A Variation Orders clause defines the process by which changes to the original scope of work in a contract can be formally requested, approved, and implemented. VARIATION ORDERS. 4.1 Either Party may, prior to the Delivery or completion of Services and subject to the limitations set out in Clause 4.3, request variations in the originally agreed scope of supply. Such Party shall make a request for a variation by written notice to the other Party with an exact description of the variation requested.
4.2 The Supplier shall, without undue delay, after receipt of a request for a variation or after having himself proposed a variation inform the Buyer in writing whether and how the variation can be carried out stating the effects of the variation on the Contract Price, the estimated time for Delivery or completion of the Services and other terms of the Contract. The Supplier shall also give such notice when variations are required by reason of changes in laws and regulations.
4.3 The Supplier is not obliged to carry out variations before the Parties have agreed on how the variation will affect the Contract Price, the time for Delivery or completion of the Services and other terms of the Contract, including issuance a of payment security for the increased price. For the avoidance of doubt, if the Supplier for any reason carries out the requested variation before the Parties have agreed its effects, such performance is deemed to have been made in good faith and shall constitute neither a waiver of any of Supplier’s rights nor Supplier’s acceptance of Buyer’s requests.
VARIATION ORDERS. 9.2.1 Add the following sentence to 9.
2.1 The Contractor must give immediate notice to the Engineer of any direction received from any representative of the Principal (or, where the Principal is the Ministry of Education, any representative of the School). The Contractor shall not be obliged to comply with any such instruction unless confirmed in writing by the Engineer. The Contractor will not be entitled to any adjustment to the Contract Price or the Due Date for Completion unless and to the extent the Engineer issues an order in writing instructing a Variation.
VARIATION ORDERS. 18.1 In cases where the estimated value of the envisaged changes in purchase does not vary more than 15% of the total value of the original contract, the contractor may be instructed to deliver the goods or render the services as such. In cases of measurable quantities, the contractor may be approached to reduce the unit price, and such offers may be accepted provided that there is no escalation in price.
VARIATION ORDERS. If, between order date and the completion of the work, variations occur as a consequence of your requirements or any change in legislation or technical regulations, then the price and / or delivery date shall be adjusted to provide for these variations. No Order shall be varied and/or altered and/or amended, unless you notify us in writing of the variation and/or additional work required. As soon as reasonably possible after having received such notification, we will advise you of the effect the requested amendment will have on the contract price and delivery dates. We will not commence work in terms of any such variation notification until the revised terms of the Order have been agreed to in writing and signed by the parties.
VARIATION ORDERS. From time to time it may be necessary to amend an Order Form due to Service requirements changing. Under such circumstances the change will be presented to the Client that lays out the changes in the following areas:
i. Scope of Service
ii. Explanation of why the change is being undertaken
iii. Integration with other aspects of Service, considering the Client, the Supplier and third parties. In the event that the Client manages the third parties then the Client is responsible for ensuring that the third party is in agreement with the change iv. Technical design (if applicable)
VARIATION ORDERS. We can by written notice instruct you to make any variations to the Services or Order. You must notify us in writing within (14) days of receipt of our variation order of the impact on the timing of the Services and pricing of the Order. You must not commence work in terms of any such variation order until the revised terms of Order have been agreed in writing by us. Any work done on a variation order without our written consent will be done at your risk and expense. If after (14) days of date of our variation order, you have not notified us of the impact of such variation on the Order, you will be deemed to have accepted the variation without impact on the timing of the Services and contract price and you will not have any claim against us in respect thereof.
VARIATION ORDERS. 7.1 The Buyer may initiate changes by issuing to the Seller written notices that alter, add to, or deduct from the goods or services, but that are otherwise subject to the terms of the Contract. The Seller will promptly comply with the terms of any such variation order.
VARIATION ORDERS. The Contractor shall not make any such variation without an instruction of LOST in writing. For the purpose of this Clause, any increase or decrease in the quantities of any work executed in accordance with the Contract with respect to quantities shown in the Bill of Quantities shall not require the issuance of a Variation Order.
VARIATION ORDERS. If the Contractor or the Employer requests a Variation Order, then and in that instance:
10.1 The Contractor or the Employer must prepare a Variation Order request form and submit same to the other party;
10.2 The Variation Order request form must be reviewed and evaluated by the other party for approval;
VARIATION ORDERS. 9.1 Buyer may give, or Norwegian Oilfield Supply AS may request, a variation order (hereinafter called “Variation Order”) specifying increases or reductions in scope, character, quality, kind or performance of the Delivery or any part of these, as well as changes in delivery time, provided that these variations are within what could reasonably have been expected by the parties when the Agreement was entered into.
