From Leave. Provisions for reinstatement upon return from leave shall be as per section 8.9D.

From Leave. In the event that an Occasional Teacher's long-term assignment is interrupted due to illness or other leave, the original Occasional Teacher will continue that assignment, upon notifying the Principal.

From Leave. 1915 An effort will be made to return the Registered Nurse to the same position when the leave ends, if it is available, or to a similar position for which the Registered Nurse is qualified. However, reinstatement in such circumstances cannot be guaranteed unless required by State or Federal law. A Registered Nurse who fails to return on the next scheduled workday following the expiration of her/his leave of absence will be considered to have voluntarily resigned from his/her employment.

At least forty-five (45) calendar days prior to the completion of the long-term leave of absence, CUE shall notify the University of the employee’s intent to return to the University’s employ and the employee shall likewise so advise the University. b. Upon return, the employee shall be placed in the same position from which s/he took the leave of absence and at the rate of pay which would place the employee at the same relative position in the range for the position as that range exists when the employee returns. Placement of the employee in her/his previous position shall be consistent with staffing reductions and/or layoffs, which may have occurred during the period of the leave of absence without pay.

From Leave. Except as otherwise required by law, an employee who returns from a leave of absence in accordance with the terms of the approved leave date will be returned to the same position if the leave is for one hundred twenty (120) calendar days or less. An employee returning in accordance with the terms of an approved leave in excess of one hundred twenty (120) days will be returned to his/her position if it has not been permanently filled; otherwise (s)he will be assigned a vacant position as similar as is practicable to the one occupied prior to the leave of absence, and if no such employee vacancies exist as of the return date, the employee will be placed on lay off status. An employee returning from a medical disability leave, family/medical leave due to the employee's own disability, or Workers' Compensation leave, must provide the Human Resources Department with a clearance to resume duties from the employee's physician, as permitted by law, which clearance will be placed in the employee's health file.

Permanent part-time and permanent full-time employees shall be eligible to participate in the benefit plans stated above provided they have completed their probationary period.
