RESTRICTIONS ON THE USE OF SERVICES. 10.1. While using Services it is prohibited to: 10.1.1. breach this Agreement, other applicable supplements, agreements, legislation, including but not limited to, anti-money laundering and counter-terrorist financing regulations; 10.1.2. use Services for any illegal purposes, including, but not limited to fraud and money laundering; funding of terrorist organizations; unlawful sexually oriented materials or services; counterfeit products; unlawful gambling activities; unlawful purchase or sale of tobacco, firearms, weapons, war ammunition, prescription drugs, other controlled substances; unlawful trade of currency (Forex), binary options or other products prohibited by law; unlawful provision of financial or investment services; 10.1.3. infringe Verifo or Agent or any third party’s copyright, patent, trademark, trade secret or other intellectual property rights, or rights of publicity or privacy; violate any rights of third parties; 10.1.4. spread computer viruses and undertake other actions that could cause Agent and/or Verifo System malfunctions, information damage or destruction and other damages to Verifo and/or Agent; 10.1.5. conduct your business or use the Services in any manner that is likely to result in or may result in complaints, disputes, reversals, chargebacks, fees, fines, penalties or other liability to Verifo and/or Agent, other clients, third parties or You; 10.1.6. request to perform a transaction or to receive a payment from restricted countries or persons; 10.1.7. provide Verifo and/or Agent with false, inaccurate or misleading information; 10.1.8. refuse to provide Verifo and/or Agent information or undertake other actions that are reasonably requested by Verifo and/or Agent; 10.1.9. refuse to cooperate in an investigation or provide confirmation of Your identity or any information You provide to Verifo and/or Agent; 10.1.10. instruct Verifo and/or Agent to send or receive what Verifo and/or Agent reasonably believe to be potentially fraudulent funds on Your behalf; 10.1.11. reveal any passwords and other Personalized Safety Features to anyone or use anyone else’s passwords and other Personalized Safety Features; 10.1.12. conduct Your business or use the Services in any manner that may cause risk to Verifo and/or Agent. 10.2. If Verifo or Agent believe that You might have breached these provisions, Verifo or Agent may take actions to protect themselves, other clients and third parties. RESTRICTIONS ON THE USE OF SERVICES. 3.1. To use our services, you need a POS printer, a compatible mobile device, and an Internet Connection Service offered by a third-party provider. According to local legislation, you may need other equipment (fiscal printers and the like) offered by a third party. Such third-party providers may charge you for the purchase or use of a mobile device and/or Internet connection to access services. You are solely responsible for paying such costs yourself. 3.2. By agreeing to these Terms, you acknowledge that you are a natural or legal person acting exclusively for your own commercial or professional purposes and that, at the time of signing these Terms, you are authorized to operate in one or more of the countries we support (the "territories"). The list of territories is published and periodically updated on our website. If you are a natural person, you must be eighteen (18) years old or older to use our services. We can always ask you to provide us with proof of your age. 3.3. By accepting these Terms, you also agree to the rules of the network ("network rules") set by credit institutions, including but not limited to Visa, MasterCard and American Express (together with "card schemes"). The network rules may require some of our traders to conclude an additional contract with one of our partner banks or one of the card schemes according to the amount of transactions. In that case, we'll let you know about it and offer you a separate contract. RESTRICTIONS ON THE USE OF SERVICES. 25.1. incard will use its sole discretion based on its own risk assessment (which will change from time to time) when deciding whether to allow a prospective client to open an incard Account and whether to close open incard Accounts. 