Transfers Outside the Bargaining Unit. Any Employee who transfers to a position outside the bargaining unit shall have their existing bargaining unit seniority frozen effective the day they leave the bargaining unit, and will cease to continue to accumulate bargaining unit seniority while working outside the bargaining unit. An Employee transferred back to the bargaining unit pursuant to this Section will be placed in the classification to which he was assigned at the time he left the bargaining unit, provided he has the seniority to hold the classification. He will first be placed on an open job in the classification and if there is no open job, he will displace the least senior Employee provided he is capable of performing the available work. The parties agree that there are certain positions outside the bargaining unit which are privy to confidential employee and business information, which would make it inappropriate for that person to return to the bargaining unit. Where loss of previous bargaining unit seniority is a condition of a promotional opportunity, this will be clearly identified in the Job Posting.

An employee transferred by the Company to a position outside the Bargaining Unit shall maintain their seniority for a period of up to twelve (12) months for the purpose of transferring back into the Bargaining Unit. Transfers Outside the Bargaining Unit. When a bargaining unit employee is promoted or transfers to a job with the Employer outside the bargaining unit, the employee shall cease to accrue seniority but shall retain the seniority he/she accumulated up to but not beyond the date he/she left the bargaining unit. Only former bargaining unit members who are employed in positions outside the bargaining unit on or before July 31, 2009, will retain seniority within the bargaining unit.
Transfers Outside the Bargaining Unit. Employees shall not be transferred to positions outside the bargaining unit without their consent. If employees are transferred to positions outside of the bargaining unit, they shall retain their seniority acquired at the date of leaving the unit, but will not accumulate any further seniority. Employees will retain their seniority for a maximum of three (3) years from the date of their transfer outside the bargaining unit. Employees who later return to the unit shall be placed in jobs commensurate with their competency and seniority. Such return will not result in the lay-off or bumping of any employee within the bargaining unit.
Transfers Outside the Bargaining Unit. 11.01 If an employee who has acquired seniority status is or has been transferred to an occupation not covered by this Agreement, or to a supervisory position, he/she shall continue to accrue seniority for a period of one (1) year. If an employee is subsequently transferred back to an occupation covered by this Agreement he/she shall retain his/her prior seniority plus the time (up to one (1) year) spent outside the bargaining unit and continue to accrue seniority thereafter.

Any bargaining unit employee, who is appointed by the City to a position outside of the bargaining unit, shall continue to accrue seniority for a period of one (1) year after the date of appointment to a non-bargaining unit position. It is understood that seniority retention as referred to in #1 above shall apply strictly for the purpose of returning to the bargaining unit. In the event that a non-bargaining unit employee and the City mutually agree to revert, the following conditions shall apply:
(a) the employee shall be reverted to a vacant position not below his previous rank for which he/she is eligible to hold by right of seniority. In no circumstances shall an employee be bumped from an appointed position.
(b) the employee shall have the required qualifications to hold the assigned rank.
(c) the employee shall assume all terms and conditions of employment including benefits and entitlements under the Collective Agreement according to accrued seniority.
(d) the reversion shall not result in the layoff, demotion or displacement of any bargaining unit employee. It is understood that the provisions set forth above shall also apply to all non-bargaining unit employees existing as of the date of signature to this agreement. It is further understood the City and the Association may amend the provisions set forth above by mutual agreement based on the circumstances of each case.
Transfers Outside the Bargaining Unit. When a bargaining unit employee is promoted or transferred by the Employer to a supervisory or other job with the Employer outside the bargaining unit, such employee shall not continue to accumulate seniority for a period of six (6) months after said promotion or transfer. If, during said six (6) month period, the employee is removed from such supervisory or other job with the Employer for any reason other than discharge for reasons considered valid under this Agreement, such employee shall be allowed to exercise his seniority to return to a job within the bargaining unit, assuming said job is intended to be filled by the Employer, and he has the then present ability to satisfactorily perform all such job requirements, and seniority permitting. If an employee is removed after six (6) months, he shall have no right to return to the unit.
Transfers Outside the Bargaining Unit. Employees shall only be transferred to a position outside the bargaining unit with his/her consent. If an employee is transferred or successfully posts to a temporary position outside the bargaining unit, the employee shall retain his/her seniority acquired at the date of leaving the unit, and for a further period of eighteen (18) months, after which the employee will not accumulate any further seniority unless agreed upon by mutual consent of the parties. If such employee later returns to the bargaining unit, he/she shall be placed in a job for which that employee possesses the required knowledge, education, qualifications, abilities and skills consistent with his/her seniority. Such return shall not result in the layoff or bumping of an employee holding greater seniority.
Transfers Outside the Bargaining Unit. No employee shall be transferred to a position outside the bargaining unit without his/her consent. If an employee accepts a temporary position outside the bargaining unit, the employee shall retain his/her seniority acquired at the date of leaving the unit for a period of twenty-four (24) months, after which time the employee will no longer have seniority within the bargaining unit. The employee shall have the right to return to their former position. If their former position no longer exists, the employee retains their right to displace as per Article 10.
