Scheduling of Compensatory Time. Current systems of accumulating and scheduling compensatory time shall continue if consistent with this Section. The issues of accumulation, scheduling and pay-off of compensatory time for any classification, including those designated as Code 3, covered by this Agreement will be subject to secondary negotiations. When compensatory time credits have been earned by an employee for overtime work or work performed on a holiday, this accrued time shall be used at the convenience of the employee subject to supervisory approval based on criteria applicable to annual leave. However, if the Employer does not permit the employee to use accrued compensatory time credits before the end of the fiscal year in which the credits have been earned, the employee may be paid in cash at the regular rate for the compensatory time credits unused at the end of the fiscal year. Unused compensatory time credits which are not paid shall be carried to the next fiscal year. The employee may carry over eighty (80) hours compensatory time credits unless otherwise agreed upon in secondary negotiations. Compensatory time shall be taken before annual leave except where an employee at the allowable annual leave cap would thereby lose annual leave. Unused compensatory time credits of an employee who resigns, retires, or transfers to a different Appointing Authority shall be paid at a rate not less than the employee's current regular hourly rate or the average regular rate received by such employee during the last three (3) years of the employee's employment, whichever is higher. Unused compensatory time credits of an employee who is laid off shall be paid in the manner of annual leave prior to such layoff.
Scheduling of Compensatory Time. Employees shall not be permitted to submit requests for 15 compensatory time off earlier than thirty (30) days prior to the date for which the use of 16 compensatory time is requested. An employee will be permitted to take compensatory time off 17 within a reasonable time after requesting it provided that it will not create additional overtime 18 unless approved by the Chief or his designee(s). If multiple requests are received for use of 19 compensatory time during the same time period, seniority will determine which employee is 20 permitted to take compensatory time. 22 Scheduling of vacation leave prior to or after compensatory leave requests. Prior requests 23 for vacation time will supersede requests to use compensatory time off at the same time. No 24 vacation request made after the compensatory time off has been granted will be honored for any 25 of the same hours off. 27 Response to request for compensatory time off. The Chief or his designee(s) shall grant or 28 deny the employee’s request for compensatory time off within five (5) days of its submission to 29 him/her. In the event the prohibition of allowing compensatory time to be used if it would create 30 additional overtime is determined to be unenforceable by a court of competent jurisdiction in a 31 case brought or supported by the Union, the restrictions upon accumulation and annual use of 32 compensatory time off in lieu of pay for overtime shall be reduced to twenty-four (24) and forty- 33 eight (48) hours respectively.

