Operational Considerations. Our operating results fluctuate within each quarter and from quarter-to-quarter making our future revenues and operating results difficult to predict While our sales cycle varies substantially from customer to customer, we usually realize a high percentage of our revenue in the third month of each fiscal quarter, and this revenue tends to be concentrated in the later part of that month. Our orders early in a quarter will not generally occur at a rate which, if sustained throughout the quarter, would be sufficient to assure that we will meet our revenue targets for any particular quarter. Moreover, our reorganization into business units, our shift in business emphasis to a more solutions-oriented sales process--undertaken in part to increase our average order size--and our transition from a one product to a multi-product company have resulted in longer and more unpredictable sales cycles for products and services. Accordingly, our quarterly results may be difficult to predict prior to the end of the quarter. Any inability to obtain large orders or orders in large volumes or to make shipments or perform services in the period immediately preceding the end of any particular quarter may cause the results for that quarter to fall short of our revenue targets. In addition, our operating expenses are based on expected future revenue and are relatively fixed for the short term. As a result, a revenue shortfall in any quarter could cause our earnings for that quarter to fall below expectations as well. Operational Considerations. You understand that use of RBFCUsend by you shall at all times be subject to (i) these Terms and Conditions, (ii) your express authorization for RBFCU to initiate a debit entry to your bank account, and (iii) the terms and conditions of your Membership Agreement with RBFCU. RBFCUsend operates on the Mastercard® Send platform. Once the Recipient has provided their card information, the transfer is considered “accepted” and the money is debited from your bank account (unless otherwise provided below), and may not be canceled or revoked. We therefore recommend that you use RBFCUsend to send money only to people you know and trust.
a) In most cases, when you are sending money to a Receiver, the transfer will occur in minutes; however, there are circumstances when the payment may take longer. For example, in order to protect you, RBFCU and the Recipient’s Financial Institution (FI), we may need additional time to verify your identity or the identity of the person receiving the money.
b) When you send money, we will send the intended Receiver a notification to accept the payment. If the Recipient does not accept the notification and provide their payment details within 24 hours, then the money will not be sent, and the transaction will be cancelled. You understand and acknowledge that the Recipient may fail to enroll with RBFCUsend, and/or otherwise ignore the payment notification. The money will not be debited from your account until the Recipient approves the transfer. Note: a transaction may be cancelled within the 24-hour period provided the Recipient has not accepted the transfer.
c) The money may also be delayed, or the transfer may be blocked, by RBFCU to prevent fraud or comply with regulatory requirements. If RBFCU delays or blocks a transfer that you have initiated, you will be notified accordingly.
d) RBFCU has no control over the actions of the Recipient, the Recipient’s FI or other financial institutions that could delay or prevent your money from being delivered to the intended Recipient.
e) RBFCUsend may be used to send funds to practically any Recipient who has a consumer or small business debit card in the U.S., for Mastercard or Visa-branded cards. Cross-border transactions are not allowed, nor supported as part of this Agreement.
Operational Considerations a. Measurement of water supplied
i. The quantity of bulk treated water supplied by the BWSP to Service Provider must be measured by flow meters located at points agreed between the BWSP and Service Provider and documented in the schedule to this agreement.
ii. To ensure their accuracy, the flow meters will be placed, tested and calibrated according to best industry practice or when requested by Service Provider or the BWSP and shall also be in accordance with the relevant guidelines.
iii. All costs associated with such testing or calibration must be met by the BWSP unless data and information obtained from flow meters are shared, in which case costs must be shared.
iv. The cost of any additional testing must be borne by the party making the request.
v. Data and information from flow meters must be made available on an integrated basis to each organisation’s telemetry and other relevant communications and monitoring systems.
vi. This information must be freely available to the regulatory board upon request.
b. Charges for the supply of water
Operational Considerations. The Parties shall use their best endeavors to reach a satisfactory level of on- time service performance at all ports of call by jointly design, review and optimize service rotations and all related operational arrangements.
