Supervision of Work by Contractor. Before starting the Work, Contractor shall designate, in writing, a representative having authority to act for Contractor, and may designate an alternate representative. The representative or alternate shall be present at the work site when Work is in progress. Orders or communications given to this representative shall be deemed delivered to the Contractor. In the absence of the Contractor or designated representative, directions or instructions may be given by the City Representative to the superintendent or ▇▇▇▇▇▇▇ having charge of the specific work to which the order applies. Such order shall be complied with promptly and referred to the Contractor or the representative.
Supervision of Work by Contractor. 6.6.1 The Contractor shall supervise and direct the work, using professional best skill and attention. The Contractor shall be responsible for assigning appropriately qualified personnel for the specified work. 6.6.2 The Contractor shall be responsible to the County for the acts and omissions of its employees, subcontractors, and their agents and employees, and other persons performing any of the work under a contract with the Contractor. 6.6.3 The Contractor shall designate a project manager to act on its behalf that shall be responsible for matters pertaining to the Contractor’s performance of services and shall have authority to accept service of all notices which the County desires to serve, or which are required by this Contract to be served on the Contractor. The Contractor shall advise the County in writing of the name, address and telephone number of such designated representative and of any change in such designation. 6.6.4 The Contractor’s working project manager must be available to County management during designated working hours and available through a cell phone or paging system during non-working hours to ensure problems, working conditions, complaints, coordination and any other necessary matters in connection with the work are satisfactorily attended to. The Project Manager must have the ability and authority to act for the Contractor in matters relating to the Contract.

During construction, reconstruction, repair, alteration of or addition to any detention facility, the Board of State and Community Corrections ( BSCC), as provided by the California Code of Regulations, shall make such inspection as in its judgment is necessary or proper for enforcement of applicable Regulations, and the protection of the safety of inmates, supervisory personnel, and the public. If at any time as the Work progresses, prior to the issuance of the final approval, it shall be found that modifications or changes are necessary to secure safety, the BSCC may order such modifications or changes. Refer to Title 24, California Code of Regulations. B. Contractor shall supervise, inspect, and direct Work competently and efficiently, devoting the attention and applying such personal skills and expertise as may be required and necessary to perform Work in accordance with Contract Documents. C. Contractor is fully responsible for Contractor’s own acts and omissions. Contractor is responsible for all acts and omissions of its subcontractors, suppliers, and other persons and organizations performing or furnishing any of the Work, labor, materials, or equipment under a direct or indirect contract with Contractor. D. Contractor shall be solely responsible for and have control and charge of construction means, methods, techniques, sequences and procedures, safety precautions and programs in connection with the Work. Contractor shall be responsible to see that the completed Work complies accurately with Contract Documents. E. Contractor shall keep on the Site at all times during Work progress a competent resident Superintendent, who shall not be replaced without Owner’s express written consent. The Superintendent shall be Contractor’s representative at the Site and shall have complete authority to act on behalf of Contractor. All communications to and from the Superintendent shall be as binding as if given to or by Contractor. F. Administration of design and construction shall include the following delineations of responsibilities pursuant to Title 24, California Code of Regulations. Contractor shall perform as required, including, but not limited to verified reports.

Supervision of Work by Contractor. The contractor shall personally supervise the work or furnish at all times a duly authorized representative, who shall receive and execute all orders given by the Project Director. Such orders so given to and received by said representative shall be deemed to have been given to and received by the Contractor. Supervisory personnel must be available locally, twenty-four (24) hours a day, seven (7) days a week until all items have been completed and under this Contract.