Scheduling of Compensatory Time. An employee shall be entitled to a leave with pay to the extent of earned compensatory time. The request of an employee to schedule compensatory time leave must receive the prior approval of a supervisor not in the bargaining unit to assure that the scheduling of compensatory time leave will not occur during a critical time period or otherwise disrupt essential services. In the absence of a request from the employee to utilize accumulated compensatory time, a supervisor not in the bargaining unit shall have the right to require the employee to schedule a compensatory time leave during a period designated by the supervisor.
Scheduling of Compensatory Time. The following applies to scheduling of compensatory time off when the Prospect Dispatch center, or any of the four regular shift schedules is running at minimum staffing levels as determined by the Department (2012 minimum staffing is defined as two dispatchers). For the purposes of scheduling compensatory time off, staffing levels of each of the four regular shift schedules will be considered individually: i. Employee may only request the amount of compensatory time off they have already accrued. Schedule changes must be approved by the Fire/EMS Dispatch Supervisor or Communications Division Chief during regular business hours or when they are available and on site. Regular business hours are defined as Monday through Friday from 8 AM to 5 PM excluding designated holidays. ii. Requests for scheduling of compensatory time off must be submitted no fewer than 14 calendar days prior to the shift being requested. The City will grant requests on a first-come basis, provided that volunteer coverage for the 12 hour overtime shift is found. All requests for compensatory time shall be approved or denied within 7 days of the request. Volunteer coverage will follow the normal overtime hiring process. Should volunteer coverage only be found for 4, 6, or 8 hours of the 12-hour shift, the employee requesting the time off has the option of only taking the partial hours or cancelling the request. iii. The department reserves the right to cancel scheduled compensatory time up to 48 hours before the time scheduled off is taken, except that the first two bid compensatory time days each quarter cannot be canceled, once approved. iv. Should the employee ask to cancel his/her scheduled compensatory time off, the Department will automatically cash out the scheduled time. Under rare circumstances and upon an employee's written request, the Fire Chief has sole discretion to allow an employee to retain the cancelled time in his/her accrued compensatory leave bank. v. Should the Department request that the employee work during his/her scheduled compensatory time, the employee will have the option of cashing out the time or retaining the time in his/her accrued compensatory leave bank. vi. Employees may request, through the Fire Chief or their designee, to reschedule non-bid compensatory time.   • Compensatory Time A Bargaining Unit member may choose to take compensatory time in lieu of overtime compensation if such choice is indicated during the tour of duty in which the overtime is worked. Compensatory time shall be credited to the Bargaining Unit member and accumulated at the rate of one and one-half (1 ½) hours for each overtime hour worked. Each Bargaining Unit member’s compensatory time bank shall be limited in accumulation to a maximum number of two hundred forty (240) hours. Once a Bargaining Unit member has reached the maximum hours of compensatory time as compensation for overtime hours worked, all additional overtime will be paid. The Bargaining Unit member may choose to carry over any balance into the following year. Any balance of compensatory time carried over into the following year shall count towards the two hundred forty (240) hour cap in that year. Compensatory time off must be taken at a time agreeable to the Department and the Bargaining Unit member. Approval for compensatory time off shall not be unreasonably withheld. Compensatory time off should be requested as far in advance as possible but no later than forty eight (48) hours in advance. When Bargaining Unit members request compensatory time off at least 45 calendar days in advance, the employer will, within five (5) working days of the request being made, notify the member whether or not his/her request has been approved. Approval for compensatory time shall not be unreasonably withheld. As soon as the employer notifies the member that his/her request has been approved, and if the employer determines that the shift will be filled, the employer will post the overtime assignment to cover the member’s request. If there are no volunteers to cover this need for overtime, and if the employer determines that the shift will be filled, a mandate to cover the shift will occur no less than seven (7) calendar days in advance of the beginning of the shift that needs to be covered. The employee being mandated will have the lowest number of overtime hours worked and will be notified by a supervisor.   • Use of Compensatory Time An employee must have the appropriate supervisor's prior approval to use accumulated compensatory time.

  • Compensatory Time Use An employee must use compensatory time prior to using vacation leave, unless this would result in the loss of their vacation leave or the employee is using vacation leave for domestic violence leave. Compensatory time must be used and scheduled in the same manner as vacation leave, as in Article 11, Vacation Leave. Employees may use compensatory time for leave as required by the Domestic Violence Leave Act, RCW 49.76. The Employer may schedule an employee to use their compensatory time with seven (7) calendar days’ notice.

  • Overtime and Compensatory Time Overtime work shall be compensated as follows: A. Hours in an active pay status in excess of forty (40) hours in any calendar week shall be compensated at the rate of one and one-half (1 1/2) times the total rate of pay, as defined by Section 43.01, for each hour of such time. Total rate of pay includes the base rate plus longevity, all applicable supplements, and shift differential where applicable. B. An employee may elect to take compensatory time off in lieu of cash overtime payment for hours in an active pay status more than forty (40) hours in any calendar week. Such compensatory time shall be granted on a time and one-half (1 1/2) basis. C. The maximum accrual of compensatory time shall be two hundred forty (240) hours and compensatory time must be taken within one (1) year of its being earned. D. When the maximum hours of compensatory time accrual is rendered, payment for overtime work shall be made in cash. Compensatory time not taken within one (1) year shall be paid in cash to a maximum of eighty (80) hours in any pay period. E. Compensatory time is not available for use until it appears on the employee’s earnings statement and on the date the funds are made available. F. Upon termination of employment, an employee shall be paid for unused compensatory time at a rate which is the higher of: 1. The final total rate received by the employee, or 2. The average total rate received by the employee during the last three (3) years of employment. For the purposes of this Article, active pay status is defined as the conditions under which an employee is eligible to receive pay, and includes, but is not limited to, vacation leave and personal leave. Sick leave and any leave used in lieu of sick leave shall not be considered as active pay status for purposes of this Article. Compensatory time requests must be submitted in writing twenty-four (24) hours in advance of the anticipated time off, unless the need for time off is of an emergency nature.

  • Compensatory Time Off Utilization of compensatory time off shall be by mutual agreement between the department head and the employee. The smallest increment of compensatory time which may be taken off is six (6) minutes.
