Performance Data definition
Performance Data means a rating, ranking, quotation, discussion or analysis regarding an aspect of the investment performance of an investment fund, an asset allocation service, a security, an index or a benchmark;
Performance Data means all data relating to the performance of the Communication Services as implemented for CUSTOMER, including without limitation all test and performance data, as well as usability feedback data generated during the use of the Communication Services;
Performance Data means the data submitted by Contractor to OHA in connection with the Performance Measures deliverables required under 42 CFR § 438.330(a) and (c) and as set out in further detail in Ex. B, Part 10 of the Contract.

FTR shall have the right to collect and analyze Performance Data, and FTR will be free (during and after the term of this Agreement) to use such Performance Data for any legal purpose; provided, that, such use does not reveal the identify of Client or any judge, attorney, witness, litigant or other courtroom personnel.
Client acknowledges that FTR retains all right, title and interest in and to the FTR Offerings, Performance Data and all software and all FTR proprietary information and technology used by FTR or provided to Client in connection with the FTR Offerings (the “FTR Technology”), and that the FTR Technology is protected by intellectual property rights owned by or licensed to FTR.

Performance Data is data regarding a campaign gathered during delivery of an Ad pursuant to the IO (e.g., number of impressions, interactions, and header information), but excluding Site Data or IO Details.

Performance Data means the data relating to use of the Software or how resources of the components of the system are utilized, including, without limitation, system data about memory usage, CPU usage, I/O of the database, error and other logs about system performance.
Performance Data means such data relating to the performance of the Asset as may be notified by the Buyer to the Seller or by the Seller to the Buyer from time to time;
Performance Data means any and all aggregate, de-identified data relating to the access or use of the Services by or on behalf of Customer or any User, including any performance, analytics or statistical data, that LVT may collect from time to time.
