Further Competition Procedure. Contracting Body's Obligations 3.1 Any Contracting Body awarding a Call Off Agreement under this Framework Agreement through a Further Competition Procedure shall: 3.1.1 develop a Statement of Requirements setting out its requirements for the Goods and/or Services and identify the Framework Suppliers capable of supplying the Goods and/or Services; 3.1.2 amend or refine the Template Call Off Form and Template Call Off Terms to reflect its Goods and/or Services Requirements only to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; 3.1.3 invite tenders by conducting a Further Competition Procedure for its Goods and/or Services Requirements in accordance with the Regulations and Guidance and in particular: (a) if an Electronic Reverse Auction (as defined in paragraph 4 below) is to be held the Contracting Body shall notify the Framework Suppliers identified in accordance with paragraph 3.1.1 and shall conduct the Further Competition Procedure in accordance with the procedures set out in paragraph 4.3; 3.1.4 apply the Further Competition Award Criteria to the Framework Suppliers' compliant tenders submitted through the Further Competition Procedure as the basis of its decision to award a Call Off Agreement for its Goods and/or Services Requirements; 3.1.5 on the basis set out above, award its Call Off Agreement to the successful Framework Supplier in accordance with paragraph 7 which Call Off Agreement shall: (a) state the Goods and/or Services Requirements; (b) state the tender submitted by the successful Framework Supplier; (c) state the charges payable for the Goods and/or Services Requirements in accordance with the tender submitted by the successful Framework Supplier; and (d) incorporate the Template Call Off Form and Template Call Off Terms (as may be amended or refined by the Contracting Body in accordance with paragraph 3.1.2 above) applicable to the Goods and/or Services, 3.1.6 provide unsuccessful Framework Suppliers with written feedback in relation to the reasons why their tenders were unsuccessful. 3.2 The Supplier shall in writing, by the time and date specified by the Contracting Body following an invitation to tender pursuant to paragraph 3.1.3 above provide the Contracting Body with either: 3.2.1 a statement to the effect that it does not wish to tender in relation to the relevant Goods and/or Services Requirements; or 3.2.2 the full details of its tender made in respect of the relevant Statement ...

Further Competition Procedure. The process of a customer issuing a Brief and the Supplier submitting a proposal in response to such Brief. Good Industry Practice Standards, practices, methods, and procedures conforming to the Law and the exercise of the degree of skill and care, diligence, prudence, and foresight which would reasonably and ordinarily be expected from a skilled and experienced person or body engaged within the relevant industry or business sector. Guarantee A deed of guarantee that may be required under this Call Off Framework Agreement in favour of the Customer in the form set out in Framework Clause 3 (Call Off Guarantee). Guarantor The person, if a Guarantee is required under this Call Off Framework Agreement, acceptable to the Customer to give a Guarantee. Impact Assessment The assessment to be carried out by a Party requesting a Variation in accordance with Clause 9.4.
Further Competition Procedure. Contracting Body’s Obligations Any Contracting Body ordering Services under the Framework through a further competition is expected to:- develop a Statement of Requirements setting out its requirements for the Services and invite all Framework Service Providers capable of supplying the Services to tender; refine the Call-Off Terms and Conditions to reflect its Services Requirements only to the extent permitted by and in accordance with the requirements of the Regulations and Guidance; follow the Regulations and Guidance when conducting a further-competition for its Services Requirements and in particular:- invite all Framework Service Providers who are capable of meeting the Contracting Body’s Statement of Requirements to submit a tender, that sets out clearly how it will meet the Contracting Body's Statement of Requirements and the charges that will apply, for each specific Call-Off Contract to be awarded. This would normally be issued to all the Framework Service Providers in a given lot. However, where a Statement of Requirement is sufficiently complex as to span the scope of more than one lot, the Contracting Body shall only invite those Framework Service Providers who are included in all of the lots that are deemed applicable to the Statement of Requirement; by giving written notice by email to the designated contact for each Framework Service Provider; unless the invitation to submit a tender is published using the ITQ facility on the Buying Solutions website. In which case, the written notice will be automatically generated according to the information contained within the system and provided for that purpose by each Framework Service Provider; set a time limit for the receipt by it of the tenders which takes into account factors such as the complexity of the subject matter of the contract and the time needed to submit tenders; and

Further Competition Procedure. 4.1 When seeking to place an Assignment Contract under this Framework Agreement the Authority shall undertake a Further Competition in accordance with the procedure in this clause 4 and Schedule 6. 4.2 An invitation to take part in a Further Competition issued by the Authority will: 4.2.1 be issued in writing to all suppliers in the relevant Lot of the Framework Agreement capable of fulfilling the requirement for the provision of the Research and Evaluation Services the Authority requires through the Bravo site; 4.2.2 specify the Research and Evaluation Services that the Authority requires and by when they are to be delivered; 4.2.3 explain how any Potential Supplier wishing to bid for the provision of the Research and Evaluation Services may submit a proposal to the Authority; 4.2.4 specify the evaluation criteria that the Authority will use to select its preferred supplier from the potential suppliers; 4.2.5 state the latest date and time by which proposals are to be submitted by potential suppliers. Such time limit shall be of sufficient duration to allow proposals to be submitted, taking into account factors such as the complexity of the Research and Evaluation Services required and the time needed by potential suppliers to compile and submit a proposal. 4.3 The Authority will evaluate all proposals received in accordance with the stated criteria and will notify all potential suppliers who submit a proposal of the outcome of that evaluation and which of them it has chosen as its preferred supplier to provide the Services. 4.4 The Authority will enter into an Assignment Contract with its preferred supplier for the supply of the Research and Evaluation Services substantially in the form of the document in Schedule 1. This Assignment Contract will incorporate the Assignment Contract Terms and Conditions in Schedule 2.
