Regular Meal Break. 37.1.1. To be 30 minutes to 1 hour duration scheduled to coincide with individual run requirements. ▇▇▇▇▇ breaks to be taken on the road when required and paid at ordinary time. 37.1.2. This meal break must commence no earlier than three and a half hours and no later than five and a half hours after the employee’s fixed starting time of ordinary hours of work. However, where it is reasonable and practicable the meal break may be arranged to be in balance with the ordinary hours of work. 37.1.3. If a meal break is not allowed to an employee, the time worked after five and a half hours after the fixed starting time until the break without pay is allowed, will be paid at the rate of ordinary time, the payment to be in addition to any payment due in respect of a weekly or casual wage.
Regular Meal Break. 7.1 A Depot Employee must be allowed a regular unpaid meal break during the ordinary hours of work except where unforeseen extraordinary circumstances arise. 7.2 The meal break must: (a) be of a regular duration of not more than one hour or less than 30 minutes; (b) commence no earlier than three and a half hours and no later than five and a half hours after a Depot Employee’s fixed starting time of the ordinary hours of work; and (c) where reasonable and practical, be taken at a time to coincide with any requirement to take a break under fatigue management rules/regulations, or as otherwise required by LT. LT and a Depot Employee may agree to any alteration to the arrangement for taking breaks to suit the work at hand. This may include splitting the break into separate periods. 7.3 As far as is reasonably possible, Depot Employees working more than nine hours will be allowed to take an additional break of up to 20 minutes during any engagement. This shall be taken in a flexible manner in order to accommodate operational requirements. This may include being taken in separate periods. Such a break will be paid at the Depot Employee’s base ordinary rate of pay. 7.4 There will be no requirement to a break on any day that a Depot Employee works less than 5 ½ hours.
