Should a bargaining unit member be required to perform work during a lunch period, the bargaining unit member shall be paid the appropriate portion of his/her hourly wage rate for all such work during the lunch period or his/her schedule will be adjusted by an amount of time equal to that worked. D. Bargaining unit members who work in the Food Service classification for three (3) or more hours a day shall be entitled to a duty-free unpaid thirty (30) minute lunch period. The lunch period will be established by the Food Service Director or designee to coincide with the bargaining unit member's work schedule. E. A bargaining unit member who works four (4) or more consecutive hours shall be entitled to one (1) fifteen

At least five (5) working days prior to the start of school in any year, bargaining unit members shall receive written notice of the hours they are scheduled to work. Should a bargaining unit member be required to perform work during a lunch period, the bargaining unit member shall be paid the appropriate portion of his/her hourly wage rate for all such work during the lunch period period, or his/her the schedule will be adjusted by an amount of time equal to that worked. D. . Break periods will be established by the bargaining unit member's immediate supervisor. Part-time bargaining unit members who work between three (3) and five (5) hours a day may take a fifteen (15) minute break. The foregoing Section C shall not apply to bus drivers. The first shift is any shift that regularly starts at or after 4:00 a.m. but before 1:00 p.m. The second shift is any shift that regularly starts at or after 1:00 p.m. but before 7:00 p.m. The third shift is any shift that regularly starts at or after 7:00 p.m. but before 4:00 a.m. Bargaining unit members are responsible for the input of time off/absence(s) in the sub-system. Bargaining unit members are also responsible for inputting aforementioned time off/absence(s) in the time clock for payroll. Any bargaining unit member who is assigned to call substitutes shall be paid at his/her regular hourly rate irrespective of whether the responsibilities are executed at or away from his/her normal workstation or outside of his/her regularly assigned hours of work. The Employer agrees to provide parking space for all bargaining unit members during their regularly assigned work hours at no charge. Bargaining unit members who are required to provide tools in connection with their employment shall have said tools insured for their full replacement value at Employer expense. Except provided for in Articles 9 and 10, the scheduling of overtime shall be subject to the following procedures: Overtime shall be offered and distributed to bargaining unit members within the classification(s) in each building. Overtime will be organized using an overtime chart and will be offered within the building where overtime is available to the most senior bargaining unit member on the seniority rotation list. Bargaining unit members assigned to more than one (1) classification and/or building shall be offered overtime on a rotating basis within each classification; however, bargaining unit members will be eligible for overtime in only one (1) of the buildings to which they are assigned. On or before September 1 of each year, the bargaining unit member will notify the Association Representative responsible for overtime as to the overtime building of his choice. Same shall remain in effect without change until the following September 1. For purposes of maintaining the overtime chart, the refusal of an offer of overtime shall be recorded as if it had been accepted. Upon completion of the probationary period, a bargaining unit member shall be added to the bottom of the seniority rotation list in accordance with his bargaining unit seniority i.e., last date of hire. Overtime work shall be voluntary. Absent a volunteer, the district reserves the right to assign the least senior bargaining unit member in the Food Service classification within the building. The seniority rotation list shall continue in effect from year to year. An extension of the bargaining unit member's shift for three purposes of task completion shall not be subject to the overtime rotation. The Association will designate a representative to administer, post and maintain the overtime, extra work, and extra trip provisions under this Agreement subject to the provisions below: Once the work is authorized by the supervisor, the Association Representative will be responsible for providing the names of the bargaining unit members who will perform the work. Communications required to obtain bargaining unit employees to perform the work may be done during the work hours with prior authorization from the supervisor. In the event of an error or omission in terms of the application of any overtime, extra hours and extra trips, the bargaining unit member bypassed will be placed at the top of the rotation list for the next opportunity to work and in the drivers, case will be assigned the next available unassigned trip. When a bargaining unit member works five (35) or more hours a day in any day, he shall be entitled to a duty-free free, unpaid lunch period equal to thirty (30) minute lunch periodminutes unless he is notified that he is the only District employee on duty in the building. In the event the entire instructional day is cancelled prior to coincide with the start of a bargaining unit member's workday due to inclement weather or conditions not within the control of the district, the following procedures will apply: Maintenance and mechanics may be required to report to work schedule. E. and will receive their regular rate for the day. If an individual is directed not to report, the employee will not suffer a loss of pay for the day. If an individual is not able to arrive at their regularly scheduled starting time, the employee may request to arrive up to three (3) hours late and extend their workday accordingly. School year employees and secretaries shall not be required to report to work. In the event the district is not required to make up such day(s) to receive State Aid payments, bargaining unit members will receive their regular rate of pay for the day(s). If the District is required to make up the day, pay will be issued after the rescheduled day(s) have been worked. A bargaining unit member who works four (4) is on paid leave as provided in Article 18 when school is closed for the reasons stated above, shall suffer no loss of leave time nor loss of salary when State Aid is received. In the event a student instructional day is delayed, or more consecutive hours students are dismissed early due to inclement weather or conditions not within the control of the district, the following procedures will apply: Maintenance and mechanics who are required to report to work at their regularly scheduled starting time or remain until their regularly scheduled quitting time, shall receive their regular rate of pay for the day. Maintenance and mechanics who are not required to report to work at their regular time or are dismissed early will receive their regular rate of pay for the day. School year employees and secretaries shall be entitled directed when to one report to work and will receive their regular rate of pay for the day. Employees covered by Section 2 who are released when students are dismissed early, will receive pay for the balance of the day provided Stale Aid is received for the remainder of the day. When the Food Service Supervisor determines to deliver the special menu on a delay day, food service employees shall be directed when to report to work and will be paid their regular rate of pay for the day. In the event the Food Service Supervisor determines to deliver the regular menu, food service employees will report at the irregular time and will be paid at their regular rate of pay for the day. L When a bargaining unit member is assigned to perform doctor prescribed medical treatment or scheduled maintenance of a medical apparatus used by a student, the bargaining unit member will be provided with training regarding the proper procedures to be utilized. The cost of the training will be paid by the Employer and the bargaining unit member will receive his/her regular hourly rate of pay. The Ingham County Intermediate School District plan for the delivery of special education programs and services will be made available for review at the Central Office. Questions regarding the plan should be directed to the Special Education Director or Superintendent. In the event a special education aide is directed to report to an IEPC meeting, the aide will be informed as to the procedures involved by the principal or Special Education Director upon request of the aide. Should an aide be assigned to accompany a class/student on a District-sponsored trip and the trip extends beyond the aide's regularly assigned work hours, said aide shall be paid at his/her regular hourly rate provided said hours do not exceed eight (18) hours a day nor forty (40) fifteenhours a week. Hours in excess of eight (8) hours a day or forty (40) hours a week shall be paid in accordance with the overtime provisions of this Agreement. A bargaining unit member shall not be required to accompany a class/student on a district-sponsored trip if the duration of the trip will extend beyond the member's scheduled hours unless pre-approved by immediate supervisor.

