Contractor Management. Contractor shall provide all personnel necessary to manage and perform specified services. Contractor shall furnish general management, safety management, quality management, training, administration, travel, supervision, quality control (QC), supplies, materials and equipment (not otherwise furnished as Government Furnished Materials) necessary to deliver abatement and demolition services in compliance with task order schedule and IAW with contract terms and conditions, reference documents, contract and task order requirements, and contract clauses. At all times during performance of this contract until government acceptance of the work, the Contractor shall provide a Program/Project Manager and an on-site Job-Site Superintendent IAW requirements set forth below.
Contractor Management. 5.1. Building Contractors will be managed on behalf of the individual by the HHIA, including the obtaining of quotes, supervision of works, contract variations, and signing off the work as satisfactory.
5.2. The HHIA will engage contractors through either:
5.2.1. The HHIA Contractor Framework, for non-complex, standardised works; or
5.2.2. Through a tender process for complex, non-standard work.
5.3. Non-complex works will generally include (but is not exclusively restricted to) level access showers, stair-lifts, and ramps.
5.4. The Contractor Framework will be reviewed every [four] years, in accordance with the Framework specification.
5.5. Queries and issues arising during the course of the building work will be referred to the Technical Officers and Caseworkers for resolution. Works outside the DFG application, or in addition to the application will be considered, but must be approved by the HHIA.
5.6. Any variations to the contract, or unforeseen works must be approved by the Technical Team Leader or Head of Service as being necessary and appropriate before work related to the variation or unforeseen circumstances can be started, except in the event of an emergency where remedial work must be done to prevent harm or damage to property.
5.7. Home owners may, in some circumstances, be allowed to upgrade aspects of the build at their own expense (for example patterned tiles in bathrooms), but this must be agreed with the HHIA before work begins.
5.8. Work must be signed off as satisfactory by the HHIA before payment is made.
Contractor Management. Responsibility for ensuring safe working practices and that a contractor is qualified to do the work rests with the person/s who commissions the work to be done, be it a Property officer or a Site Manager. This is a legal requirement under Building Management and Design Regulations (CDM).

The contracts with selected contractors will include provisions related to labor and occupational health and safety, as provided in the World Bank SPD and Serbian law. The Supervision Consultant will manage and monitor the performance of Contractors in relation to contracted workers, focusing on compliance by contractors with their contractual agreements (obligations, representations, and warranties). This may include periodic audits, inspections, and/or spot checks of project locations or work sites and/or of labor management records and reports compiled by contractors. Contractors’ labor management records and reports may include: (a) a representative sample of employment contracts or arrangements between third parties and contracted workers; (b) records relating to grievances received and their resolution; (c) reports relating to safety inspections, including fatalities and incidents and implementation of corrective actions; (d) records relating to incidents of non‐compliance with national law; and (e) records of training provided for contracted workers to explain labor and working conditions and OHS for the project. Contractor Management. DSHS will retain exclusive authority, discretion and rights of approval concerning verification activities related to the Contractor performing its obligations of the Contractors supporting DSHS.
1.1. it is qualified and registered to transact business in all locations where the performance of its obligations hereunder would require such qualification;
1.2. it has all necessary rights, powers, and authority to enter into and perform this Agreement and to bind its DSHS with respect to the same, and the execution, delivery, and performance of this Agreement by the Contractor have been duly authorized by all necessary corporate actions;
1.3. the execution and performance of this Agreement by the Contractor shall not violate any law, statute or regulation, and shall not breach any agreement, covenant, court order, judgment or decree to which the Contractor is a party or by which it is bound;
1.4. it has, and promises that it shall maintain, in effect, all governmental licenses and permits necessary for it to provide the Services contemplated by this Agreement;
1.5. it owns or leases and promises that it shall own or lease, free and clear of all liens and encumbrances, other than lessors' interests, or security interests of the Contractor's lenders, all rights, titles, and interests in and to the tangible property and technology and the like that the Contractor intends to use or uses to provide the Services, and in and to the related patent, copyright, trademark, and other proprietary rights, or has received appropriate licenses, leases or other rights from Third Parties to permit such use; and
1.6. this Agreement constitutes a valid, binding and enforceable obligation of the Contractor.

Contractors must meet all operational and safety and health standards that apply to the operation they are responsible for.
