Items Included. Owner shall pay, and Construction Manager shall accept, as full and complete payment for the Construction Services, only the sum of the following items (collectively, the “Contract Price”), which Contract Price shall not exceed the GMP:
(i) the aggregate Cost of the Work, not to exceed the amount therefore specified in the GMP;
(ii) the compensation for Construction Manager’s provision of management services (the “Staffing Costs”), not to exceed the amount therefore specified in the GMP;

"Common areas and facilities" is defined as all of the Shopping Center improvements now or hereafter existing, excepting that area which is presently leased to tenants or leasable space, including, but not limited to, the parking areas provided by Landlord in the Shopping Center, the mall area (if any), the public conveniences of the Shopping Center, the delivery areas and service lanes, and all other areas in the Shopping Center now or hereafter constructed and intended to be used in common by, or for the benefit of, the tenants and/or customers of the Shopping Center.
