Mandatory Vaccination. Where permitted by law, a Producer may implement a policy providing that the following individuals19, 20 must be fully vaccinated against COVID-19 as a condition of employment and/or prior to entering the workplace, subject to reasonable accommodations as required by law for individuals who cannot be vaccinated due to disability or a sincerely held religious belief, practice, or observance:
Mandatory Vaccination. To ensure employee safety, Lambda Legal shall have the right to implement and modify mandatory vaccination policies for employees that Lambda Legal deems necessary and reasonable for the health and safety of its workforce, consistent with recommendations of public health authorities and informed by advice from the labor management committee on public health and safety established under Article 28 (Public Health and Safety) of this Agreement.

In jurisdictions where vaccinations are not available or where Government restrictions prevent Employees from receiving a first or second vaccination dose, Employees will satisfy the provision by making their best efforts to get fully vaccinated. A Producer that intends to implement such a policy on a particular commercial must notify the applicable Unions as soon as practicable. In addition, on a production by production basis, the Unions will consider and will not unreasonably deny an Employer’s request for mandatory vaccination of Employees beyond Zone A. The Union(s) shall reply to any request by the Employer as soon as possible but in no event longer than three (3) business days of such request.

To be considered “fully vaccinated” and “up to date” for purposes of this September 2022 Agreement, an individual must receive a full course of vaccination using a vaccine approved or authorized for use by the FDA, and one booster and must have passed the applicable waiting period for developing immunity using the vaccine, as recommended by the CDC. In jurisdictions where vaccinations are not available or where Government restrictions prevent Individuals from receiving first, second, or booster vaccination doses, Individuals will satisfy the provision by making their best efforts to get fully vaccinated.

Mandatory Vaccination. The COVID-19 vaccine is a key component of the University’s overall strategy and commitment to maintaining a safe and healthy workplace for its academic campuses and Michigan Medicine, to protect our patients, learners, and workforce members from COVID-19. Maximizing our COVID-19 vaccination rates will be key to identifying, mitigating, and managing possible infections throughout our organization, as the COVID-19 vaccine is the single most effective tool in helping combat the spread of COVID-19 and saving lives. Further, the COVID-19 vaccine is mandatory for all facility employees who do not have an approved medical or religious exemption pursuant to the Medicare and Medicaid Programs; Omnibus COVID-19 Health Care Staff Vaccination Interim Final Rule, 42 CFR Parts 416, 418, 441, 460, 482, 483, 484, 485, 486, 491, and 494, hereinafter referred to as “CMS COVID-19 Vaccine Mandate”. The University and the Michigan Nurses Association and University of Michigan Professional Nurse Council (the MNA/UMPNC or “the Union”) are committed to meeting these mutual interests and objectives and complying with the CMS regulations mandating the COVID-19 vaccine. The parties agree that:

Anyone that cannot be vaccinated for medical reasons, or for other protected grounds under the Ontario Human Rights Code, will need to request an exemption through Student Accessibility Services (▇▇▇@▇▇▇▇▇▇▇▇▇▇.▇▇) prior to arrival. Vaccine exempt persons must commit to regular testing to continue to be eligible to live in residence.
