POSTING OF AVAILABLE POSITIONS. The assignment and reassignment of teachers is the responsibility of the Superintendent of Schools. The assignment and reassignment will be made in accordance with the needs of the schools as determined by the Superintendent. The decision of the Superintendent shall be final. The administration will publish a listing of all vacancies for the succeeding school year as soon as they are aware (notified in writing) of said vacancies. The listing will be updated as vacancies occur during the school year. A. Notice of vacancies of bargaining unit work, which result from nonrenewals, resignations, terminations, or the creation of new positions, will be sent to the principal of each building. B. A notice of all available positions will be posted by electronic messaging to bargaining member’s school message mailbox. C. Vacancies which are posted shall not be filled, except on a temporary basis, until the vacancy has been posted for at least ten (10) calendar days. D. After the first paycheck in July until the beginning of the next school year, vacancies which are posted shall not be filled, except on a temporary basis, until the vacancy has been posted for at least five (5) calendar days. E. When the Board decides to fill a supplemental vacancy, the position(s) shall be offered to: 1. Qualified, certified/licensed employees in the district. 2. Qualified, certified/licensed employees outside the district. 3. Qualified, neither certified nor licensed employees.

POSTING OF AVAILABLE POSITIONS. 11.1 When the District intends to fill any vacancy in a position covered by this agreement, the District shall post in a conspicuous place in each school building a notice which briefly describes the position available, the date of posting and where to apply for the same. A copy of such notice shall be sent to the Association. Such position shall not be filled until five calendar days (exclusive of Saturday and Sunday) after the date the position was posted, provided always that in the case of an emergency a temporary appointee may be made at any time. All paraprofessionals shall be given opportunity to make application for such position. 11.2 Work that is done by paraprofessionals in grant-funded positions shall continue to be done by paraprofessionals at the grant-funded rate or their current rate of pay. 11.3 Vacancies in summer work, evening and before or after school positions shall be posted and paraprofessionals shall be given the opportunity to make application for such positions. 11.4 If an Employee wishes a building transfer or change in assignment, he/she may make application therefor to the Superintendent. Said application shall be in writing and shall set forth the transfer or change sought and the reason therefor. The purpose of such application is to communicate with the Superintendent in a formal way of an employee’s desire for a different assignment. The Superintendent may but need not grant the request. The decision of the Superintendent shall be final and it shall not be subject to either the grievance or arbitration procedures. 11.5 A vacancy occurs only during the school year and after all paraprofessionals have been assigned to a position for that particular school year.
POSTING OF AVAILABLE POSITIONS. Whenever a teaching or extra-curricular position becomes available for assignment, the School District shall post, for a minimum of two weeks, notice of that available position unless a shorter time period is mutually agreed upon between the Association and the District. All postings shall be sent via email to all certified staff’s district email on the day the position is posted. The available position shall not be filled during that time, except in the case of an emergency or immediate need. a. The posting shall be made in each building, with a copy to the Association. b. Each posting shall indicate the date such notice is posted and the date the posting expires. i. Teachers may apply for transfer, assignment, or reassignment to an available position provided they 1) make written application prior to the expiration date of the notice, and 2) possess a valid certificate/license to teach/direct/coach in the subject area, the grade level, or activity that requires such licensure.

No position will be filled before one week (five working days) after posting to allow all qualified staff to apply for vacancies. The Superintendent determines who shall fill the vacancies. No assignments will be made until all staff candidates have been screened and, in the Superintendent’s judgment, the best person has been selected for the position. Any staff candidate that is adjudged not qualified will receive a signed letter from the Superintendent stating his/her reasons for deeming the employee not qualified for the position. If no staff candidate is adjudged qualified by the Superintendent, persons from outside the system will be considered.
POSTING OF AVAILABLE POSITIONS. For the opening of a new school, the first posting for those schools affected by the opening will be made within (5) working days of the appointment of the Principal but no later than February 15.

  • Job Postings and Applications ‌ If a vacancy or a new job is created for which union personnel might reasonably be recruited, the following shall apply: (a) If the vacancy or new job has a duration of thirty (30) calendar days or more, the vacancy or new job including salary range, a summary of the job description, the required qualifications, the hours of work, including start and stop times and days off, the work area and the commencement date shall, before being filled, be posted for a minimum of seven (7) calendar days, in a manner which gives all employees access to such information, provided that no employees shall be entitled to relieve other regular employees under this clause on more than two (2) occasions in one calendar year unless the Employer and the Union otherwise agree in good faith. (b) Notwithstanding (a) above, if a temporary absence is one of less than ninety (90) calendar days, the work of the absent employee may be performed by employees working in float pool positions, where float pools exist. (c) Notwithstanding (a) above, if the vacancy is a temporary one of less than ninety (90) calendar days and the work is not being performed by a float employee, the position shall not be posted and instead shall be filled as follows: (i) where practicable by qualified regular employees who have indicated in writing their desire to work in such position consistent with the requirements of Article 14. Should a vacancy under this Article result in backfilling of more than one (1) vacancy (including the initial vacancy) the second (2nd) vacancy may be filled by an employee registered for casual work unless the Employer and the Union agree otherwise in good faith. If the application of this paragraph requires the Employer to pay overtime to the employee pursuant to Article 19, the proposed move shall not be made. An employee who accepts work under this provision is not eligible to work in another Article 16.01(c) assignment that conflicts with the accepted one. Probationary employees and employees undergoing a qualifying period shall not be considered for a 16.01(c) assignment in a different classification. (ii) by employees registered for casual work in accordance with the casual addendum. (iii) in cases of unanticipated or unplanned temporary absences, such temporary absence may first be filled under (c)(ii) for a period of up to seven (7) days. (d) A part-time employee who has accepted a casual assignment which conflicts with a temporary vacancy referred to in paragraph (c)(i) above shall be considered unavailable for such temporary vacancy. A part-time employee who has accepted a temporary vacancy referred to in paragraph (c)(i) above which conflicts with a casual assignment shall be considered unavailable for such casual assignment. Where an employee declines an offer to work under (c)(i) the Employer need not offer the work again to that employee under (c)(ii), if she/he is also registered for casual work. (e) Existing local agreements will be in force and effect (including termination clauses) unless changed by mutual agreement by the parties at the local level. (f) Where the local agreement covering access to work by part-time employees (former “15.01c”) does not contain a termination clause, the agreement may be terminated on giving of six (6) months’ notice by either party. (g) By mutual agreement, the parties may vary the job posting process set out in Article 16.01.
