Assignment of Mandatory Overtime. 1. When mandatory overtime is required, it will be assigned to employees on duty in inverse order of seniority. Employees will be allowed to select from any position available at the time of assignment for which they qualify. However, employees will not be required to work mandatory overtime unless the work is contiguous to the end of the employee’s normal shift. 2. In those cases where two (2) or more employees are assigned to mandatory overtime and qualified relief becomes available, the employee with the greatest seniority will normally be provided the first opportunity to be relieved from duty. 3. An employee will only be subjected to one (1) mandatory overtime per cycle. The inverse order will be re-established when the list has been exhausted (senior employee on duty has satisfied their requirement to work mandatory overtime and additional overtime is necessary) or at the beginning of each month, whichever occurs first. Except as expressly provided in Subsections 17.2.H.6 and 17.2.I, there will be no carryover of missed mandatory overtimes into a new cycle. 4. Upon request, shift rosters indicating mandatory overtime assignments will be available for review by the Union. Upon request, an employee who believes they were improperly assigned mandatory overtime may request the shift roster for a specific date and shift. 5. The Department will work with an employee to ensure a ride home if assigned mandatory overtime and the employee has missed their car/vanpool ride home.
Assignment of Mandatory Overtime. The following provisions shall apply to the assignment of mandatory overtime: 1. Mandatory overtime shall only be used to fill vacancies that affect the established minimum staffing level (“MSL”). 2. Special events and department-wide training shall be handled by adjusting the MSL for the duration of the event or training. It is understood that the Chief of Police can adjust the MSL at any time. 3. This exception shall also include those scheduled days off that occur immediately preceding and adjacent to or immediately after and adjacent to a vacation. b. No officer who has worked twelve (12) or more hours of overtime within a calendar week (Sunday through Saturday) shall be assigned mandatory overtime during that same calendar week. If the Department is unable to fill all required mandatory overtime slots with officers who have volunteered and worked less than the twelve (12 ) hours described above, they shall continue to fill the necessary mandatory overtime slots by officers who have volunteered and worked more than the required twelve (12 ) hours in an order from the officer having volunteered and worked the least number of hours to the officer who has volunteered and worked the greatest number of hours until all mandatory slots are filled. c. No more than twelve (12) hours of mandatory overtime shall be assigned to an officer in any given seven (7) day period. In addition, no officer shall be mandated to work more than sixteen (16) hours per day or more than twenty-four (24) hours of total overtime per week; provided, that nothing in this Section shall preclude any employee from volunteering to work overtime in excess of these amounts, subject to the provisions of Section 11.05(B) above. d. The exceptions specified in 5(b) and 5(c), above, shall be waived during periods of unusual occurrence, including special events, dignitary protection details, department-wide training, or in the event of an emergency.   • Assignment of Overtime 3.4.1 Overtime shall be assigned on a rotating seniority basis among all qualified employees who are in the same classification, the same organizational unit, and at the same work location. An employee may decline an overtime assignment without adverse consequence unless it is assigned pursuant to Section 3.4.2 below. The department may define the group of qualified employees by their shift for purposes of assigning overtime so that call back pay is not obligated. In order to determine if an employee is qualified, the department should consider the employee’s work record in the department, including being in an unsatisfactory status on a current evaluation or having a formal discipline action in process. 3.4.2 If no employee in the classification, organization unit and work location accepts the overtime assignment, using the rotating seniority process, the District may assign the overtime in reverse rotating seniority order. 3.4.3 The following are allowable exceptions to the seniority overtime assignment process: When overtime is authorized for completion of a specific assignment, project, or work in progress, the employee who began the assignment, project, or work may be assigned the overtime; When the District determines it is necessary to consider special skills and training of employees to perform particular work; When employees are available to perform the work on a non-over-time basis, the District shall not be required to assign the work on an overtime basis. Overtime pay assignments will not be given to temporary employees unless the regular employees that would normally be assigned the overtime are not available or one of the seniority exceptions apply. 3.4.4 All overtime shall be offered to everyone on the applicable overtime list in descending order of seniority until the list is exhausted. Once the last name on the list is reached the process will resume from the top of the list. If an employee is offered overtime for a scheduled project and declines to accept, the employee forfeits his/her turn in the rotation. That employee will not be offered overtime until the list has been completed and his/her name comes up again in order of seniority. 3.4.5 Notice of scheduled overtime, for situations that are recurring or have advance notice, and which are offered on a rotational basis shall be posted in the same area as all required employment notices and announcements and will remain up until the work has been completed. Posting shall be on a form agreed to by the District and CSEA. Employee responses to the overtime posting shall be on a form agreed to by the District and CSEA. In lieu of posting, an organizational work unit may use electronic communications when all employees in such unit regularly use electronic communication. All such notices whether posted or sent by electronic communication will contain a description of the work to be done, the anticipated length of time to accomplish the work, the date(s) on which the work will be scheduled, and the date and time of posting. The notice shall be posted within a reasonable time of the District learning of the overtime work. Records will be maintained of all notices, employee responses, and overtime assignments for a period of three years.

  • Assignment of Overtime Work (a) Subject to the operational requirements, the Employer shall make every reasonable effort to avoid excessive overtime and to offer overtime work on an equitable basis among readily available qualified employees. (b) Except in cases of emergency, call-back, or mutual agreement with the employee, the Employer shall, wherever possible, give at least four (4) hours’ notice of any requirement for overtime work.

  • Assignment of Contract A. No assignment by a party hereto of any rights under or interests in the Contract will be binding on another party hereto without the written consent of the party sought to be bound; and, specifically but without limitation, moneys that may become due and moneys that are due may not be assigned without such consent (except to the extent that the effect of this restriction may be limited by law), and unless specifically stated to the contrary in any written consent to an assignment, no assignment will release or discharge the assignor from any duty or responsibility under the Contract Documents.
