PURPOSE OF THESE TERMS. The purpose of these Terms is to set the respective rights and obligations of MVO Portugal and the End User with respect to the connection, access to and use of the MVO Portugal National System by the End User in order to verify the authenticity of, and to decommission, the unique identifier of medicinal products in accordance with the provisions of the EU Directive on Falsified Medicines and the Delegated Regulation (the “Purpose”).

In the case of conflict between the Terms and any of the accompanying Schedule(s), the terms of the relevant Schedule shall prevail.

It is expressly agreed that EMVO and the NMVOs develop and operate the EMVS, including the European Hub and the National Systems, in view of the verification of the authenticity and the decommissioning of the unique identifiers of medicinal products in accordance with the provisions of the EU Directive on Falsified Medicines and the Delegated Regulation, to be operational by 8 February 2019, at 23:59:59 CET at the latest. The EMVS, including the European Hub and National Systems, is therefore still being designed, developed and tested and could therefore be substantially amended, without any indemnity being due to the IT Service Provider.
