Exemption criteria. The District Committee and National Exemptions Committee, when considering an application, must take into account the following criteria (the order not indicating any form of priority): (a) any written and/or verbal substantiation provided by the applicant; (b) fairness to the employer, its employees and other employers and the employees in the industry; (c) whether an exemption, if granted, would undermine this Agreement or the collective bargaining process; (d) whether it will make a material difference to the viability of a new business, or a business previously outside the jurisdiction of the Council; (e) unexpected economic hardship occurring during the currency of the Agreement, and job creation and/or loss thereof. (f) the infringement of basic conditions of employment rights; (g) the fact that a competitive advantage might be created by the exemption; (h) comparable benefits or provisions where applicable; (i) the applicant’s compliance with other statutory requirements such as the Occupational Injuries and Diseases Act or Unemployment Insurance; or (j) any other factor which is considered appropriate.
Exemption criteria. The Independent Board must consider all appeals with reference to the following criteria: (a) the written substantiation and motivation submitted by the applicant; (b) the extent of consultation with and the petition for or against granting the exemption as provided by employers or employees who are to be affected by the exemption if granted; (c) the scope of exemption required; (d) the infringement of basic conditions of employment rights; (e) the fact that a competitive advantage is not created by the exemption; (f) the viewing of the exemption from any employee benefit fund or training provision in relation to the alternative compatible bona fide benefit or provision, including the cost of the employee, transferability, administration management and cost, growth and stability; (g) the extent to which the proposed exemption undermines collective bargaining and labour peace in the Motor Industry; (h) any existing special economic or other circumstances which warrant the granting of the exemption; (i) cognisance of the recommendations contained in the Report of the Presidential Commission to Investigate Labour Market Policy; and (j) any recommendation from the Council.

Exemption criteria. The Exemptions Board and the Council shall consider all applications of exemptions referred to in terms of this clause 26 with reference to the following criteria: (a) The extent of consultation with and the petition for or against granting the exemptions as provided by employers or employees who are to be affected by the exemption if granted; (b) infringement of basic conditions of employment rights; (c) that a competitive advantage is not created by the exemption; (d) that exemption from any employee benefit fund or training provision be viewed in relation to the alternative comparable bone fide or provision including the cost to the employee, transferability, administration management and cost, growth and stability; (e) the extent to which the proposed exemption undermines collective bargaining and labour peace in the Contract Cleaning Services Industry; (f) the reality that the majority of employers at any time engaged in the Contract Cleaning Services Industry within the Council’s area of jurisdiction as well as the majority of members of the employer parties to the Council, represent the category micro to medium enterprises and employ between one and one hundred employees; (g) any special economic or other circumstances that exist warrant the granting of the exemption; (h) take cognizance of the recommendations contained in the Report of the Presidential Commission to Investigate Labour Market Policy.
Exemption criteria. Those university courses that appear from title, description and requirements to be similar (but not identical) to our own. Those university courses which have no with any of those in our instructional Certificate Program, but appear to be valid alternates. Work experience which appears to parallel the intended outcome of any of the courses in the Instructional Certificate Program. This, of course, would require a detailed substantiation by a persons previous superior. Work experiences which would appear to parallel the objectives of courses which would be accepted as valid alternates had they been taken as university courses. The Instructional Certificate Program is designed as "teacher" training. The criteria outlined should be viewed in this light. A course in Canadian History or Advanced Electronics may be appropriate in view of the subject matter being taught, but would not be viewed as possible alternates to the requirements of a "teacher" training program. With reference to Section Definitions, this list indicates the "Program Cluster" to which an academic staff member is assigned, for purposes of redundancy considerations. Exemption criteria. Central Govt., State Govt. & PSU Vehicles are exempted from payment of parking charges in Airport premises. Vehicles of MPs & MLAs are also exempted from payment of parking charges in Airport premises.

  • Criteria (1) Annual Evaluation Criteria. All performance evaluations shall be based upon assigned duties, and shall carefully consider the nature of the assignment in terms, where applicable, of: a. Teaching effectiveness, including effectiveness in presenting knowledge, information, and ideas by means or methods such as lecture, discussion, assignment and recitation, demonstration, laboratory exercise, practical experience, supervision of interns, theses, professional projects and/or dissertations, and direct consultation with students. The evaluation shall include consideration of effectiveness in imparting knowledge and skills, and effectiveness in stimulating students' critical thinking and/or creative abilities, the development or revision of curriculum and course structure, and adherence to accepted standards of professional behavior in meeting responsibilities to students. The evaluator may take into account class notes, syllabi, student exams and assignments, and any other materials relevant to the employee's teaching assignment. The teaching evaluation must take into account any relevant materials submitted by the employee, including the results of peer evaluations of teaching, and may not be based solely on student evaluations when this additional information has been made available to the evaluator. b. Contribution to the discovery of new knowledge, development of new educational techniques, and other forms of creative activity. Evidence of research and other creative activity shall include, but not be limited to, published books; articles and papers in professional journals; musical compositions, paintings, sculpture; works of performing art; papers presented at meetings of professional societies; funded grant activities; and research and creative accomplishments that have not yet resulted in publication, display, or performance. The evaluation shall include consideration of the employee's productivity, including the quality and quantity of the employee's research and other creative programs and contributions during the year, as well as recognition by the academic or professional community of what has been done. c. Public service that extends professional or discipline-related contributions to the community, the State, public schools, and/or the national and international community. This public service includes contributions to scholarly and professional organizations, governmental boards, agencies, and commissions that are beneficial to such groups and individuals. d. Participation in the governance processes of the University through significant service on committees, councils, and senates, beyond that associated with the expected responsibility to participate in the governance of the University through participation in regular departmental or college meetings. e. Other assigned University duties, such as attending University events, advising, counseling, and academic administration, or as described in a Position Description, if any, of the position held by the employee. Other assigned duties may include entrepreneurial activities that contribute to the further development of the University with an end result of creating a new venture. Evidence of entrepreneurial contributions shall include, but not be limited to, creation of self- supporting centers or institutes, development of multi- disciplinary research partnerships, and applications of research to implementations in society. To provide guidelines for the establishment, maintenance and use of employee evaluation files within the employee’s respective academic unit.

  • Screening Requirements LFAC shall ensure that all prospective and current Covered Persons are not Ineligible Persons, by implementing the following screening requirements. a. LFAC shall screen all prospective Covered Persons against the Exclusion List prior to engaging their services and, as part of the hiring or contracting process, shall require such Covered Persons to disclose whether they are Ineligible Persons. b. LFAC shall screen all current Covered Persons against the Exclusion List within 30 days after the Effective Date and on a monthly basis thereafter. c. LFAC shall require all Covered Persons to disclose immediately if they become an Ineligible Person. LFAC shall maintain documentation (i.e., a print screen of the search results) in order to demonstrate that LFAC: (1) has checked the Exclusion List and determined that its Covered Persons are not Ineligible Persons; and (2) has required its Covered Persons to disclose if they are an Ineligible Person. Nothing in this Section III.D affects LFAC’s responsibility to refrain from (and liability for) billing Federal health care programs for items or services furnished, ordered, or prescribed by an excluded person. LFAC understands that items or services furnished by excluded persons are not payable by Federal health care programs and that LFAC may be liable for overpayments and/or criminal, civil, and administrative sanctions for employing or contracting with an excluded person regardless of whether LFAC meets the requirements of Section III.D.
