No Requirement. Nothing in this Agreement shall require any Lender to exercise any such right or shall affect the right of any Lender to exercise, and retain the benefits of exercising, any such right with respect to any other indebtedness or obligation of the Borrower. If, under any applicable bankruptcy, insolvency or other similar law, any Lender receives a secured claim in lieu of a set-off to which this Section 2.10 applies, such Lender shall, to the extent practicable, exercise its rights in respect of such secured claim in a manner consistent with the rights of the Lenders entitled under this Section 2.10 to share in the benefits of any recovery on such secured claim.

The governing board of a junior college district located wholly or partly in a county with a population of more than three million may contract to provide remedial programs described above with the governing board of any independent school district located wholly or partly in a county with a population of more than three million. High school students who have passed all sections of the STAAR EOC assessments with the high school graduation standard may be permitted to enroll in state-funded developmental courses offered by a college at the college discretion if a need for such coursework is indicated by student performance on an assessment instrument approved by the Coordinating Board. Remedial and developmental courses may not be offered for dual credit.
No Requirement. The Company shall not be required to issue fractional shares of Common Stock on the exercise of Warrants.
No Requirement. The Supplier will provide and maintain a detailed, fully resourced and costed exit and transition plan to ensure the smooth transition of Services to a successor service provider.

No Requirement. The Supplier must ensure that a security manager is appointed who shall have ultimate responsibility for all aspects of information governance and security management relating to the Supplier Services.
No Requirement. Except for the purpose of compliance with the standards set out in section 12.3 of this Article in respect of Canada, and section 12.4 of this Article in respect of Manitoba, nothing in this Article shall, or shall be deemed to, require the provision by the governments of Canada or of Manitoba of any Funding and Programming. Nothing in this Article shall require the maintenance or continuation of any Funding and Programming, or require that any particular terms or form of Funding and Programming be established or maintained.