25.2. The following is a non-exhaustive list of examples of businesses which are outside our risk assessment, you must inform us if any of these become applicable to you (a) businesses or businesses with persons associated with it that are (i) suspected or convicted of financial crime or any other offence or action that carry a reputational risk for incard; (ii) subject to economic sanctions; (iii) highly rated politically exposed persons; (iv) suspected or convicted of terrorism and related offences; (v) knowingly providing false information to incard relating to their identity or business activities; (b) businesses that are: (i) actively involved in crypto or virtual currencies; (ii) traders of precious metals and stones; (iii) operating as a money service business; (iv) involved in banking and similar financial services; (v) active in the betting and gambling industry; (vi) active in trading with unlicensed drugs; (vii) trading in weapons and armaments; (viii) operating bidding fee auctions; (ix) operating unlicensed scrap metal dealership; (x) active as unregistered waste management businesses. 25.3. It is not permitted to: (a) use the Services for any illegal purposes. incard will report any suspicious activity and cooperate with any relevant law enforcement agency or regulator; (b) use the Services to abuse, exploit or circumvent the usage restrictions imposed by a merchant on the services it provides, or to obtain goods or services without paying the amount due partially or in full; (c) breach these Terms or any other agreement or policy that you have agreed with incard or with the incard Card Issuer; create more than one incard Account without our prior written consent; use the Services to violate any law, statute, ordinance, or regulation; use the Services for any illegal purposes including the purchase or sale, or the facilitation of the purchase or sale of, illegal goods or services; (d) infringe incard’s or any third party’s copyright, patent, trademark, trade secret or other intellectual property rights, or rights of publicity or privacy; (e) act in a manner that is defamatory, libellous, threatening or harassing when using the Services; (f) harass our employees, agents, or other users of incard; (g) provide us wi...
RESTRICTIONS ON THE USE OF SERVICES. Except to the extent expressly permitted by this Agreement, the Merchant shall not: - make the Ivy Services available to any third party; - disassemble, decompile or reverse engineer all or any part of the Services except to the extent permitted by Applicable Laws; - mask or hide from ▇▇▇ the identity of the Merchant Platform as it connects to the Ivy API; - access or attempt to access the Services except from the Merchant Platform through the Ivy API; - do anything to impair the functionality or availability of the Ivy Service; and - use the Ivy Services in a way that: (i) may damage our or any other person’s computer systems, computing devices, software or data or which otherwise causes damage or injury to any person or property; (ii) is unlawful, harmful, threatening, defamatory, obscene, infringing, harassing or racially or ethnically offensive; (iii) is discriminatory based on race, gender, color, religious belief, sexual orientation, disability, or is otherwise illegal or facilitates illegal activity;
RESTRICTIONS ON THE USE OF SERVICES. 5.1 Nationals and residents of the USA and Canada are not entitled to receive these Services. 5.2 You must not allow others to use these Services on your behalf, unless expressly allowed in the insurance policy. 5.3 You are not allowed to use the Services in judicial or regulatory proceedings. 5.4 You are not allowed under any circumstances to: (a) use the Services in a manner that might be considered as offensive or may interfere with the use by anyone else; (b) disable, circumvent or tamper with our security systems; (c) attempt to disable, circumvent or tamper with any of the restrictions when copying or duplicating any contents accessible through our Services; (d) attempt to gain access to any personal data that may be stored in our Services on behalf of other Users; (e) attempt to use the services for purposes other than those set out in these Terms of Use; or (f) upload any data containing viruses or any other harmful computer code(s) restricting the functionality of the Services. 5.5 We do not tolerate any abusive or offensive behaviour.

