From Leave. Failure to return to work at the expiration of approved leave shall be considered as absence without leave and grounds for dismissal. This section should be subject to extenuating circumstances preventing timely return, as determined by the Superintendent.

a. At least forty-five (45) calendar days prior to the completion of the long-term leave of absence, CUE shall notify the University of the employee’s intent to return to the University’s employ and the employee shall likewise so advise the University.

From Leave. Except as otherwise required by law, an employee who returns from a leave of absence in accordance with the terms of the approved leave date will be returned to the same position if the leave is for one hundred twenty (120) calendar days or less. An employee returning in accordance with the terms of an approved leave in excess of one hundred twenty (120) days will be returned to his/her position if it has not been permanently filled; otherwise (s)he will be assigned a vacant position as similar as is practicable to the one occupied prior to the leave of absence, and if no such employee vacancies exist as of the return date, the employee will be placed on lay off status. An employee returning from a medical disability leave, family/medical leave due to the employee's own disability, or Workers' Compensation leave, must provide the Human Resources Department with a clearance to resume duties from the employee's physician, as permitted by law, which clearance will be placed in the employee's health file.
