Flexible Part time (a) The engagement is subject to a minimum number of hours per week, between 12 and 36 hours per week, with a minimum daily engagement of four (4) hours. (i) The company and the employee will agree on: i. The hours to be worked ii. The days on which the hours are to be worked, and iii. The commencing and finishing time for the hours worked (ii) The agreement reached in 2.1.3(a)(i) may be varied by agreement, including for the period of a roster cycle. (b) Overtime will be paid at the rates specified in clause 2.4.2 (a) to the employee for all hours worked: (i) in excess of 12 ordinary hours on any particular day; or (ii) in excess of 38 ordinary hours per week; or (iii) on the 6th or 7th days of the week, following ordinary time worked on five (5) consecutive days; or (iv) outside of those agreed in 2.1.3(a)(i) and 2.1.3(a)(ii). (c) Employees engaged under this provision may be requested to work reasonable additional hours to meet operational or customer needs, taking into account the employee's personal circumstances. Employees have the right to refuse to work additional hours in accordance with the NES. (d) Except in the case of operational necessity, a part-time employee engaged under these provisions will be provided the following notice in relation to shift/roster changes: (i) Four (4) working days’ notice of a change of shift: this includes an additional shift, a shift deletion, or an amendment/swapping of a shift. (ii) 24 hours’ notice of a change to an employee’s start/finish times due to operational needs. (e) The above notice periods can be waived or reduced if mutually agreed to by the Company and the employee. (f) All conditions applicable to full-time employees shall apply to part-time employees provided that leave entitlements (other than Long Service Leave) shall apply on a pro rata basis according to the average number of ordinary hours worked, taken over the previous 13 weeks or in accordance with the NES, whichever is greater.
Flexible Part. Time Employees may be engaged on the following terms: The employer encourages and values long serving employees and supports casual employees in becoming permanent. The following terms and conditions provide the employee the benefits of permanent employment with the flexibility necessary for the employer to meet customer and operational requirements. (a) Flexible Part-time employees, for the purposes of this subclause, will be employed for not less than 15 hours per week and up to 38 hours per week as mutually agreed between the employer and employee. Ordinary hours for flexible part-time employees shall be paid on the basis of not more than 8 hours in any one-day or not more than 152 hours over a four-week period. (b) Flexible Part-time employees shall be required to work a minimum of the agreed hours. The agreed minimum hours are the average hours worked over the past 12 months (see section 3.2.4). The Flexible Part-Time employee will have varied days of work and varied starting / finishing times. The employer will consult with the flexible part-time employee at the end of their shift to arrange and/or confirm the starting and finishing times for the next scheduled workday. The starting times for the next day may vary by three hours. The range of hours for a flexible part-time employee will be 5 hours maximum from their agreed minimum hours in a cycle. For example, an employee who has the agreed minimum hours of 25 hours per week may work up to 30 hours and 20 hours the next week within the cycle. The flexible part-time employee may work up to 38 hours in a week at ordinary rates by mutual agreement. If it is not mutually agreed and the employee is required to work above their range then overtime rates would apply. For example, overtime rates would apply when an employee who has the agreed minimum hours of 25 hours per week and has already worked an additional 5 hours and is required by the employer to work further hours will be paid overtime rates.

Employees engaged under this provision may be requested to work reasonable additional hours to meet operational or customer needs, taking into account the employee's personal circumstances. Employees have the right to refuse to work additional hours in accordance with the NES. d) Except in the case of operational necessity, a part-time employee engaged under these provisions will be provided the following notice in relation to shift/roster changes:

  • Flexible Working Arrangement (a) The Parties recognise the importance of flexible working arrangements and the right of Employees to make requests under section 65 of the Fair Work Act for flexible working arrangements. An Employee may request a flexible working arrangement if any of the following circumstances apply to the Employee: (i) the Employee is pregnant; (ii) the Employee is the parent, or has responsibility for the care, of a child who is of school age or younger; (iii) the Employee is a carer (within the meaning of the Carer Recognition Act 2010); (iv) the Employee has a disability; (v) the Employee is 55 or older; (vi) the Employee is experiencing violence from a member of the Employee’s family; (vii) the Employee provides care or support to a member of the Employee’s immediate family, or a member of the Employee’s household, who requires care or support because the member is experiencing violence from the member’s family.
