The 'Formal Level One' clause establishes the initial stage in a formal dispute resolution process between parties. Typically, this clause requires that disputes be first addressed through written notice and a meeting between designated representatives of each party, such as project managers or department heads, before escalating to higher levels of management or external mediation. By mandating a structured, stepwise approach to resolving disagreements, the clause aims to encourage early, direct communication and resolution, thereby minimizing escalation, reducing costs, and preserving business relationships.
Formal Level One. When informal procedures fail to resolve the concern, the employee may elect to complete the Conflict Resolution Form. The Conflict Resolution Form will be completed and submitted to the administrator/supervisor within five (5) working days following the informal procedure. Information on the Conflict Resolution Form will state the concern in specific terms and propose a remedy. The administrator/supervisor will render a written decision within five (5) working days after receipt of the Conflict Resolution Form. Conflict Resolution Forms will be available at each school office, at the District Office, through the REA, on the District website, and in the Appendix of this agreement.
Formal Level One. If a complaint is not resolved in a conference between the Employee(s) and his/her immediate supervisor, the complaint may be formalized as a grievance. A formalized grievance shall be submitted in writing within ten (10) days of the meeting between the supervisor and the affected Employee(s). A copy of the grievance shall be sent to the Association and the immediate supervisor. The immediate supervisor shall, within five (5) days of the receipt of the grievance, render a written decision. A copy of this decision shall be forwarded to the grievant(s) and the Association. If the grievant(s) or the Association is not satisfied with the disposition of the grievance at Level One or if no disposition has been made within five (5) days of receipt of the grievance, the grievance shall be transmitted to the Superintendent or the designated representative at Level Two.
Formal Level One. If the grievance cannot be resolved informally, the Association may file the grievance in writing with the principal or responsible administrator and should inform the immediate supervisor. The written grievance shall state the nature of the grievance, the specific provisions of the agreement allegedly violated, and the relief requested. The filing of the formal, written grievance at Level One must be within thirty (30) days from the date of the occurrence of the event giving rise to the grievance or from the date when the grievant could reasonably have become aware of such occurrence. Formal Level One. If the grievance cannot be resolved informally, the Association may file the grievance in writing with the principal or responsible administrator and should inform the immediate supervisor. The written grievance shall state the nature of the grievance, the specific provisions of the agreement allegedly violated, and the relief requested. The filing of the formal, written grievance at Level One must be within thirty (30) days from the date of the occurrence of the event giving rise to the grievance or from the date when the grievant could reasonably have become aware of such occurrence. The principal or responsible administrator shall respond to the grievance in writing to the employee and the Association within ten (10) days after receipt of the grievance, or request a meeting with the grievant and the Association in which event the principal or responsible administrator shall have additional time to respond. Such additional time shall not exceed fifteen (15) days from receipt of the grievance or ten (10) days from the date of the meeting, if held, whichever shall be the lesser. Should a grievance occur within thirty (30) days prior to the last work day of the school year, the time for the filing of a formal written grievance at Level One may be extended into the next school year, at the option of the Association, for a period up to the difference between thirty (30) days and the number of days expended prior to the last work day of the school year. Should a grievance occur during the summer recess, the deadline for filing the formal written grievance shall be extended to a date thirty (30) days beyond the first work day of the following school year.
Formal Level One. If the grievance is not resolved after the informal level, the grievant must, within ten (10) days of the response to informal level, reduce his/her grievance to writing on the form attached hereto (see Appendix C) to the Director, Human Resources/Labor Relations or designee. The Director, Human Resources/Labor Relations or designee shall meet with the grievant within ten (10) days to resolve the grievance, if practicable, or discuss other resolution methods. After that meeting, the Director, Human Resources/Labor Relations or designee has seven (7) days to respond in writing to the grievant’s written, formal level one.
Formal Level One. In the event that a grievance is not resolved at the informal conference level, the grievance, in writing, may be filed with or submitted to the immediate supervisor and the principal of the school within ten (10) days following the informal conference. The immediate supervisor and the principal shall, within ten (10) days of the receipt of the grievance render a written decision. A copy of this decision shall be forwarded to the Union.
Formal Level One. If the Union is not satisfied with the disposition of the grievance at the informal level (7.2a above), or if no disposition is made within seven (7) work days of the informal meeting between the grievant/Union and the immediate supervisor as above, a formalized grievance shall be submitted in writing within twelve (12) days of the informal meeting. A copy of the grievance will be sent to the Union and to the immediate supervisor involved. The immediate supervisor shall, within seven (7) work days, render a written decision. A copy of this decision shall be forwarded to the grievant and to the Union.
Formal Level One. The grievance statement should include the following:
6.2.2.1 A statement of the grievance clearly indicating the question raised by the grievance, the facts upon which it is based, such as supporting documents and other relevant data, and the section of the Agreement allegedly violated.
6.2.2.2 The remedy or correction requested of the District, and the concise disagreement with the administrative solution proposed. The grievance statement shall be signed and dated by the grievant and their representative. The date and time of presentation shall be affixed and signed as received by the immediate supervisor. The immediate supervisor shall give their written answer to the grievance within five (5) working days from the time the written grievance is received. The supervisor’s answer shall include the following:
6.2.2.2.1 A statement of the supervisor’s position and the facts and supporting documents, etc. upon which it is based.
6.2.2.2.2 The remedy or correction, which has been offered, if any.
Formal Level One. Within 10 days of the occurrence or of first knowledge of the occurrence of the alleged violation of the Agreement, or within 10 days of the Informal Level meeting, the grievant shall present the grievance in writing to the immediate supervisor.
5.11.1 The written grievance shall contain the following minimum information:
1. The grievant's name.
2. The date of filing.
3. The date of the alleged violation.
4. The specific Article(s) or section(s) violated.
5. A brief description of the alleged violation.
6. A brief synopsis of the informal conference.
7. The specific relief requested.
5.11.2 Grievances not containing the required information shall be rejected as being improperly filed.
5.11.3 The grievant may request a conference with the immediate supervisor. The conference shall be held within 10 days of the request.
5.11.4 Within 10 days of receipt of the grievance by the supervisor or within 10 days of the conference, if one is requested, a written decision shall be issued to the grievant.
1. If the supervisor does not respond within the time limit, the grievance is denied and the grievant may appeal to the next level.
Formal Level One. Immediate Supervisor
7.8.1.1 If the informal conference does not resolve the grievance and the ▇▇▇▇▇▇▇▇ wishes to initiate a formal grievance, they must do so within ten (10) days after the informal conference. The grievant and/or CSEA must present the employee’s grievance in writing on the form attached hereto (Appendix I) to the employee’s immediate supervisor. The statement shall be a clear, concise statement of the grievance, the circumstances involved, including the specific contract provisions violated, the result of the informal conference, and the specific remedy sought. A copy of the grievance shall be submitted to the Chapter President and the Labor Relations Representative.
7.8.1.2 Either party may request a personal conference with the other party. The immediate supervisor shall communicate the supervisor’s decision to the employee and CSEA Labor Relations Representative in writing within ten (10) days after receiving the formal grievance. This concludes Level One.
