determining the qualifications of an employee. If it is determined that the employee does not meet the qualifications for a vacant position, the employee may appeal to the Director of Human Resources. If it is determined that an employee in the Job Bank is qualified for a vacant position, the employee shall be selected. The appointing authority may appeal the issue of whether the employee is qualified. The dispute shall be presented to and resolved by the Job Bank Steering Committee. If it is determined that an employee on a recall list is qualified for a vacant position, the employee will be given priority consideration and may be selected. Appeals regarding employees on a recall list and their qualifications for a position will be handled by the Civil Service Commission. The grievance procedure under the Labor Agreement shall not apply to determinations as to qualifications of the employee for a vacant position.

  • Transfer to a safe job (a) Where an employee is pregnant and, in the opinion of a registered medical practitioner, illness or risks arising out of the pregnancy or hazards connected with the work assigned to the employee make it inadvisable for the employee to continue at her present work, the employee will, if the employer deems it practicable, be transferred to a safe job at the rate and on the conditions attaching to that job until the commencement of maternity leave. (b) If the transfer to a safe job is not practicable, the employee may elect, or the employer may require the employee to commence parental leave for such period as is certified necessary by a registered medical practitioner.
