ASSEMBLY AND INSTALLATION a) If Supplier is responsible for assembly or installation of the Goods, Supplier shall perform these services in a careful and prudent manner in compliance and conformity with safe industry practices, Applicable Policies, Assembly Instructions, and in accordance with the requirements of all applicable laws, ordinances and regulations.
b) PERI may agree to provide engineering or design services in respect of the Goods, in which case all plans, calculations, designs, method statements and design advice produced by ▇▇▇▇, or its agents or consultants, before or after delivery of the Goods are intended to be only a general guide. It is the Supplier’s sole responsibility to check the adequacy, accuracy, suitability and completeness of the design advice and to notify PERI forthwith of any concerns.
ASSEMBLY AND INSTALLATION. 7.1 Unless otherwise agreed in writing, assembly/installation shall be subject to the following provisions, Customer shall provide at its own expense:
7.1.1 all earth and construction work and other ancillary work outside the scope of the work agreed to be performed by the Company, including the necessary skilled and unskilled labor, construction materials and tools;
7.1.2 the equipment and materials necessary for assembly and commissioning such as scaffolds, lifting equipment and other devices as well as fuels and lubricants;
7.1.3 energy, water and other utilities at the point of use including connections, heating and lighting;
7.1.4 suitable dry and lockable rooms of sufficient size adjacent to the site for the storage of machine parts, apparatus, materials, tools, etc. and adequate working and recreation rooms for the assembly and installation personnel, including sanitary facilities as are appropriate in the specific circumstances;
7.1.5 all measures reasonably appropriate for the protection of ▇▇▇▇▇▇▇▇’s own possessions and to protect the possessions of the Company and of the assembly and installation personnel at the site; and
7.1.6 protective clothing and protective devices needed due to particular conditions prevailing on the specific site.
7.2 Before the assembly/installation starts, Customer shall make available of its own accord architectural drawings and plans, as well as any other information or makings required concerning the location of concealed electric power, gas and water lines or of similar installations as well as the necessary structural data.
7.3 Prior to assembly or installation, the materials and equipment necessary for the work to start must be available on the site of assembly/installation and any preparatory work must have advanced to such a degree that assembly/installation can be started as agreed and carried out without interruption. Access roads and the assembly/installation site itself must be level and clear.
7.4 The Company shall make its own employees available to provide on-site installation assistance. Notwithstanding the foregoing, the Company shall not be responsible for the means, methods, techniques or procedures of installation selected by Customer or any failure of installation personnel to perform the assembly or installation in accordance with the applicable assembly instructions or Customer’s instructions. ASSEMBLY AND INSTALLATION. 1. The Principal is responsible for implementing, in a correct and timely manner, all arrangements facilities and/or conditions that are necessary for setting up the product to be assembled and/or the correct operation of the product in assembled state.
2. Notwithstanding the provision of paragraph 1, the Principal shall in any event arrange that (at his own expense and risk):
a. the employees of LGMG, or the employees of its subcontractors as soon as they have arrived at the place of installation, can commence their work and continue performing their work during normal working hours and moreover, outside normal working hours if this is deemed necessary by LGMG, provided the Principal has been informed of this in good time.
b. suitable accommodation with all conveniences becomes available for the employees of LGMG or its subcontractors, as required by virtue of governmental regulations, the agreement or practice;
c. the access roads to the place of installation are suitable for the requisite transport;
d. the designated place of installation is suitable for storage and assembly;
e. the necessary lockable storage sites for equipment, tools and other matters are present;
f. the requisite and usual auxiliary workers, auxiliary equipment, additives and industrial materials (fuel and lubricants, polishing and other small materials, gas, water, electricity, steam, pressurised air, heating, lighting etc.) as well as the normal measuring and testing equipment for the business of the Principal, are available for LGMG employees and its subcontractors in good time, free of charge and in the right place;
g. all necessary safety and precautionary measures have been taken and will be maintained in accordance with the guidelines for VCA certified work and that, as regards assembly or installation undertaken by our technicians is compliant with all government regulations;
h. at the start of and during the assembly all the requisite products and materials are present in the correct place.
3. Damage and costs arising because the conditions set forth in this article have not been complied with or not in good time, are to be paid for by the Principal.
4. With regard to the assembly/installation time, article 5 is likewise applicable.

13.2 In the event that Escuder undertakes to carry out the assembly or the installation of the Products, the parties shall expressly agree the terms and conditions applicable to the aforesaid assembly or installation.

ASSEMBLY AND INSTALLATION. The Buyer shall take all measures, prior to the planned delivery date, to ensure the proper operation of the Products including, but not only, any hydraulic, electrical, air intake, masonry or utility connection works, and any corresponding and necessary certifications and declarations of conformity. In the event of a default or of the lack of certificates and declarations of conformity regarding such plants and connections, the Buyer indemnifies and holds O.G. harmless from and against any liability for any Product malfunction. O.G. does not provide any connection, testing and starting service for Product operation; the Buyer’s technicians and staff in charge of performing the said services will be present at the time of Product assembly. The Buyer indemnifies and holds O.G. harmless, which will not be liable, for any instance in which the Products cannot be assembled, in whole or in part, due to defects, whether manifest or hidden, in the building (walls, ceilings, etc.) or other technical problems (electricity, gas, water, lack of certifications, etc.), and whenever any defects in the building or plants might cause a damage to the Products.