  • Restrictions on the Fund Neither you nor any beneficiary may sell, transfer, or pledge any interest in your ▇▇▇▇ ▇▇▇ in any manner whatsoever, except as provided by law or this agreement.   • Restrictions on Use This ▇▇▇▇ grants You the right to install and use the Licensed Materials in accordance with the terms under which You have licensed the Licensed Materials from Altium. Notwithstanding the foregoing, Altium permits You to make a Temporary Use of the Licensed Materials so long as such use does not result in the use of more copies of the Licensed Materials than You are permitted to use at any given time, if Your license is so restricted hereunder. In the event that You desire to expand or extend Your use, or to migrate to different Products or functionality within any such Products You must notify Altium prior to any such expanded or extended use and arrange for the licensing of the applicable Licensed Materials. 2.4.1. In no event shall You: a) allow any of Your affiliates, subsidiaries or divisions, any portion of Your business located at a different geographic site, or third parties, to copy, have access to or use any portion whatsoever of the Licensed Materials unless You have licensed the Licensed Materials on a Continental License or Global License basis that would permit such use; notwithstanding the foregoing, You may make a Temporary Use of the Licensed Materials as stated in Section 2.3 above; b) allow any third party to have access to or use any portion whatsoever of the Licensed Materials, unless such access or use is in connection with a Temporary Use by You in carrying out a legitimate business purpose that does not otherwise violate the terms of this ▇▇▇▇, including but not limited to the restrictions on number of users, if such restrictions apply to Your license hereunder; c) make copies of the Licensed Materials for use by any of Your other affiliates, subsidiaries or divisions, or by any third party; d) allow more than the number of permitted persons to access and use the Licensed Materials at any one time, (whether involving a single license or a license that allows multiple users), including any Temporary Uses, unless you have negotiated with Altium for a license that permits an unlimited number of users to access and use the Licensed Materials; e) allow persons not covered by the geographic scope of Your licenses to use the Licensed Material on a “floating” or other basis; or f) using the Licensed Materials in any way that is not in compliance with Permitted Uses. 2.4.2. In the event that You have licensed the Licensed Materials for use in connection with a single computer, You may install and use only a single copy thereof at any given time, and said copy may be used only by You; provided, however, that if You have licensed the Licensed Materials for use on a single computer: a) you may install a second copy of the Licensed Materials on a home computer solely for use in connection with, and governed by, the License granted herein, so long as such copy is never used simultaneously with the original copy; and b) You may make a back-up, archival copy thereof that You shall install and use only in the event the original copy of the Licensed Materials is lost, corrupted or in some other way made unavailable other than through use or possession by another person. 2.4.3. In the event that You have licensed the Licensed Materials on a Single Site License, Continental License or Global License basis, this ▇▇▇▇ allows as many persons employed or hired as contractors (so long as such contractors have entered into an appropriate form of confidentiality agreement) by You to simultaneously use the Licensed Materials as are permitted under the license obtained from Altium. At no time shall You permit the number of persons that may access and/or use the Licensed Materials to exceed the number of persons for whom You have licensed the same, including in connection with any Temporary Use. You understand and agree that such use beyond that licensed hereunder, whether by allowing excess persons to use the Licensed Materials or otherwise, shall constitute not only breach of this ▇▇▇▇, but violation of national and international copyright and patent laws. ENGAGING IN ANY USE OF THE LICENSED MATERIALS BY PERSONS BEYOND THE NUMBER PERMITTED TO USE THE SAME, AT SITES FOR WHICH THE LICENSED MATERIALS ARE NOT LICENSED (EXCEPT FOR PERMITTED TEMPORARY USES) OR BY PERSONS NOT AUTHORIZED UNDER YOUR LICENSE TO USE THEM SHALL RESULT IN IMMEDIATE TERMINATION OF THIS ▇▇▇▇, WHETHER OR NOT ALTIUM IS AWARE OF YOUR ACTIVITIES AT THE TIME OR DISCOVERS THEM LATER. ANY FURTHER USE OF THE LICENSED MATERIALS BY YOU SUBSEQUENT TO SUCH TERMINATION WILL EXPOSE YOU TO LIABILITY FOR COPYRIGHT INFRINGEMENT AND OTHER CLAIMS. 2.4.4. You may increase the number of persons or sites permitted to use the Licensed Materials at any one time, or the features and functionality of Your Licensed Materials through Extensions or otherwise, by paying Altium additional license fees in accordance with then-applicable pricing, provided that such additional persons in no way access or use the Licensed Materials, or the additional functionality, prior to any such additional license fees being paid by You. In the event that any provision of this ▇▇▇▇ is breached by You, the license granted herein shall automatically terminate, without further action by Altium and whether or not You abide by such termination. Failure of Altium to learn about any such breach shall not constitute a basis for You to assert that You are not in breach hereof, or that Altium has acquiesced in such breach.