A bargaining unit member who works four (4) or more consecutive hours shall be entitled to one (1) fifteenfifteen (15) minute, duty-free break period within the four (4) hours and same shall be paid. A bargaining unit member who works eight (8) hours in any day shall be entitled to two (2) fifteen (15) minute, duty-free break periods within the eight (8) hours and same shall be paid. F. Bargaining unit members will be informed of the name and telephone number of the person with whom they are to report their unavailability for work. G. The Employer shall provide a uniform allowance in accordance with the following: 1. Bargaining unit members in the Food Services classification who regularly work more than two (2) hours a day shall receive six (6) shirts or smocks each calendar year. The wearing of employer supplied shirts or smocks shall be mandatory during working hours. 2. All full time grounds, custodial, maintenance and delivery employees shall receive three (3) sets of uniforms each calendar year. In addition, grounds, maintenance and the day custodial/maintenance bargaining unit members shall receive two (2) pairs of coveralls or one (1) pair of insulated coveralls. Other bargaining unit members may submit a written request regarding uniforms with the Director of Operations including the option of a different type of shirt. The decision of the Director of Operations shall be final. a. The bargaining unit member will maintain his/her own uniforms. b. Bargaining unit members who leave the employ of the Board within six (6) months of the issuance of uniforms shall return same. 3. For the 2012-2013 school year only, current bargaining unit members will not receive the uniform benefits listed in number 1 and 2 above. However, if new uniforms are needed, bargaining unit members may submit a written request to their respective department supervisor for uniform apparel. H. The Board shall provide the tools and equipment necessary to do a job. 1. Bargaining unit members will not be liable for loss, theft or damage to tools and equipment nor will they be required to make restitution for same unless proven guilty of negligence. 2. Every effort will be made to provide tools and equipment that meet safety standards. 3. Protective equipment for eyes/glasses will be available to bargaining unit members who weld. I. The Employer shall schedule its meetings with bargaining unit members on the Employer's time whenever reasonably possible. Meetings which are otherwise scheduled shall entitle the unit members to be paid at their regular hourly rate of pay for such time spent meeting with the Employer except when such meetings exceed the forty (40) hour work week and/or the eight (8) hour work day in which case the overtime provisions shall apply. The Employer's meetings with the Food Service classification can be scheduled on system-wide half-days of student instruction with at least thirty (30) calendar days notice to employees. J. Except as set forth in Section 2 below, overtime and additional hours shall be offered and distributed to bargaining unit members as equally as possible within each classification within a building. 1. Overtime for custodial/maintenance will be handled as follows: Overtime shall be rotated based on seniority within the building. If all building seniority personnel refuse overtime, then the supervisor of the building may take the overtime. If further overtime is needed (overflow), then overtime shall be distributed on a rotating basis from a volunteer list of qualified personnel within the classification. 2. Overtime or additional hours for food service will be handled as follows: At the beginning of each school year, all bargaining unit members within food service will have an opportunity to sign a voluntary list for the distribution of additional hours. It is understood that as additional hours occur, bargaining unit members on the list must be able to perform the duties necessary for the additional hours. The list shall be ranked by seniority and building. Additional hours will be by rotation on a building basis first, and additional hours thereafter on a system-wide basis. The rotation list will be started anew each year. 3. For rotation purposes, if a bargaining unit member refuses or is not available for overtime he/she shall be treated as having taken the overtime. 4. Known overtime shall be posted as soon as reasonably possible. 5. To the extent possible, overtime and/or additional hours will be voluntary. 6. When a regular bargaining unit member is absent, management will attempt to use regular employees rather than substitutes when other factors reasonably permit. 7. For rotation purposes, if a bargaining unit member is on vacation or personal business leave, he/she will be considered as being unavailable but will not be treated as having taken the overtime. K. Emergency closings will be governed by the following procedures: 1. Bargaining unit members under the Director of Operations shall receive one (1) day off with pay for each day that they are required to report as set forth herein. The day(s) off with pay shall be mutually arranged between the bargaining unit member and the Director of Operations. 2. Bargaining unit members who are not required to report for work shall receive the time off with full pay.
